REQUEST:
To reclassify an area zoned "R-2" to "PCD."
I. EXISTING CONDITIONS
This site is bordered on the south and west by
undevelopable tracts consisting of creeks and woods, on
the east by a church, and on the north by the end of
West 5th Street. The eastern half of the property
consists of a single family, frame residence. The
western half, which is vacant, has recently been
cleared of underbrush. A permanent natural feature is
a £loodway (40' x 140' from the property line) which
diagonally cuts through the property and extends
halfway into the eastern lot. The remainder is
composed entirely of the floodplain.
II. DEVELOPMENT OBJECTIVES AND PHILOSOPHY
(1) The wouldsnotfbeand in the prractical foromostlotherawhich
uses, as a
horticultural storage site.
(2) To retain all trees and natural undergrowth not in
the way of the building site.

VI. STAFF RECOMMENDATION
Approval, subject to comments made.
VII. SUBDIVISION COMMITTEE RECOMMENDATION:
The applicant was informed that most of this property
lay in an area that is included in a new parks plan.
As a part of the proposal to improve Rock Creek (for
flood control), the City has an interest in this
property because of a desire to have control of the
floodplain. The applicant was instructed that there
were options to be considered. He could plat to the
boundary of the floodway, or if the City wanted to buy
the entire property, arrangements may be possible for
leasing. He was also instructed that he could be
exempted from paving the parking lot and making
improvements on West Fifth Street. A motion was made
for approval, subject to the submission of a plat
showing an easement over the floodway and noting that
no construction would take place in the floodway and
resolution of the floodway problem. The motion passed
by a vote of: 2 ayes, 0 noes, 3 absent.
PLANNING COMMISSION ACTION:
The applicant, Mr. Stan McDaniel, and owner of the property,
Mrs. Lowie, were both present. Three persons were present
from the Sunnymeade neighborhood. They requested that the
item be deferred since they had not received what they
considered proper notice due to a wrong address. The City
Attorney responded to this request by determining that
proper notice had been given.
A discussion was held during which it was reported that the
City had an interest in acquiring this property as a part of
a proposed Parks plan and as a protective measure against
floodplain development. The Commission expressed concern
that approval of.this type use in the area was an
inappropriate use of the PUD concept and constituted spot
zoning. A motion for denial was made and passed by a vote
of 8 ayes, 0 noes, 2 absent and 1 abstention.

III. ENGINEERING CONSIDERATIONS
None at this time.
IV. STAFF ANALYSIS
This site is located in a multifamily area that
consists mainly of older housing stock that has been
converted to duplexes, though the property is bordered
on the north by a single family residence. The only
existing structure is a very recently constructed
duplex on the west, which the existing zoning allows.
The applicant is proposing to replat the lot and build
a similar unit on the vacant portion to the east.
Staff is concerned with the possibility that one of the
resulting lots may be sold. That is not advisable
since this would then create lots smaller than usual
for this land use. Also, the plan should be revised
to accommodate the six parking spaces required as
designed, it is doubtful that adequate space exists.
STAFF RECOMMENDATION:
Approval, subject to comments made.
SUBDIVISION COMMITTEE RECOMMENDATION:
Since the applicant was not present, the Committee decided
to pass this to the Commission without recommendation.
PLANNING COMMISSION ACTION:
The applicant was not present. There were no objectors.
The motion was made and passed to defer the item for one
month in order for it to be returned to the Subdivision
Committee and the applicant contacted. The motion passed by
a vote of 9 ayes, 0 noes and 2 absent.
