VARIANCE REQUESTED:
1. Minimum lot width be changed from 100' to 75',
recognizing existing circumstances.
2. That a rear setback not be required on Lots 4, 5, 6, 11
and 12.
3. That the front 40' setback required on the east 30' of
Lot 12 be changed to a zero setback, until or if the
existing building is moved or torn down.
STAFF ANALYSIS
This application was submitted for review as result of
Planning Commission action on the Worthen Bank Branch/site
plan review on April 13, 1982. As a condition of approval,
the applicant was asked to submit a preliminary plat that
would incorporate the entire commercial ownership of the
lessor of the Worthen Bank site. This includes this strip
of mixed commercial uses along the north access road at
Interstate 30, approximately 1,400' east of the County Line
Road underpass. This strip was annexed in its present form,
so the plat merely serves as a means of classification or as
a means of establishing control over the land use of the
entire ownership.
The applicant has requested three waivers: (1) Minimum lot
width be changed from 100' to 75'. (2) That a rear setback
not be required on Lots 4, 5, 6, 11 and 12. (3) That the
front 40' setback required on the east 30' of Lot 12 be
changed to a zero setback, until or if the existing building
is torn down. Since the variances requested are only to
accommodate the existing uses and circumstances, staff has

no objections; however, we would like to comment that the
applicant could have a considerable savings in dollars if he
would final all of this at one time.
ENGINEERING CONSIDERATIONS:
No comments.
STAFF RECOMMENDATION:
Approval of the plat and the variances.
SUBDIVISION COMMITTEE RECOMMENDATION:
After a brief discussion, the Committee voted to recommend
the plat as filed. The vote: 4 ayes, 0 noes, 1 absent.
PLANNING COMMISSION ACTION:
A motion in agreement with the Subdivision Committee's
recommendation was made and passed by a vote of 9 ayes,
0 noes and 2 absent.
