History of the Site On April 24, 1979, the Commission considered the same applicant's request for the rezoning of this site to multifamily. The request was denied, but the site was ultimately rezoned for duplex use. Petitions from 57 neighborhood objectors were submitted. B. Existin2 Conditions This site is currently a wooded tract which slopes very steeply east to west. It is located in an area that generally consists of "R-4" and "R-5" zoning. Access to the site is currently provided by a gravel access easement off Beechwood and an alley in fair condition running north "I" Street. Allsopp Park abuts on the north. C. Development Proposal The applicant is requesting that he be allowed to replat a parcel of .37 acres into two lots for use as duplexes. The access proposed for the new development will be the same as that existing currently; a 20-foot valley on the south and a 13-foot access easement on the west. September 13, 1983 3 UBDI V JPSIZ. NS Item No. 1 - Continued D. Engineering Considerations The 13-foot access easement does not appear to be adequate. We request a plan with grades for proposed access, and for access between lots, plus internal drainage plan. E. Analysis This proposal has a significant problem with access. The only dedicated access to the site is a 20-foot alley, which is now partially in use by neighbors. The other portion is unconstructed. The second means of access will be through a 13-foot private access easement that currently leads to the rear of an apartment building. It is unimproved and consists of a rather steep grade. At the time of this writing, staff had not yet received comments from the Fire Department. It is imperative that they approve of this request. A topographic survey is definitely needed in this instance, so as to indicate where the lot lines lie in respect to grade and access. F. Staff Recommendation Comment is reserved until additional information is received. SUBDIVISION COMMITTEE REVIEW: The applicant was represented by Mr. Allen Curry. Along with the owner, they presented their case for the replatting of the two lots in question. The Committee discussed this issue at length receiving comments from both the Planning and Engineering staffs. The only issues remaining to be resolved by the applicant are specific layout and design on the location of the 131 driveway and its connection with the parking lots on both lots as well as the alley. The applicant was directed to prepare design work in this direction prior to the meeting on July 12. PLANNING COMMISSION ACTION: (July 12, 1983) Mr. Bek Kaiser, the owner, was present in support of the application. Since the revised plan was not submitted, the Commission voted to defer this item until the July 26th public hearing. The motion passed by a vote of 9 ayes, 0 noes and 2 absent. September 13, 1983 SUBDIVISIONS Item No. 1 - Continued PLANNING COMMISSION ACTION: (7-26-83) Staff reported that a letter had been received from the applicant requesting deferral until the September 13th Planning Commission meeting. A motion was made and passed to this effect. The vote was: 10 ayes, 0 noes and 1 absent. SUBDIVISION COMMITTEE REVIEW: Staff reported that the applicant had requested a deferral until a revised plan could be submitted. PLANNING COMMISSION ACTION: ( 9-13-83 ) The applicant in this matter requested a deferral. However, the Planning Commission felt that withdrawal and a new application at a later would be in order. The Commission then voted unanimously to withdraw the matter from further consideration. The vote - 11 ayes, 0 noes.
