HomeMy WebLinkAbout16313 RESOLUTION NO. 16,313 2 3 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO 4 EXECUTE ANY DOCUMENTS NECESSARY FOR THE SALE OF LAND 5 TO THE ARKANSAS STATE HIGHWAY COMMISSION, IN THE 6 AMOUNT OF THIRTY-SIX THOUSAND, TWO HUNDRED THIRTY-SIX 7 DOLLARS ($36,236.00), AS PART OF THE CANTRELL ROAD 8 IMPROVEMENT PROJECT, FROM TAYLOR LOOP ROAD TO 9 PLEASANT RIDGE DRIVE; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City of Little Rock, Arkansas, is the owner of certain property described as Part of 12 Lot 7, Block 16 of the Josephine Pankey Third Addition, an addition to the City of Little Rock as filed in 13 Book 1, Page 111, located in the Northeast Quarter of the Northwest Quarter of Section 20, Township 2 14 North, Range 13 West, Pulaski County,Arkansas; and, 15 WHEREAS, it has been determined that the Commission needs to acquire this property as right-of- 16 way, as part of the Cantrell Road Improvement Project, from Taylor Loop Road to Pleasant Ridge Drive; 17 and, 18 WHEREAS, the value of said property being acquired by the Commission was appraised by Fair 19 Market Value as Thirty-Six Thousand Two Hundred Thirty-Six Dollars($36,236.00),which is based upon 20 Thirty-Two Thousand, Three Hundred Fourteen Dollars ($32,314.00) as just compensation for the reality 21 to be acquired and Three Thousand,Nine Hundred Twenty-Two Dollars($3,922.00)for market damage to 22 the remaining lands. 23 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK,ARKANSAS: 25 Section 1. The Mayor and City Clerk are hereby authorized to execute any necessary documents, in a 26 form acceptable to the City Attorney,to sell the property to the Arkansas State Highway Commission,more 27 particularly described as: 28 Part of Lot 7, Block 16 of Josephine Pankey Third Addition, an addition to the 29 City of Little Rock, Arkansas, as filed in Book 1, Page 111, located in the 30 Northeast Quarter of the Northwest Quarter of Section 20, Township 2 North, 31 Range 13 West, Pulaski County, Arkansas more particularly described as 32 follows: Commencing at a point being used as the southwest comer of said Block 33 16 also being on the east right-of-way line of Harris Street (platted as Derrick 34 Street)as established by Josephine Pankey Third Addition as filed in Book 1,Page [Page 1 of 21 1 111; thence North 1°56'44" East along said right of way line a distance of 238.10 2 feet to the southerly right-of-way line of Crockett Street Extension as established 3 by the Arkansas Department of Transportation (ArDOT)Job No.061382 and the 4 POINT OF BEGINNING; thence continuing North 1°56'44" East along said 5 right-of-way line a distance of 11.90 feet to the northwest corner of said Lot 7; 6 thence South 87°27'44" East along the north line of said Lot 7 a distance of 140.00 7 feet to the northeast comer of said Lot 7; thence South 1°56'44" West along said 8 east line a distance of 50.00 feet to the southerly right-of-way line of Crockett 9 Street Extension as established by ArDOT Job No. 061382 and the southeast 10 comer of said Lot 7; thence North 87°27'44" West along the south line of said Lot 11 7 and said right-of-way line a distance of 95.65 feet to a point; thence North 12 47°02'45" West along said right-of-way line a distance of 58.77 feet to the POINT 13 OF BEGINNING and containing 0.14 acres,or 6,155 square-feet, more or less,as 14 shown on ArDOT plans referenced as Job No. 061382. 15 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 16 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 17 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and 18 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 19 resolution. 20 Section 3. Repealer.
