AN ORDINANCE AMENDING CHAPTER 31 OF THE
CODE OF ORDINANCES OF THE CITY OF LITTLE
ROCK, ARKANSAS PROVIDING FOR A VARIANCE
OF SUBDIVISION REGULATIONS REQUIREMENTS
FOR THE OTTER CREEK INDUSTRIAL SERVICE
CENTER, LOTS 1, 2 AND 3, TRACT 2.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 31 of the Code of Ordinances
be amended to provide for variance of certain requirements
within the Subdivision Regulations of the City of Little
Rock for the Otter Creek Industrial Service Center, Lots 1,
2 and 3, Tract 2 as follows:
Subsection a. That Sections 31-281 thru 31-288 be
amended to allow less than 5 acre lots in C-2 zoning, to
allow access to the public right-of-way via platted access
easement to Lots 2 and 3 and reduction of a 40 foot building
setback to conform to existing building footprint at
location shown on plat.
SECTION 2. This ordinance shall take effect thirty
(30) days from and after its passage.

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the City of Little Rock, Arkansas, Otter Creek
Development Company and Otter Creek Mall, Inc. executed and filed
their Plat and Bill of Assurance (the "Bill of Assurance")
pertaining to lands located in the City of Little Rock, Pulaski
County, Arkansas, described as follows:
Tract 1 and Tract 2, Otter Creek
Industrial Service Center Addition
to the City of Little Rock,
Arkansas.
A portion of Tract 2 was platted and the Plat appears of
record in Pulaski County, Arkansas, Plat Book A, at page 934 and
the original Bill of Assurance appears of record as Pulaski County,
Arkansas Instrument No. 83-29035 and the Amendment to Bill of
Assurance appears of record as Pulaski County, Arkansas Instrument
No. 90-04850;
WHEREAS, Otter Creek Park Company, a Texas general
partnership is the present owner of the portion of Tract 2 found at
Plat Book A, page 934; and
WHEREAS, the City of Little Rock, Arkansas, has
determined that by reason of the desired r_platting lay the owner of
the portion of Tract 2 that the access easements should s❑ serve
as a means of access_ for vehicular and pedestrian ingress and
egress to Lots 1, 2 and 3, Tract 2 as replatted.
NOW THEREFORE, WITNESSETH:
In consideration of the mutual covenants and promises
which the undersigned acknowledges to be of value and represent
adequate consideration, the undersigned hereby amends the Bill of
Assurance as follows:
"Grantor hereby reserves a non-exclusive easement for
vehicular and pedestrian ingress to and egress from Lots 1, 2 and
3 of Tract 2 as replatted, in favor of the public, the City of
Little -Rock and such public and private utility companies as may
from time to time provide utility services to Lots 1, 2 and 3 of
Tract 2 ,_deAjgnated as a 35-feet access and utility easement on the
replat."
Except as amended hereby, all other provisions of the
Plat and Bill of Assurance pertaining to Tract 2, Otter Creek
Industrial Service Center Addition to the City of Little Rock,
Arkansas, as previously amended shall remain in full force and
effect and unchanged hereby.

Dear Tad,
On behalf of Marathon U.S. Realties, Inc., I have enclosed for consideration
of the Little Rock Planning Commission at its September 10, 1991 meeting the
Preliminary Plat for Lots 1, 2, & 4 of Tract 2 Otter Creek Industrial Service
Center. This plat subdivides Tract 2 Otter into 3 lots with the area and uses
described as follows:
Lot 1 - 1.715 acres - 6,500 Sq. Ft. Retail Building with 24 parking spaces
Lot 2 - 4.232 acres - 13,500 Sq. Ft. Restaurant (150 seat rest. area + 50
seat lounge) & Motel Lobby and 152 unit
motel building with 190 parking spaces.
Lot 3 - 4.009 acres - 5 office buildings (38,700 sq. ft. building area) with
152 parking spaces.
The following variances are requested in conjunction with this preliminary
plat:
1. Allow less than 5 acre lot area in present C-2 Zoning.
2. Allow access to public right of way for lots 2 & 3 via platted access
easement. A 40 foot platted access easement exist around the perimeter
of the tract and access easements are proposed along the interior lot
lines. Lots 2 & 3 have existing driveway access to Interstate 30
frontage road but not to City of Rock Public Right of Way.
3. Allow reduction in 40 foot building setback line along the eastern
boundary of Lot 3, the common line between lot 1 & lot 2 and common line
between lot 2 & lot 3 to conform to existing building footprint as shown
on the preliminary plat.
