Permanent easements for access, ingress and egress, for drainage, for laying and maintaining pipes and mains, lines and cables, storm sewers, and for the installation and maintenance of water, sewer, gas, electric, telephone, cable television, fiber optic and other utilities are created, excepted and reserved over, under, across and through the Land as shown on the Plat. Any and all of the covenants set forth herein (except those set forth in the Declaration which may only be amended in accordance with its terms) may be amended, modified, extended or changed in whole or in part from time to time by written instrument signed and acknowledged by the owner or owners of three fourths (3/4) of Lots 1, 4, 5 and 6 Tract A, Parkway Place Subdivision to the City of Little Rock, Pulaski County, Arkansas. The right to amend, modify, extend, change and/or cancel shall exist at all times before August 1, 2035, and shall also exist at all times during each and every one of the successive ten (10) year periods - 4 - provided for hereinafter and shall become effective when each such instrument is filed for record in the office of the Recorder of Pulaski COLinty, Arkansas. The covenants, restrictions, and provisions of this instrument shall be automatically extended for successive periods of ten (10) years each on and after August 1, 2035, unless and until amended or canceled as authorized hereinbefore then such automatic extensions for successive periods of ten (10) years each shall apply to this instrument as so changed. To the extent the provisions of this Bill of Assurance conflict with any of the provisions, terns or restrictions of that ceftain Plat and Bill of Assurance dated November 24, 1980 this Plat and Bill of Assurance shall be deemed to supersede such Plat and Bill of Assurance and shall govern as to the Land.
