THIS FIRST AMENDMENT TO DECLARATION OF RESTRICTIVE
COVENANTS AND BILL OF ASSURANCE OF CYPRESS POINT is made this,L�ay of
June, 2020, by Pinnacle Ridge Development Company, an Arkansas corporation ("Allottor").
WITNESSETH:
WHEREAS, a Declaration of Restrictive Covenants and Bill of Assurance of Cypress
Point subdivision was filed of record by Allottor in the Office of the Circuit Clerk and Ex-Officio
Recorder of Pulaski County, Arkansas on July 5, 2017, as Instrument No. 2017042470 ("Bill of
Assurance"); and
WHEREAS, the Plat of Cypress Point ("Plat") was filed of record in the Office of the
Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas on July 5, 2017, as
Instrument No. 2017042471, said Plat depicting all lands to be governed by the Bill of
Assurance;
WHEREAS, under the terms of the Bill of Assurance and pursuant to the authority
granted therein, Allottor has the authority to amend and modify the terms and provisions set forth
in the Bill of Assurance; and
WHEREAS, Allottor has filed a replat of Lot 189 and Lot 190 ("Replat") of record in
the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas on June'
2020 as Instrument No. 2020cL>tL �3 ; and
WHEREAS, it is desirable to amend and modify the Bill of Assurance to identify the lots
governed thereby.
NOW, THEREFORE, Allottor, by and through its authorized officer, does hereby
amend and modify the Bill of Assurance as follows:

1. Lot 189 and Lot 190 have been replatted into a single lot as shown and identified
on the Replat as Lot 189R.
2. The lands embraced in the Replat and governed by the Bill of Assurance shall
hereafter be identified as Lots 187R and 189R.
All capitalized terms not defined herein shall have the meanings ascribed to them in the
Bill of Assurance. All other terms, covenants and restrictions of the Bill of Assurance not
amended hereby shall remain in full force and effect.
IN WITNESS WHEREOF, Allottor has executed this First Amendment to Declaration
of Restrictive Covenants and Bill of Assurance of Cypress Point on the date and year first above
