A. History of the Site:
During previous zoning cases, it has been established
that the floodway is located on the southwestern
portion of the property.
B. Project Characteristics:
1. The construction of four buildings on 4.28 acres
to be used for office/warehouse.

(c) Detailed landscaping will be provided at the
time of each request for building permits.
Special Requirements:

1. Front yard setback of 50 feet. The plan does not
comply.
2. Rear yard depth of 25 feet. This plan complies.
3. Lot areas not less than 14,000 square feet. This
plan complies.
4. Submission of three approved copies before
building permit is received for Buildings B, C and
D.
Engineering Comments:
1. Extend sidewalk full length of property; construct
handicap ramps at driveways.

2. Floodway items have previously been reviewed by
the City Engineer's Office.
E. Staff Analysis:
As presented, the site plan does not conform with the
front yard setback requirement of 50 feet in "I-2"
areas. The applicant should submit a revised plan
reflecting the appropriate building line. Staff would
like to caution the applicant that this recommendation
does not include endorsement of the area indicated for
future parking. A specific plan should be submitted to
The Engineering Department -for this area. Since the
northern boundary of the site consists of a common
private access with the abutting office development,
staff feels that the usual requirements of perimeter
landscaping and screening should be waived. Even
though some indication of landscaping has been
submitted, the applicant is still required to submit a
landscape plan. The presence of the floodway does not
present a problem since the finished floors will be set
2.8 to 5.8 feet above the 100-Year Flood.
F. Staff Recommendation:
Approval, subject to comments made.
SUBDIVISION COMMITTEE REVIEW:
Additional Information -
(a) Article V, Section 37.20-D of the Subdivision Ordinance
refers to "the Reservation of Public Facilities - where
proposed community or public facilities of the
Municipal Plan are located in whole or in part in a
proposed subdivision, the Planning Commission, Board or
public body shall require that land for those public
facilities be reserved as a condition of preliminary
plat approval for a period of four months following the
date of notification of the developer's intent to
develop as evidenced by submission of the preliminary
plat. The public, Board, Commission or body having
jurisdiction or financial responsibility for the
acquisition of said reserved facility shall be given an
opportunity to execute a written contract to acquire by
purchase or file suit for condemnation of said area
reserved for such facility. Provided further, said
contract to acquire must be closed within 12 months
following the date of the approval of said preliminary
plat.

(b) A resolution was passed by the Board on April 5, 1983,
which authorized the City Attorney to file the
necessary condemnation suits for acquisition of lands
on the east bank of Rock Creek between Boyle and Kanis
Parks.
The -Committee decided to pass this item to the Commission
subject to the resolution of the condemnation issue. The
applicant was given an option of removing the drive within
the floodway or phasing the project to include that area not
affected by the resolution.
PLANNING COMMISSION ACTION:
Mr. Bob Richardson of Richardson Engineers represented the
Developer. He submitted a revised plan which eliminated the
drive within the floodway. A motion was made for approval
of the revised plan. It passed by a vote of 10 ayes, 0 noes
and 1 absent.
