History of the Site: When the original site plan was submitted on this development, the applicant stated that they wanted a commitment only to those units in the first phase. They were advised that each subject and phase would require a site plan review. II. Project Characteristics: (a) The construction of 10 luxury condominium flats on a site of 14 acres. Special Requirements: (1) Exterior yard should have a depth of at least 25 feet. This plan complies. (2) All interior yards, yards which abut interior property lines, or any lot of record shall a depth equal to the height of any proposed building or structure. The applicant has requested a waiver. (3) All detached buildings shall be separated by a distance of at least 10 feet. This plan complies. (4) Minimum site area is one acre. This plan complies. IV. Engineering Comments: Prior drainage requirements are to be continued with this new phase. V. Staff Analysis: Staff has several comments relative to the proposal. The applicant should submit clarification as to the design or intrusion of a structure over the phase line. If both of these are filed as separate plats, this building will overlap lots. Secondly,, the final plat on the first phase has not been submitted. Before construction begins on the second phase, this plat must be recorded. The applicant has asked to waive a side yard requirement that the setback be equal to the height of the adjacent building, which in this case is 30 feet. His justification is based on a marketing study which indicated that flats were the preferred type of housing. As a result, 10 feet more were needed to make the design work. Staff has no problems with the request. VI. Staff Recommendation: Approval, subject to comments made. SUBDIVISION COMMITTEE REVIEW: The Committee decided to pass this to the Commission, subject to the applicant filing the final plat upon building permit application. -May 10, 1983 SUBDIVISIONS Item No. 9 - Continued PLANNING COMMISSION ACTION: Mr. Joe White of Edward G. Smith & Associates represented the owner. There were no objectors. A motion was made and passed for approval, subject to the filing of a final plat upon application for a building permit. The vote was: 10 ayes, 0 noes and 1 absent.
