A. BACKGROUND:
On December 3, 1998, the Planning Commission approved a
preliminary plat for the subdivision of 5.56 acres into
seven (7) lots. The lots on the west side of Point West
Dr. were to be final platted at the same time, as were the
lots on the east side of this street. The approval was
subject to conditions noted by staff, which included no
variances.
According to Chapter 31 of the Little Rock Code of
Ordinances, Section 31-94(e):
"A preliminary plat approved by the Planning
Commission shall be effective and binding
upon the Commission for one (1) year from
the date of approval or as long as work is

actively progressing, at the end of which
time the final plat application for the

A. PROPOSAL:
The applicant proposes to subdivide 5.56 acres at the
northeast and northwest corners of Kanis Road and Point West
Drive into 7 lots. The owner plans to develop small offices
on the property.
The Planning Commission recently approved an application
rezoning this property from MF-18 to 0-1. The 0-1 rezoning
will be heard by the Board of Directors on December 1, 1998.
The lots within Tract B will be final platted at the same
time, as will the lots within Tract C.
B. EXISTING CONDITIONS:
The 5.56 acres is undeveloped and wooded. The Point West
single-family residential subdivision is located immediately
north of the site. The general area contains a mixture of
residential, office and commercial uses and zoning along
Kanis Road.

C. NEIGHBORHOOD COMMENTS:
As of this writing, staff has received no negative comment
on this plat. All abutting property owners as well as the
Gibralter Heights/Point West/Timber Ridge and Parkway Place
Neighborhood Associations were notified of the public
hearing.
D. ENGINEERING COMMENTS:
Public Works Conditions:
1. Kanis Road is listed on Master Street Plan as a minor
arterial. A dedication of right-of-way to 45 feet from
centerline is required.
2. Access to lots needs to be modified to permit only right -
out drives at shown access easements for shared
driveways or access shall be taken at rear of lot.
Example: Tract B - full access between Lot 3 and 4
and Lot 2 using a rear access from this shared access
or a rear access across Lot 1. Tract C - right -in &
right -out at shared accesses shown and rear access to
Lot 2 from Lot 1 or Lot 3. Both tracts - Lot 1 and Lot
3 (Tract "C") shall take access from side streets.
3. Construct curb at 33' from centerline of Kanis and
construct 5' sidewalk at new right-of-way line 45, from
centerline.
4. Close the median on Point west Drive.
E. UTILITIES AND FIRE DEPkRTMENTI COUNTY PLANNING:
Wastewater: Sewer main extension required with easements
to serve Lots 1, 3 & 4 Tract B & Lots 2 & 3 Tract C.
Existing sewer must have easement retained on plat.

G. ANALYSIS•
As of this writing, the applicant needs to submit a revised
preliminary plat to staff, making several minor additional
notes. Those additional minor notations include the
following:
a. Name/address of property owner/subdivider
b. Source of title
c. Storm drainage analysis and storm drainage plan
d. Plat book and page or instrument number for Point West -
Phase I.
e. Names of all abutting property owners
f. Note proposed zoning of property.
g. Legal description to nearest one -tenth of an acre.
Another issue (as noted in the Public Works Comments) which
needs to be worked out relates to the driveway location for
the proposed lots. This issue was discussed by the
Subdivision Committee and the applicant stated that he would
work with Public Works in resolving the driveway locations
prior to the public hearing.
Otherwise, there should be no other outstanding issues
associated with the plat.
H. STAFF RECOMMENDATIONS:
Staff recommends approval of the preliminary plat subject to
the following conditions:
1. Compliance with the requirements as noted in paragraphs
D, E and G of this report.
2. The applicant needs to resolve the issue of driveway
locations with Public works.
SUBDIVISION COMMITTEE COMMENT: (NOVEMBER 5, 1998)
Pat McGetrick was present, representing the application. Staff
gave a brief description of the preliminary plat. Staff
mentioned several minor items which needed to be shown on the
plat.
The location of driveways to serve the various lots was briefly
discussed. Bob Turner of Public Works made some suggestions to
the applicant regarding driveway locations, using only right -in,
right -out drives along Kanis Road. Mr. McGetrick stated that
there was a need for a left turn lane into this subdivision. Mr.
McGetrick stated that he would work with Public Works on the
issue.

There being no further issues for discussion, the Committee
forwarded the issue to the full Commission for final action.
PLANNING COMMISSION ACTION: (DECEMBER 3, 1998)
Pat McGetrick was present, representing the application. There
were no objectors present. Staff gave a brief description of the
preliminary plat and a recommendation of approval with
conditions. Staff added the following condition of approval to
the recommendation: "The proposed 0-1 zoning for the property
must be approved by the Board of Directors or the preliminary
plat will become invalid."
Pat McGetrick addressed the Commission in support of the
application. Mr. McGetrick gave a brief description of the
preliminary plat and stated that the proposed driveway locations
had been approved by Public Works.
Monte Moore, of the Planning Staff, noted that one letter of
opposition had been received regarding this project.
A motion was made to approve the preliminary plat as recommended
by staff. The motion passed by a vote of 8 ayes, 0 nays and 3
absent.
