NAME: I-30 Industrial Park Street
Improvements Waiver
LOCATION: Southwest Corner of West 65th &
Allied Way
APPLICANT: William A. Brandon
Brandon Van & Storage, Inc.
STAFF REPORT:
This is a request by the applicant for a waiver of street
improvements along Allied Way. It is associated with the
completion of the requirements necessary for the processing
of a final plat. Several reasons have been submitted for
the request:
(a) The work should have been done by the original
developer as specified in his agreement with the City.
(b) 65th Street is in floodplain. Proper construction
should be raised and this can't be done in a piecemeal
fashion.
(c) The bridge to the west is narrow and should be raised
and widened. When this is done, any piecemeal
construction would be wasted.
-(d) This portion of 65th is a major thoroughfare and should
be done by the City as a capital improvement project.
(e) Other developers along 65th have not been required to
make improvements.
STAFF RECOMMENDATION:
Comment is reserved until the City Engineers have had the
opportunity to research the reasoning submitted for the
request.
SUBDIVISION COMMITTEE RECOMMENDATION:
The applicant was present. The applicant was instructed to
get together with Planning and Engineering to try and work
out some options. The Committee felt that more information
was needed on the proposal, so it was derided to pass this
item to the Commission without recommendation.

PLANNING COMMISSION ACTION:
The applicant and his engineer were present. There were no
objectors. Mr. Bob Lane of the Engineering Department,
presented a report which indicated that West 65th Street has
several problems relative to the 100 Year Flood elevation
and bridge construction. These problems make one-half
street improvements impractical at this time. The
recommendation of the Engineering Department is that an
in -lieu contribution divided between the various phases of
development on Lot 1 be required. The Commission discussed
the issue and various options, with the result that the
following motion was made: "To approve the variance request
for improvements on West 65th Street at this time and
require the owner to contribute a total of $25,000 to an
in -lieu fund, the contributions to be made in two parts of
even amount when the next two building permits are issued
for this site. Further, that the initial building be tied
to a requirement to improve Allied Way to industrial street
standards. That is, one half of a 28' pavement section with
6' shoulders and properly designed open ditch section on the
west side of the street."
The vote: 9 ayes, 0 nays, 1 absent and 1 open position.
