PHYSICAL SITE CHARACTERISTICS This plat is located toward the western boundary of the existing subdivision. The land involved can be characterized as very hilly, with slopes that naturally average in excess of 18 percent or greater. The hillside regulations should be applied in the review of this matter. B. DEVELOPMENT PROPOSAL The owner is proposing to develop this plat of 6.22 acres into ten lots for single family use. A waiver of sidewalks is requested. Justification for the waiver is based on the fact that no sidewalks have been built within the entire subdivision because of the terrain. C. ENGINEERING CONSIDERATIONS None. ul D. ANALYSIS This plat presents no real problems. "Staff, however, would like to point out that no record has been found of the street, to the west of Lot 98, that is proposed for development at a later time. In no way are we supportive of a street of this nature. It rises 50' in elevation at 200' which means that it has a grade of 25 percent. In regard to the variance request, we have no objection to sidewalks along the street right-of-way if the existing pattern of pedestrian ways is maintained. STAFF RECOMMENDATION Approval of the plat, subject to the concerns expressed by staff. SUBDIVISION COMMITTEE RECOMMENDATION Some discussion concerning the request for a waiver of sidewalks was held. Both Staff and the Committee agreed that the applicant was not essentially asking to vary from the Ordinance, but requesting a modification from the requirement of sidewalks along the Beckingham Drive right-of-way, since he has agreed to maintain the existing pattern of pedestrian ways. A motion for approval subject to the maintenance of the existing walkways was made and passed by a vote of 3 ayes, 0 noes and 2 absent. r J. r April 14, 1981 Item No. 6 - Continued SUBDIVISION COMMITTEE RECOMMENDATION A motion for approval of the plat was made and passed by a vote of 3 ayes, 0 noes, 2 absent. PLANNING COMMISSION ACTION The applicant was present. No objectors were present. Some discussion was held concerning the true nature of the proposal. The applicant chose to clarify his position by withdrawing his request for a sidewalk waiver; and by amending the application to include a formal request for the location of an internal pedestrian walkway at the southern end of Lots 89 through 94. This is in accordance with Section 37.27-D of the Subdivision Ordinance. A motion was made and passed to approve the application as amended.
