RE: ST. JOHNS PLACE APPROVAL OF CONSTRUCTION
This office has inspected and approved the construction of
street and drainage facilities in St. Johns Place. There is
an immediate need however, to replace a storm drain inlet
top on the catch basin located on the south end of Taylor
Street.
We have received from Robinette Keyes Construction Co. a
maintenance bond in the amount of $26,295.00 dated June 12,
1989, to run for one year. On or about June 12, 1990, the
project will be inspected for release of the maintenance
bond.

BILL OF ASSURANCE
St. John's Place, hereinafter called Grantor, hereby makes
this Bill of Assurance as follows:
1. Grantor owns lands in Pulaski County, Arkansas,
described as:
Part of the NE-1/4, SW-1/4, Section 30, T-2-N, R-12-W,
Pulaski County, Arkansas, more particularly described
as: Beginning at a point on the south line of said
NE-1/4, SW-1/4, 25 ft. S 88 deg. 21 min. 00 sec. E of the
Southwest corner thereof; thence North along a line,
25 ft. East of and parallel with the west line of said
NE-1/4, SW-1/4, 932.72 ft. to the Southwest corner of Lot
8, St. John's Wood Subdivision, Little Rock, Arkansas;
thence S 81 deg. 39 min. E along the south line of
said Lot 8, 162.98 ft. to the Southeast corner
thereof, said corner also being the Southwest corner
of Lot 9, said St. John's Wood Subdivision; thence N

ft. by 10 ft. wide strip of land located in said NE
1/4, SW 1/4, lying North of and adjacent to Lot 8, Block
7, Newton Addition, to the City of Little Rock,
Arkansas containing 8.5368 acres more or less.
2. Grantor desires to subdivide the land into lots and
streets and has caused same to be surveyed by White-Daters &
Associates, Inc., registered professional engineers and land
surveyors, who have made a plat thereof, identified as St.
John's Place, Pulaski County, Arkansas, hereinafter called the
Addition. The said plat is dated Oelle& �?/ , 1988,
bears the Certificate of Approval of the Little Rock Planning
Commission, and is recorded in the office of the Recorder,
Pulaski County, Arkansas, in Plat Book at Page
3. Grantor has laid off, platted and subdivided the land
in accordance with the plat, and the land therein embraced
shall be forever known as designated thereon. Any conveyance
of any lot in the Addition describing same by the number shown
on the plat shall always be a sufficient description thereof.
4. Grantor has donated and dedicated to the public no
easement for streets, but has separately provided for two types
of private drive easements to be used for ingress and egress
only by the owners of the lots, their agents, licensees,
family, guests and invitees. The drive to be known as St.
John's Place and so designated on the plat shall be subject to
common use by all of the above categories of users. Easements
to the rear drives and garages are designated on the plat as
"private access drives," and use shall be limited to those lot
owners and guests who reasonably require the use of such ease-
ments for access to a specific lot. Public vehicles shall have
the use of all private drive easements for the purpose of law
enforcement or public service. Vehicular use of all private
drive easements is restricted to the paved sections.
5. A property owners association (the "Association") will
be created, and all lots will be subject to the assessments
that may from time to time be imposed upon property owners and
the Association. The area designated on the plat as "common
property" shall remain open, and all private drive easements and
common area shall be maintained by the Association.

6. An easement is hereby retained in favor of the
Association over the lots and the common areas for the
construction of a common cable television system, a common
sprinkler, landscaping or any other item for the common benefit
of the owners. An easement is further granted for the purpose
of the repair and maintenance of any item so constructed. An
entry upon any lot to effectuate the foregoing purposes shall
not be deemed trespass. Each owner covenants not to damage or
destroy any portion of an item so constructed and shall hold
the Association harmless for the cost of repairing or replacing
any portion damaged or destroyed by such owner, his family, his
guests and invitees.
7. The filing of this Bill of Assurance and the plat for
record in the Office of the Recorder, Pulaski County, Arkansas,
constitutes a valid and complete delivery and dedication of the
street and all easements shown on the plat.
8. The St. John's Place main drive and private access
drives, as well as any other easements so designated on the
plat, shall be for use by utilities.
9. All buildings constructed on lots in the Addition
shall be constructed no nearer to the street than the building
lines shown on the plat, and all buildings shall be constructed
in conformance with the Building Code and Zoning Ordinance of
the City of Little Rock, Arkansas.
10. No lot shall be further subdivided and no portion less
than all of any such lot nor any easement or other interest

therein, shall be conveyed by any owner, except, however, that
easements may be granted to any governmental or quasi -
governmental agency or a public utility.
11. Invalidation of any one of the covenants or restric-
tions by judgment or court order shall in no way affect any
other provisions which shall remain in full force and effect.
12. This Bill of Assurance may be amended, cancelled or
supplemented by a written instrument signed by at least 67% of
the owners of lots (one vote per lot) in the Addition and
mortgage holders representing at least 51% of the lots subject
to mortgages in the Addition, as recorded in the Office of the
Recorder, Pulaski County, Arkansas, subject to approval by the
Little Rock Planning Commisison.

UNIT DEVELOPILiENT AND ESTABLISHING
A PRD DISTRICT TITLED ST. JOHN'S
PLACE (Z-4852) IN THE CITY OF
LITTLE ROCK, ARKANSAS, AMENDING
CHAPTER 43 OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the
following described property be changed from "R-2" Single
Family District to PRD Planned Residential District:
A tract of land described as part of the NE 1/4, SW
1/4, Section 30, T-2-N, R-12-W, Pulaski County,
Arkansas, more particularly described as: Beginning at
a point on the south line of said NE 1/4, SW 1/4, 25
feet S 880 21' 00" E of the SW corner thereof; thence
North along a line 25 feet East of and parallel with
the West line of said NE 1/4, SW 1/4, 932.72 feet to
the SW corner of Lot 8, St. John's Wood Subdivsion,
Little Rock, Arkansas; thence S 810 39' E along the
South line of said Lot 8, 162.98 feet to the SE corner
thereof, said corner also being the SW corner of Lot 9,
said St. John's Wood Subdivision; thence N 74° 14' 40"

SECTION 2. That the preliminary site development
plan/plat be approved as recommended by the Little Rock
Planning Commission.
SECTION 3. That the change in zoning classification
contemplated for St. John's Place PRD is conditioned upon
obtaining a final plan approval from the Planning Commission
within the time specified by Article 9, Section 9.101 of the
Code of Ordinances.
SECTION 4. That the map referred to in Chapter 43-1 of
the Code of Ordinances of the City of Little Rock and
designated district map be and it is hereby amended to the
extent and in the respects necessary to effect and designate
the change provided for in Section 1 hereof.
SECTION 5. That this ordinance shall take effect and
be in full force upon final approval of the plan/plat by the
Planning Commission.

A RESOLUTION OF -THE LITTLE ROCK PLANNING
COMMISSION RESTATING ITS SUPPORT FOR A
NEIGHBORHOOD PARK ON THE ST. JOHN'S SEMINARY
SITE, CONDITIONED UPON THE CITY'S FINANCIAL
ABILITY TO ACQUIRE THE SITE.
WHEREAS, the Planning Commission of the City of Little
Rock recommended the adoption of the Master Parks Plan of
1963 which included the area of the St. John's Seminary as a
general park site and,
WHEREAS, the Commission recommended the readoption of
the Master Parks Plan in 1971 and 1983 which then included
as a fixed park site #10-NF, an area of 10 acres and which
is part of the St. John's Seminary and,
WHEREAS, in late 1986, the owner of site 410-NF wished
to pursue plans to develop this property and did not want to
spend considerable sums of money on a development plan if
the City intended to purchase the site for a park and,
WHEREAS, the owner therefore requested its removal from
the Master Parks Plan and,
WHEREAS, the staff of the Office of Comprehensive
Planning of the City of Little Rock recommended the site's
removal from the Plan "due to current financial limitations"
and,
WHEREAS, the Planning Commission of the City of Little
Rock thereupon recommended its removal and,
WHEREAS, the Board of Directors of the City of Little
Rock deferred final action on its removal until it had
received the Commission's recommendation on the owner's
proposed development of the site and,
WHEREAS, there has arisen considerable neighborhood
opposition to the removal of the site from the Master Parks
Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The Planning Commission restates its
support for a neighborhood park at site #10-NF.
SECTION 2. The Commission's support is conditioned
upon the financial ability of the City of Little Rock to
acquire the site within the time frame set forth in the
Master Park Plan ordinance.

MASTER PLAN ORDINANCE NO. 14,517 FOR
THE EXCLUSION OF NEIGHBORHOOD PARK
7A - ST. JOHN SEMINARY.
WHEREAS, the Department of Parks and Recreation of the
City of Little Rock in conjunction with the Office of
Comprehensive Planning has recommended that the Master Parks
Plan be amended to delete Neighborhood Park 7A; and
WHEREAS, the park system will continue to provide a
comprehensive plan of parks; and
WHEREAS, the Planning Commission endorses and
recommends adoption of an amendment deleting Neighborhood
Park 7A from the Master Parks Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.
Section 1. Ordinance No. 14,517, the Park System
Master Plan is hereby amended to exclude Neighborhood Park
7A - St. John Seminary.

Section 2. This Ordinance shall be in full force and
affect from and after its passage.
