A. PROPOSAL/REQUEST:
This applicant proposes a transfer of title of a small
parcel of land from the Hinkson Road property to the
tract fronting upon Geyer Springs Road. The Geyer
Springs property is occupied by the Western Sizzlin
Steak House. That owner proposes to utilize the small
parcel to be acquired as additional building floor
space. The developer has requested that the southern
lot fronting on Hinkson Road not be required to install
street improvements along the Hinkson alignment.
B. EXISTING CONDITIONS:
The properties involved are generally flat grade with
the northernmost lot occupied by a steak house and the
southernmost lot occupied by church building. The
properties to the north and west are almost completely
owned for a block or more by the Cloverdale Assembly of
God Church. The transfer of title would involve a
small portion of their total ownership.
C. ENGINEERING COMMENTS:
None.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
The Planning Staff has determined from a review of the
zoning map that part, if not all, of the land area to
be transferred is currently classified as an office
district. The purchaser will be required to either
rezone the property to the appropriate commercial
district, or obtain a variance from the Board of
Adjustment for its use as off-street parking.
E. ANALYSIS:
The Staff review of this proposal does not reveal a
problem of public concern. The only issue to be
resolved being that of the zoning classification on the
property and the future use of the land. The waiver of
street improvements on West 83rd Street we would defer
to the Public Works Department for further review and
comment at the Subdivision Meeting.

F. STAFF RECOMMENDATION:
Staff recommends approval of the requested replat anc
suggests that unless a significant hardship can be
shown relative to the street improvement requirement,
that they be installed per ordinance.
SUBDIVISION COMMITTEE COMMENT: (May 4, 1989)
The application was represented by Mr. Lowe and a
representative of the church. Mr. Lowe indicated that the
purpose of this replat was to accomplish a transfer of title
from the church to the Western Sizzlin Steak House, the
purpose of which would be some future expansion of the rear
element of their building, possibly the kitchen and work
area. Mr. Lowe further commented on the Staff's
recommendation. He indicated that the church would like to
defer the improvements on Hinkson Road at this time inasmuch
as they propose no construction on their properties
remaining. At this time there is a small residential
structure used in conjunction with the church. He indicated
that the owner would be willing to dedicate the right-of-way
needed for Hinkson Road as identified by the Public Works
Department.
A brief discussion of the proposal followed during which Mr.
Lowe, City Staff, and the Committee determined that the
Commission could possibly hear a request for deferral of the
street improvements on Hinkson until some future time when a
specific building permit is proposed, or a replatting of the
property occurs.
There being no further issues, this item was forwarded to
the full Commission.
PLANNING COMMISSION ACTION: (May 16, 1989)
The applicant- was present. There were no objectors present.
A motion was made to approve the application as filed. The
motion passed by a vote of 9 ayes, 0 noes, 2 absent.
