REQUEST:
For preliminary review of
a planned mobile home
community.
STAFF ANALYSIS:
This item is before the Commission for pre -preliminary
review, meaning that the owner is simply presenting his
developmental concept to the Commission for their feedback,
before the submission of a formal application.
This applicant would like to develop a 117-lot mobile home
subdivision on 40 acres of land, most of which lies outside
of the City's boundaries; but in the Planning
a ninhe siboundaries.
Due to an extensive flooding problem
te, the
applicant is only proposing to utilize 17 of the 40 acres
for approximately 100 mobile homes. The remaining, which is
in the floodplain, would be used as a park and/or recreation
area for the occupants.
Until recently, there was no legal access to the site. In
early June the Supreme Court identified and awarded the
applicant with a 30' easement for entry after a 4-year
fight. Currently, negotiations are underway to acquire the
additional 20' to make the 50' required by Ordinance, but it
does not seem likely. If this can't be purchased, the
applicant will request a waiver of the 50'.
There is also a problem with the parcel being outside the
City's annexation boundaries and established sewer and water
districts service. The applicant is willing to lay

1/4 mile water and sewer. However, this may not be
necessary, because Wastewater's comments indicate that
because the site lies outside its service area, it cannot be
served. These annexation/utility problems conflict with the
policy established by the Board of Directors which has
determined how we define "urban land." This site does not
fit into that definition.
Staff feels that the access to the site must be 50' for a
public dedication and that physical improvements of the road
must, at a minimum, meet standards of a 27' residential
street with curb/gutter, measured back to back of curb. The
interior street system should be private with standards set
by mobile home subdivision Ordinance. The applicant should
furnish us with a copy of the court order.
ENGINEERING CONSIDERATIONS:
Floodplain/floodway not shown. Map shows floodway away from
area to be developed. Floodway appears to encroach on rears
of Lots 1-27 and covers Lots 34-50. Plat should be
carefully to determine if this part of the propose site is
usable.
SUBDIVISION COMMITTEE -RECOMMENDATION:
The Committee determined that there were too many unanswered
questions concerning this proposal to warrant further
consideration.
The Staff was directed to remove the matter as a public
hearing item and advised the owner to pursue solutions to
the several severe problems existant. The motion passed by
a vote of 4 ayes, 0 noes, 1 absent.
PLANNING _COMMISSION ACTION:
The Commission voted unanimously in favor of the Subdivision
Committee's recommendation of withdrawal from the agenda,
until the issues are solved. A motion to this effect was
made and passed by a vote of 9 ayes, 0 noes and 2 absent.
