Side slope distance from pavement A. EXISTING CONDITIONS This parcel is located in a rural -like area, immediately west of Interstate 440. The other boundaries include Fourche Dam Pike, a collector street on the west and Hermitage Home Site Addition, a residential subdivision on the north. The current status of the property is without structure, but scattered with a minimum amount of brush and undergrowth. The present zoning is "C-3"/"I-2." B. DEVELOPMENT PROPOSAL The applicant is proposing to develop this tract of 37.5 acres into three lots. Land use for Lots 1 and 2 will be commercial, while the larger, Lot 3 will be used for industrial purposes. Internal access will be provided by a cul-de-sac of 1,3501, (601/361) which extends from Fourche Dam Pike through the site to within 500' of the eastern boundary. Both streets will be constructed with 28' pavement and 6' paved shoulders. Several variances and their justification July 13, 1982 SUBDIVISIONS Item No. 9 - Continued have been submitted: (1) Right-of-way width on East Port Drive - instead 20' wide drainage easement would be provided adjacent to the right-of-way to accommodate open drainage facilities. (2) Length of cul-de-sac - since the adjacent development and physical configuration of the property dictate the cul-de-sac configuration. (3) Side slope distance from pavement - since four additional feet of soil shoulder would inhibit natural drainage which is critical for pavement stability. C. CONFORMANCE TO ORDINANCE (1) Variances: The plan varies from Ordinance requirements in the manner stated above with the exception of the cul-de-sac waiver, the other two variances involve the provisions for improvements related to open drainage, at street right-of-way easements found in Section 37.30 - (E) which states that (2a) side slopes should begin a minimum of 4' from the edge of the paved shoulders and (2d), street shoulder, right-of-way width shall extend 10' beyond the back slope. Ordinance requirements for cul-de-sacs are a minimum of 750' in length. (2) Technical Requirements: The plat has a few minor deviations from proper form. D. LEGAL CONSIDERATIONS Where open drainage is concerned, the Ordinance mandates that Bills of Assurance should require the adjoining property owners to mow and maintain the right-of-way and/or drainage easements adjacent to his property upon proper notice. If the property owner doesn't comply, the area may be mowed by the City, and the property owned billed per the procedure on vacant lots within the City. E. ENGINEERING CONSIDERATIONS 1. Engineering agrees with 20' drainage easements adjacent to East Port Drive. 2. Engineering has no objections to length of cul-de-sac. July 13, 1982 SUBDIVISIONS Item No. 9 - Continued 3. 28' pavement width is approved. 4. Engineering objects to omitting 4' earth shoulders outside paved shoulders. 5. Request nature of islands on East Port Drive. E. ANALYSIS Staff has no major objections to this proposal; however, the applicant should indicate plans for phasing and structural development. Engineering has indicated approval of all of the variances except one involving side slope distance from the pavement. A sewer extension will be required to serve this plat and the cost could be,, -at $100, 000. F. STAFF RECOMMENDATION Approval, subject to comments made. G. SUBDIVISION COMMITTEE RECOMMENDATION: After a brief discussion, the Committee voted to recommend the plat as filed, with the addition of a phase plan, which will allow one lot finals with all ordinance minimums to apply. The vote: 4 ayes, 0 noes, 1 absent. H. PLANNING COMMISSION ACTION The applicant's engineer, Mr. Joe White, spoke in favor of this application. No one objected. Mr. White requested staff be given the authority to approve the subdivision of the property as it occurs, so as to prevent the applicant from coming back before the Commission every time a lot is sold. This is to be done in accordance with the minimum standards set forth by the Ordinance. A motion for approval was made and passed by a vote of 7 ayes, 0 noes and 4 absent. OF NEW ST: 1,350' ZONING: "C-311/1'I-2" ' PROPOSED USES: Industrial/commercial STAFF ANALYSIS: This item is submitted as part of the review of Item No. 9, East Port Addition and as required by State statute. The staff is in receipt of supporting documentation from the City Engineer and Wastewater Utility. All review indictates that this district is proper. We endorse the formation of the district. SUBDIVISION COMMITTEE RECOMMENDATION: Approval as requested. The vote: 4 ayes, 0 noes, 1 absent. PLANNING COMMISSION ACTION: (7-13-82) The applicant was present. There were no objectors present. After some discussion, the Planning Commission made a motion to approve this request as was recommended by the Subdivision Committee. The motion passed by a vote of 9 ayes, 0 noes and 2 absent.
