Horizontal center line curve 5 at lots 44 and 45 on Fawn Tree is to be 204.07 feet. 2. The tangent length between curves 5 and 6 on Fawn Tree to be 77.20 feet. 3. Chartwell Boulevard tangent length between curves 3 and 4 to be 24.94 feet. 4. Chartwell Boulevard tangent length between curves 1 and 2 to be 0.0 feet. May 16, 1999 SUBDIVISIONS Item No. 6 (Continued) A. PROPOSAL/REQUEST: This developer proposes the first phase, some 35 acres, of a larger land holding for single family development. The preliminary plat at issue lies immediately west of Otter Creek and across the Saline/Pulaski County line. The project is bounded on the west by the West Loop arterial and the future location of a large golf course. B. EXISTING CONDITIONS: The property within the preliminary plat is rolling terrain with some significant grade in the area of the arterial street alignment. C. ENGINEERING COMMENTS: Chartwell Boulevard geometry and right-of-way does not conform to Master Street Plan and the Engineering Staff is opposed to any geometry waivers for this roadway. This alignment is identified as the West Loop Principal Arterial on the Master Street Plan.. That name should be applied to the preliminary plat for -purposes of establishing the name for future alignment dedications. The Engineering Staff feels it is difficult to reconcile the West Loop planned alignment with the alignment that is reflected on this preliminary plat. Further, this development is landlocked as it has no public road access. Apparently 500 feet of Fawn Tree Drive within the Otter Creek development has not been final platted. That would be the principal source of access. The preliminary drainage design is incomplete. No sidewalks are indicated on streets. They are required on all. D. ISSUES/LEGAL/TECHNICAL/DESIGN: The primary legal issue attached to this plat is the access which is non-existent. This developer was directed by Planning Staff to provide evidence before the Subdivision Hearing of legal access over the Fawn Tree Street alignment in Otter Creek. Apparently, there is some legal action which will cause this roadway to be dedicated and constructed by an improvement district out of Saline County which is associated with the Chartwell development. May 16, 1989 SUBDIVISIONS Item No. 6 (Continued) The technical and design issues associated with this plat are too numerous to enumerate at this point. The primary design problem has to do with the location of a principal arterial. Its proper design and location will cause a complete redesign of this plat. E. ANALYSIS: The Planning Staff view of this proposal is that the submission is premature. The plat should be deferred for purposes of a complete redesign and new approach to the development of the properties. Additionally, the plat should be held in abeyance until evidence can be provided the Little Rock City Attorney's office that this plat has the legal right of entry over the Fawn Tree alignment. F. STAFF RECOMMENDATION: Planning Staff recommends deferral of this preliminary plat - at least sixty (60) days - in order to deal with the issues reflected above. SUBDIVISION COMMITTEE COMMENT: (May 4, 1989) The applicant, Mr. Rodney Myers, was present as was Mr. Jim Phillips of his engineering firm. Gary Greeson of the Planning Staff offered comments on the Staff recommendation indicating the reasons for the deferral request. Mr. Myers and his engineer then offered comments on the design issues outlined by the Public Works Department. Mr. Gardner of Public Works provided clarification on his comments and suggested possible modifications. A lengthy discussion then followed during which it was pointed out that a letter requesting deferral will be submitted in the following week. This deferral will be until June 27. The deferral would be for purposes of allowing the engineer, Mr. Phillips, to work with Mr. Gardner toward resolution of the street alignment. It was also pointed out that the access issue involving Fawn Tree Drive should be resolved shortly. The attorney for the improvement district indicated that the district would have a legal position relative to this right-of-way shortly, and that that would give them the basis for constructing the May 16, 1989 SUBDIVISIONS Item No. 6 (Continued)„ street and taking access. He indicated that only the price to be paid for the property would remain for litigation with the current owner. STAFF REPORT AND UPDATE: The Staff has not received information concerning resolution of the access issue through Otter Creek Subdivision, nor has the City Engineer received a design filing for the principal arterial street that is acceptable. The Staff, therefore, recommends that this item be deferred for a second cycle which would place the matter on the Commission's agenda for August 8, 1989. SUBDIVISION COMMITTEE COMMENT: (June 15, 1989) The applicant was not present nor was he represented. The Staff reported that this item should be deferred for at least one six -week review cycle in order to allow the owner to pursue the access issue and the street design. PLANNING -,COMMISSION ACTION: (June 27, 1989) The applicant was not present, nor was he represented. The Planning Staff reported to the Commission that the two principal items of concern had not been resolved. The Staff suggested that the item be continued for at least one additional six -week review cycle. The Commission discussed the matter briefly. A motion was then made to defer the item as requested by Staff. The motion passed by a vote of 9 ayes, 0 noes, 2 absent.
