Markham Street Little Rock, AR 72201 Dear Mr. Barkowski: Following a conversation with Mr. Richard Wood, we are directing this request to the City of Little Rock Planning Commission. The Bills of Assurance for all phases of the Otter Creek Community state under Restrictions, Paragraph 2 that the Architectural Committee function shall expire after January 1 1990 unless "a written instrument shall be executed by the then record owners of a majority of the lots in this subdivision and duly recorded appointing a representative or representatives who shall thereafter exercise the same powers as previously exercised by said committee for such periods as may be specified in such instrument. We have filed documents in the Office of the Pulaski Circuit Clerk on December 29, 1989 for all phases of the Otter Creek Community viz: Phases I, IIA, IIB, IIIA, IIIB, IVA, IVB, IVB- 1, and IVB-2. These documents extend the Architectural Committee function as described in Restriction 2 of the Bills of Assurance for the respective phases for ten years beginning January 1, 1990 to be extended automatically for successive ten year periods unless written instrument is executed by the then record owners of a majority of the lots in the respective subdivisions and duly recorded appointing a representative or representatives who shall thereafter exercise the same powers as previously exercised by said committee for such periods as may be specified in such instrument. The Board of Directors of the Otter Creek Home Owners Association or its representatives has been appointed to serve as the Architectural Committee. i Mr. Tad Barkowsk:i Page 2 January 9, 1990 The Bills of Assurance first filed for the respective phases of Otter Creek Community required approval of the City of Little Planning Commission, and indicated such approval is needed for the extension of the Architectural Committee function, Restriction 2. No changes of any other stipulations of the Bills of Assurance for Phases I, IIA, IIB, IIIA, IIIB, IVA, IVB, IVB-1, and IVB-2 are being made at this time. We request the City of Little Rock Planning Commission approve the extension of the Architectural Committee, Restriction 2 of the Bills of Assurance for Phases I, IIA, IIB, IIIA, IIIB, IVA, IVB, IVB-1, and IV13-2 of the Otter Creek Community, and grant such approval at the March 13, 1990 meeting of the Commission. Attached are: I. Copies of the Bills of Assurance for the respective phases of Otter Creek Community (9 documents) 2. Copies of the documents to extend the Architectural Committee function together with signatures of owners of at least a majority of the lots. Please advise if further information is required. I promised to send this information to you during our meeting yesterday. Phase VI is the only phase in which a majority or more of the lots voted approval. The Developer owns more than 50 per cent of the lots, and we were unable to determine, at this time, who the owner -developer is or obtain approval signatures. It is my understanding that the Commission will act on our request at its March 13,1990 meeting.
