A. EXISTING CONDITIONS This site is located in a single family, residential area that has just recently been annexed into the City. The existing structure of green brick is unique in that it is the only obvious home in the immediate vicinity that encroaches into the 25' setback area. The property is surrounded by a chain link fence on the sides; and is bounded on the north, south and east by single family homes. The home on the north faces Gum Springs Road, not Lancaster. B. DEVELOPMENT -PROPOSAL The applicant is proposing to make an addition to the existing house, which will encroach approximately 13.7 feet into an area established by a 25' building line. The specific plans include the use of an existing 4' x 4' porch (indicated on the sketch) as an entryway to the new addition. In a letter to the. Commission, Mr. McMooran states that "if" he is "forced to set back 251, the traffic flow into the new addition will be awkward," and "the front of the existing house will not fit naturally with the proposed addition." He is requesting that the Commission allow him to continue with his long awaited plans to improve his property and the neighborhood. C. LEGAL CONSIDERATIONS None, except the usual requirement for an amendment to the BOA. March 9, 1982 SUBDIVISIONS Item No. 6 - Continued D. ENGINEERING CONSIDERATIONS None. E. ANALYSIS Upon site investigation, it was noticed that this home seems to be the only encroaching structure in the immediate area. Although staff recognizes the applicant's position, we do not wish to compound the problem by endorsing what is already an illegal situation. F. STAFF RECOMMENDATION Denial, as filed. SUBDIVISION COMMITTEE ACTION: The applicant was present. The Committee voted to approve the application subject to a notarized petition, indicating that the neighbors had been notified. The vote - 4 ayes, 0 noes and 1 absent. PLANNING COMMISSION ACTION: The applicant submitted the petition requested by the Committee. There were no objectors. A motion for approval was made and passed by a unanimous vote - 9 ayes, 0 noes, 2 absent.
