HomeMy WebLinkAboutS-0357-D ApplicationAMENDMENT TO BILL OF ASSURANCE TO INDEPENDENCE SQUARE SUBDIVISION KNOW ALL MEN BY THESE PRESENTS: WHEREAS, the undersigned are the owners of Lots 1, 2 and 3 of Independence Square, an addition to the City of Little Rock, Pulaski County, Arkansas; WHEREAS, a Bill of Assurance to Independence Square Subdivision ("Original Bill of Assurance") which contains restrictions and covenants on the use and enjoyment of the lots therein, was filed of record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas on July 8, 1987 as Instrument No. 87-43826; WHEREAS, to facilitate the development and construction of improvements on Lot 3, a portion of Lot 1 was subdivided and conveyed by Independence Square I Partnership, the owner of Lot 1, to Three Independence Square Partnership, the owner of Lot 3; WHEREAS, to evidence the reconfiguation of Lots 1 and 3, the owners of Lots 1, 2 and 3 have caused Independence Square Subdivision to be resurveyed by Pat McGetrick, registered land surveyor and a registered professional engineer with McGetrick Engineering; Inc., and a reolat thereof made which is identified by the title "Lots 1R., 2R & 3R Being a Replat of Lots 1, 2 & 3 Independence Sub`•€, Little Rock, Arkansas" bearing the date March , 1995 and have. caused the same to be filed with the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas in Plat Book at Page ("Replat"); WHEREAS, the purpose of this Amendment to Bill of Assurance to Independence Square Subdivision is to amend the definition of the "Parking Area" of the Subdivision as set forth in the Original Bill of Assurance and to address the right of ingress and egress on Lots 1R, 2R and 3R. NOW, THEREFORE, the owners of Lots 1R, 2R and 3R, for and in consideration of the benefits to accrue to them, which benefits they acknowledge to be of value, hereby amend the Original Bill of Assurance as follows: 1. The ,term "Parking Area" contained in paragraph 1 of the Original Bill of Assurance shall be amended to include without limitation all areas within the subdivision marked and designated as such on the Replat. 2. All current and future easements on Lots 1, 2 and 3 of the subdivision shall continue to be governed by the restrictions and covenants contained in the Original Bill of Assurance including, but not limited to, paragraphs 2.1 and 2.2 thereof as amended herein. 3. All other terms of the Original Bill of Assurance not modified or amended herein shall continue in full force and effect and shall govern the subdivision as replatted.
