BILL OF ASSURANCE
WHEREAS, McHowe Company, a General Partnership, is the owner of
the following described property located in Pulaski County,
Arkansas, to -wit:
A tract of land located in the Southeast Quarter (SE
1/4) Section Twenty -Eight (28), Township Two (2)
North, Range Thirteen (13) West, Pulaski County,
Arkansas, more particularly described as: Beginning
at the Northwest corner of Lot Six (6) Pleasant
Valley Place Commercial Subdivision to the City of
Little Rock, Arkansas, said corner being located on
the East right-of-way line of Hidden Valley Drive;
thence North 4 degrees 47 minutes 30 seconds East
along said East right-of-way line, 60.32 feet; thence
continuing Northeasterly along said East right-of-way
line, being the arc of an 851.47 foot radius curve to
the right having a chord bearing and distance of
North 7 degrees 09 minutes 26 seconds East, 70.47
feet to a corner of Lot Four (4) said Pleasant Valley
Place Commercial Subdivision; thence South 67 degrees
25 minutes 04 seconds East along a line of said Lot
Four (4), 211.11 feet to a corner; thence South 15
degrees 36 minutes 30 seconds West along a line of
said Lot Four (4) , 103.32 feet to the common corner
of said Lot Four (4) and Lots Six (6) and Eight (8)
said Pleasant Valley Place Commercial Subdivision;
thence North 74 degrees 23 minutes 30 seconds West
along the North line of said Lot Six (6), 187.87 feet
to the point of beginning.
NOW, THEREFORE, WITNESSETH:
1. That McHowe Company, hereinafter termed "Grantor", has
caused said tract of land to be surveyed by Edward G. Smith and
Associates, Registered Professional Engineers, and a plat
thereof made which is identified by title Lot Five (5), Pleasant
Valley Place Commercial Subdivision, and the date March 19,
1984, and by signature of the said Engineer and Grantor, and
bears a Certificate of Approval executed by the Little Rock
Planning Commission, and is of record in the office of the
Circuit Clerk and Ex-Officio Recorder of Pulaski County,
Arkansas, in Plat Book , Page and the Grantor does
hereby make this Bill of Assurance.
2. The Grantor does hereby certify that .it has platted said
real estate in accordance with said plat. The lands embraced in
said plat shall be forever known as designated on said plat; and
every deed of conveyance for said property shall use this
designation.
3. The filing of this Bill of Assurance and plat for record in
the office of the Circuit Clerk and Ex-Officio Recorder of
Pulaski County shall be a valid and complete delivery and
dedication of the streets and easements on the said plat.
4. All buildings constructed on said lots shall be constructed
no nearer to the street than the building line shown on the
plat, and all buildings shall be constructed in conformance with
the Building Code and the Zoning Ordinances of the City of
Little Rock, Arkansas.
5. No property within said subdivision shall be used for a
supermarket, a drive-in restaurant, a bowling alley, a depart-
ment store, a discount store, a service station or a garage.
These covenants and restrictions are to run with the land and
shall be binding on all parties and all persons claiming under
them for a period of 30 years from the date these covenants and
restrictions are recorded.
6. In the event of any attempt to violate any of the covenants
or restrictions herein, before the expiration date hereof, it
shall be unlawful for any person or persons owning property in
this subdivision or owning property in Pleasant Valley Addition
within 350 feet of this subdivision to prosecute any proceedings
at law or in equity against the person or persons violating or
attempting to violate any such covenant or restriction, and
either to prevent him or them from so doing or to recover
damages or other dues for such violation.
7. These covenants and restrictions shall not be amended,
cancelled or supplemented unless an instrument signed by the
owners of the said lot is placed on record agreeing to change
the covenants and restrictions in whole or in part and any
change must be approved by the Little Rock Planning Commission.

ACKNOWLEDGMENT
On this day of , 1984, before
me, a Notary Public, duly cormmissi ed, qualified and acting
within and for the County and State aforesaid, appeared in
person John McClellan to me well known, who stated that he is
one of the partners of McHowe Company, a General Partnership,
and that he was duly authorized on behalf of the Partnership to
execute the foregoing instrument for and in the name and behalf
of said Partnership, and further stated and acknowledged that he
had so signed, executed and delivered said foregoing instrument
for the consideration, uses and purposes therein mentioned and
set forth.
IN TESTIMONY WHEREOF, I have hereunto set my hand and seal
the day and year aforesaid.
