AMENDED BILL OF ASSURANCE WHEREAS, Lot "A" Pleasant Valley Addition to the City of Little Rock, Pulaski County, Arkansas, was created as a one lot subdivision by its sole owner, Pleasant Valley, Inc., by its ex- ecution of a Plat and Bill of Assurance on May 26, 1977, which was filed of record in the Office of the Pulaski County Circuit Clerk and Ex-officio Recorder on July 12, 1977, in Deed Book 1446, at Page 857; and WHEREAS, a Final Plat of said lot was duly approved by the Little Rock Planning Commission on July 12, 1977, and filed of record in the Office of the Pulaski County Circuit Clerk and Ex- officio Recorder on July 12, 1977, as Number 73144 in Plat Book 40, at Page 26; and WHEREAS, Lot "A" as identified on the Plat is described as "Pleasant Valley Subdivision - Second Installment" and is iden- tified on the Plat and Bill of Assurance as "Pleasant Valley Addition"; and WHEREAS, William T. Harris and Judith Lynn Harris, his Wife, are the owners of the entire area platted as Lot "A" in the Plat and Bill of Assurance and the contemporaneously filed Plat; and WHEREAS, the current owners are desirous of removing all doubt as to the description of the subject property and confirm- ing that said lot has never been platted as a lot of record of either the Pleasant Valley Subdivision or the Pleasant Valley 1 harris.bR Subdivision - Second Installment as such subdivisions are con- stituted in the City of Little Rock, Pulaski County, Arkansas; and WHEREAS, the current owners of record wish to develop a specific set of enumerated restrictive covenants for said lot, amending the original Bill of Assurance filed on July 12, 1977, to exclude the restrictive covenants of any other subdivision which may have been made applicable to Lot "A" by reference. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the undersigned, William T. Harris and Judith Lynn Har- ris, his wife, are the sole owners of that certain tract of real property which has been identified as Lot "A" Pleasant Valley Ad- dition or Lot "A" Pleasant Valley Addition - Second Installment. That said Lot "A" is not a part of either the Pleasant Valley Subdivision or the Pleasant Valley Subdivision - Second Install- ment; but is a single lot subdivision as depicted on that certain Plat filed of record on July 12, 1977, in Plat Book 40, at Page 26, in the Office of the Pulaski County Circuit Clerk and Ex- officio Recorder as Instrument No. 73144 which shall henceforth and forever be known as Lot "A" Pleasant Valley Club Circle Addi- tion to the City of Little Rock, Pulaski County, Arkansas. Further, that the original Plat and Bill of Assurance filed on May 26, 1977, in Deed Book 1446, at Page 857, in the Office of the Pulaski County Circuit Clerk and Ex-officio Recorder is hereby amended to exclude the application of restrictive covenants of any other subdivision, including but not limited to, 2 harris.bil Pleasant Valley Addition to the City of Little Rock, Pulaski County, Arkansas, Plat Book 20, at Pages 40 and 41, or Deed Book 983, at Page 231, of the Pulaski County Circuit Clerk and Ex- officio Recorder. The subject property, Lot "A" Pleasant Valley Club Circle Addition to the City of Little Rock, Pulaski County, Arkansas, shall henceforth and forever be subjected only to the following restrictive covenants: 1. The subject property shall only be developed in a man- ner and for a use in compliance with the applicable zoning and subdivision ordinances of the City of Little Rock, Arkansas.
