Jay's Building Line Waiver LOCATION: #47 Scenic Boulevard DEVELOPER: Wilson Jones #47 Scenic Boulevard Little Rock, AR Phone: 375-9131 REQUEST: Elimination of the 10' platted building line and utility easement for the expansion of a single family residence. A. Site Histor None. B. Existinq Conditions This site is located in an area which is comprised of single family homes. C. Development Proposal The applicant is requesting that he be allowed to replat Lots A and B of Gates replat into one lot and to eliminate a 10' platted utility easement so that he can extend his present residence about 30' west and add a garage at the south property line, which will be connected to the residence by a covered walkway. Justification for the request is based on the "extremely precipitous" terrain on the land adjacent to Scenic Boulevard, which prevents him from building beyond the 10' building line. He has stated that the sloping terrain will cause the garage to be 20' in the air if he complied with the building line. If approval is granted, the applicant would like permission to extend the curb/gutter from the house immediately west past the residence in a manner consistent with what is existent. He also stated that the owner of the reserved portion of the Gaines replat will review the proposal and respond before August 31. The applicant does not feel that his proposal will detract from the area since all the residences on Scenic are built to the street line due to the identical terrain problem. Analysis Staff recognizes the constraints placed on developments in the area due to the terrain; therefore, staff is favorable to the request. No adverse impacts are expected. The usual final plat and amended Bill of Assurance applies. F. Staff Recommendation Approval, subject to filing a one -lot plat and Bill of Assurance. SUBDIVISION COMMITTEE REVIEW: A letter from the other property owner in the plat stating her consent was submitted. The item was passed to the Commission, subject to final plat requirements. PLANNING COMMISSION ACTION: The applicant was present. There were no objectors. A motion for approval, subject to staff's recommendation, was made and passed by a vote of: 11 ayes, 0 noes and 0 absent.
