In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. None Staff recommends approval of the POD zoning. The Planning Commission voted 8 ayes, 1 no and 2 absent to recommend approval. Nix Road Villas is planned to be an upscale residential development blending traditionally -styled architecture with 21 St century construction consisting of three patio homes with two units per structure for a total of six homes. Each home would have two bedrooms and two baths. BACKGROUND CONTINUED Exterior features include masonry on three sides and smart board siding in the gable area, architectural roof shingles, lawns landscaped with Zoysia turf and automatic sprinkler systems. The roof pitch elevations will be a minimum 12/12 to enhance the aesthetics of the development. Setbacks will be a minimum of 25 feet on the front, 25 feet in the rear, and six feet on the side. Each unit would have a one or two -car garage and will be 1250 to 1500 square feet in area. Lawns and common areas would be maintained by a Property Owners Association. The Planning Commission reviewed this request at their October 10, 2019 meeting. There was one objector present. The Commission voted 8 ayes, 1 no and 2 absent to recommend approval of the item. We would ask for a variance on the dedication of additional right-of-way for Palez Avenue. This road is unopened and does not appear that it will ever be opened. 4. We have shown back -out areas for the three southern lots because of possibility of site distance issues with backing into the street. It has come to our attention that there are plans in the making to build 3 duplexes with 6 family homes on Nix road beside our home. This is of great concern to us as well as residents in this division. 1. Our small area is for Single Family homes only. Always has been. 2. We ALL are very concerned about the traffic that duplexes bring to an area. We already have streams of cars that "cut through" Nix Road from Kanis to get to Chenal or vise versa. 3. Nix Road is NOT a fully developed street in anyway and adding 6 more families in the space where there were 3 single family homes increases the flow of traffic significantly. Vehicles can only pass an approaching vehicle if the other pulls to the edge of the ditch and stops! Over half of the small street is single lane and where the houses are close together they use the street to park on both sides of the road only allowing one vehicle passage. We have an RV that a lot of the time we can't drive between them and God forbid a fire at any of our homes cause there's no way a fire truck could get through. This alone is very alarming! 4. On a road such as ours multi family rental units will more than likely bring down the property value of homeowners. Renters come and go regularly that's just a fact. 5. 1 see where there is a clause about upkeep (POA) "really" and who will maintain that it is kept up to par. Renters tend not to care nor take responsibility for making sure they keep the area maintained nor clean. Come on we all know renters do not care about the property like a homeowner does. 6. Concerning parking, how will you possibly manage that? To put the "duplexes" in this incredibly difficult spot is an accident waiting to happen! It's a very steep hill and NO ROOM FOR ERA! 7.
