Modification of an existing 40' building line to allow for the addition of a deck which encroaches into an area established by said area. A. EXISTING CONDITIONS This site is located in a residential area that is comprised of single. family homes. The property is bordered on the north, east and west by other single family structures, and on the south by Kings Arms Road. B. DEVELOPMENT PROPOSAL This is a proposal to construct a deck on the front entryway to the residence, that encroaches approximately 8' into an area designated as a 40' building line. C. CONFORMANCE TO ORDINANCE The request constitutes a deviation from the Ordinance in the manner stated. D. LEGAL CONSIDERATIONS Amendment of the Bill of Assurance, and submission of the final replat indicating the modified building line. E. ENGINEERING CONSIDERATIONS None. F. STAFF ANALYSIS Staff has no objections to the proposal, since the applicant has indicated that he has neighborhood support. He should submit documentation to that effect. October 12, 1982 SUBDIVISIONS Item No. 9 - Continued The survey appears to be inaccurate as to the dimension of the encroachment. This should be corrected. STAFF RECOMMENDATION: Approval, subject to comments made. SUBDIVISION COMMITTEE RECOMMENDATION: Both Dr. and Mrs. Roberson were resent in support pport of their request. A motion was made for approval, subject to: (1) Correction of the survey. (2) An amended Bill of Assurance. (3) Submission of a one -lot final replat reflecting the approved modification. The motion passed by a vote of 5 ayes, 0 noes, 0 absent. PLANNING COMMISSION ACTION: The applicants were present. There were no objectors. Dr. Roberson indicated that he had completed the process of amending the Bill of Assurance. A motion for approval, subject to the submission of a one -lot final plat, was made and passed by a vote of 7 ayes, 0 noes and 4 absent.
