City Manager May 16, 1989 City Hall Little Rock, Arkansas 72201 Dear Mr. Nickerson: SUBJECT: FOXBORO PRELIMINARY PLAT LOTS 16, 17, 18, & 19 The Planning Commission at its public hearing approved the subject preliminary plat by consent agenda. The preliminary plat included two waver requests requiring Board of Directors action in accordance with recent Subdivision Ordinance changes. The two waver requests are: 1) A pipe stem lot (i.e. Lot 19); 2) A 75' radius to the Foxcroft Road centerline in lieu of a 150' radius. Pipe stem lots were allowed by right prior to the recent Subdivision Ordinance change. The 75' radius is allowed for a minor residential street. However, a residential street requires a 150, radius. The criteria for a minor residential street according to the ordinance are no longer than 750' and will not service more than 35 lots. This street will be longer than 750 but will not service more than 24 or 26 residential lots at most. In my opinion the level of service is determined by traffic demand (i.e. number of lots serviced) rather than length. Because the level of service is for a minor residential street I feel the 75' radius is appropriate. For these reasons I am requesting the variance. The design change represents a superior design. It eliminates an unneeded stub street and puts to rest the concern of the local residents of an extension of Foxcroft Road to the proposed Riverfront Drive. I am additionally requesting that the Board of Directors review this matter at the June 6, 1989 meeting. My construction schedule is such that a timely decision on this matter' is paramount. Should there be any protracted delays then I will simply drop the matter and pursue the previously approved preliminary plats. Richardson PE, RLS ORDINANCE 15,695 AN ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS PROVIDING FOR A WAIVER AND A VARIANCE TO ALLOW A PIPE -STEM LOT AND A SEVENTY-FIVE FOOT HORIZONTAL CENTER LINE RADIUS ON FOXCROFT ROAD. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 31 of the Code of Ordinances be amended to provide for: (a) a waiver allowing a pipe - stem lot (Lot 19); and (b) a variance allowing a seventy- five (75) foot horizontal center -line radius on Foxcroft Road. Said lot and street are in the subdivision entitled Foxboro Preliminary Plat Revised, Lots 16 through 19. SECTION 2. This Ordinance shall take effect thirty (30) days from and after its passage. RICHARDSON President 5-33-7,C, April 7, 1989 Richard Wood Comprehensive Planning 723 West Markham Little Rock, Arkansas 72201 Dear Mr. Wood: SUBJECT: FOXBORO LOTS 16-18 PRELIMINARY PLAT Enclosed herewith are five (5) copies of a revised layout plan for the subject preliminary plat for consideration at the May 16, 1989 Planning Commission meeting. The enclosed design is a result of my meeting with Jerry Gardner and Carroll Ball of Public Works. We discussed several alternative designs to clear up the interface of originally proposed lot 19 with the present planned terminus of Foxcroft Road. The enclosed plan represents what we collectively felt, and I understand that you felt the same after discussing the matter subsequently with Mr. Gardner, was the best alternative to the present design. This plan does several things both for me and the City of Little Rock. This plan reduces the amount of public street required for maintenance, improves the flow of traffic, has a minimal effect to work already accomplished in the field, improves the layout of the lots immediately adjacent, and hopefully puts to rest the controversy over the extension of Foxcroft Road either into Robinwood or to Riverfront Drive. The plan includes a waver request for a pipestem lot and a 75' radius curve. The Subdivision Ordinance currently defines a minor residential street as to length and number of lots served. In my opinion this represents a misapropriation of sound design principles. The type of street (i.e. collector, residential, etc.) is more appropriately determined by the level of traffic generatecj, that principally the length. If a single word in the Subdivision Ordinance were change from "and" to "or" this would be accomplished. My plan calls for Foxcroft Road to serve 18 possible lots in my development and a possible 6 to 8 additional lots in the parcel to which the street is stubbed. This means a total possible of 24 residential lots well below the maximum of 35 for a minor residential street. If level of service is the overriding consideration then the street would qualify as a minor residential street thereby allowing the design criteria for a minor residential street to be applied which allows the 75' radius curve. In my opinion, this is the more rational design criteria than length of street. For these reasons I am requesting that the waver of the 75' radius be allowed.
