A. History of the Site
This site has been identified by metes and bounds
description. On the June 28th Commission, the
applicant has requested to rezone an abutting
residential tract to "C-3" so as to provide access to
Lot 12 for a new proposal.
B. Existinq Conditions
The land involved is flat with a large wooded portion
on the west and one commercial use on Lot 12. It is
bordered on the north by Worthen Bank and on the south
by a commercial use and several residential uses. Nova
Lane is a very poorly constructed street with numerous
potholes and imcomplete curb and gutter. Frenchman's
Lane on the west is fully improved.
C. Development Proposal
This is a proposal to plat three lots for commercial
use. It was prompted by the applicant's desire to
develop a Mexico Chiquita Restaurant on Lot 12.
Lot 12's depth is being increased, and the plat
includes unplatted property to the west of the lot.

D. Engineerinq Considerations
Improve Nova Lane to residential street standards.
E. Analysis
Staff has no objections to the request, provided that
the proper street improvements are made. The applicant
is simply platting the remnants of previous
developments and expanding a lot to accommodate a
proposed commercial use.
F. Staff Recommendation
Approval, subject to comments made.
SUBDIVISION COMMITTEE REVIEW:
Mr. Joe White was present representing this application.
The Committee discussed this issue at length with the end
result being an agreement by the applicant to provide for a
commitment to street improvements on the lot fronting
Nova Lane at such time as the building permit is
accomplished. No problems were experienced relative to the
balance of the plat.
PLANNING COMMISSION ACTION:
Mr. Larry Jacimore represented the application. There were
no objectors. A letter was submitted that committed the
applicant to provide the street improvements as was
requested by the Subdivision Committee. A motion was made
and passed for approval. The vote - 9 ayes, 0 noes and
2 absent.
