OF NEW ST.: 0 PROPOSED USES: Commercial VARIANCES REQUESTED: Waive any improvements on Mabelvale Cutoff, as present owner installed street to City standards in the 19701s. A. History of the Site On May 24, 1983, against the recommendation of the staff, the Planning Commission approved the rezoning of this site from 11R-2" Single Family to "C-3" Commercial. On June 21, 1983, the City Board also voted in favor of the request. The applicant maintained a position that this tract was reserved for further commercial development at the time of platting several years earlier. Staff argued that no commitment was made. B. Existing Conditions The site is flat and covered with grass and a few scattered trees. To the north is an apartment complex, and to the east is a commercial use, both developed by the applicant. The western and southern abutting properties consist of vacant land. All street improvements are in place. c. Development Pro osal This is a proposal to subdivide a tract of two acres into three lots for commercial use. A waiver of street improvements along Mabelvale Cutoff has been requested. July 12, 1983 SUBDIVISIONS Item No. 1 - Continued D. Engineering Considerations Dedicate necessary right-of-way for minor arterial streets. Street improvements were previously installed. E. Analysis Staff has no major problems with the request. The applicant has asked to limit curb cuts to one per lot, so as to minimize traffic flow onto Mabelvale Cutoff. The waiver of street improvements formerly requested is not needed since improvements are in place. Commercial subdivisions abutting residential developments are required to provide a 40-foot buffer and 6-foot fence between the two uses. F. Staff Recommendation Approval, subject to comments made. SUBDIVISION COMMITTEE REVIEW: The applicant was represented by Mr. Allen Curry. There was a brief discussion of the history of the case relative to rezoning. The Committee determined there were no problems of significance associated with this request. PLANNING COMMISSION ACTION: The applicant was not present. Staff reported that Allan Curry, the Engineer, requested that the Commission consider the item in spite of his absence, since he had to appear in court. A motion was made and passed for approval, subject to: (1) Dedication of necessary right-of-way for minor arterial streets. (2) Limitation of curb cuts to one per lot. (3) Provision of buffer and fence as required by Ordinance. The motion passed by a vote of 9 ayes, 0 noes and 2 absent.
