OF LOTS: 1 FT. OF NEW ST: 0' ZONING: °R-2" PROPOSED USES: VARIANCE REQUESTED: 1. Modification of building line on Duncan Street side to permit 10' more or less intrusion of a carport. A. EXISTING CONDITIONS This site involves a residential structure on a corner lot, located in what can be characterized as a very well -kept neighborhood of single family homes. It is bordered on the south and west by Duncan and Yorkton Drives respectively. Bordering on the north and east are other single family uses. B. DEVELOPMENT PROPOSAL This is a proposal, submitted by the applicant, for permission to construct a carport (12' long and 24' wide) to the southern end of the house. Plans include enclosing the existing carport so that the living room may be enlarged. The design of the driving entrance and brick color on the enclosed portion will remain similar to what now exists. C. CONFORMANCE TO ORDINANCE The plan is not in accordance with what is mandated by the Subdivision Ordinance since it requires modification of a 25' building line on the Duncan drive side to permit a 10' intrusion, which will be created by the construction of the carport addition. August 10, 1982 SUBDIVISIONS Item No. 6 - File No. 262 - Continued D. LEGAL CONSIDERATIONS The Bill of Assurance must be amended and property -owners in area notified. If approved, a final plat indicating the modified building line is required. E. ENGINEERING CONSIDERATIONS None. F. ANALYSIS The applicant should indicate whether or not the addition will have a flat canopy or gable type roof extension. Regardless, staff is still reluctant to endorse this request. We have not been convinced that adequate justification has been submitted for the modification of a building line; and as always, the staff is skeptical of setting a precedent in an area where the structures are generally in conformance. G. STAFF RECOMMENDATION Denial as filed. H. SUBDIVISION COMMITTEE ACTION Mrs. Stafford was present. She reported that the carport would resemble an extension of the house and would have a gable -type roof.. Due to the fact that the applicant's Bill of Assurance requires 80 percent of property -owners in the Subdivision to sign before it is amended, the Committee decided to pass the item to the full Commission without a recommendation. I. PLANNING COMMISSION ACTION Since the applicant was not present, a motion for a 30-day deferral was made and passed by a vote of 9 ayes, 0 noes and 2 absent.
