Request:
This applicant requests a review by the Planning Commission
of the extension of the Architectural Committee function,
Restriction 2, for 10 years and approval of the Bill of
Assurance for phases II, II A, II B, III A, III B, IV A,
IV B, IV B-1, IV B-2 AND VI without any changes or
stipulations.
A. PROPOSAL/REQUEST:
This applicant proposes to extend the Architectural
Committee function for ten years on Otter Creek
Subdivision. This committee has been appointed by the
Board of Directors of the Otter Creek Home Owners
Association. The proposal also includes approval of
the Bill of Assurance filed for the respective phases
of the Otter Creek community. No changes or any other
stipulations have been made at this time in any of the
Bill of Assurance.
B. ISSUES/LEGAL/TECHNICAL/DESIGN:
The only issue of concern here is the Bill of
Assurance. A proposed Bill of Assurance has been
offered for staff review. In our reading of the
instrument, we find no problems presented by the
language that is proposed.

C. ANALYSIS:
The staff review of this request reveals that the
proposed Bill of Assurance has not been changed and a
vote of over fifty percent (50%) has been recorded for
each phase except Phase VI in which a majority of the
lots are owned by the developer. There are no other
issues attendant to this proposal.
D. STAFF RECOMMENDATION:
The staff recommends approval of the extension of the
Architectural Committee and the approval of Bills of
Assurance for all phases as presented.

The applicant was present. There were no objectors. The
Commission voted 11 ayes, 0 noes and 0 absent to approve -the
extension of the Architectural Committee and approve the
Bill of Assurance for Phases I, II A, II B, III A, III B,
IV B, IV B-1, IV B-2 and VI of the Otter Creek;Community.
