10 BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
11 ARKANSAS.
12 Section 1. That the zoning classification of the following described property be changed from POD,
13 Planned Office Development, to Revised POD, Planned Office Development:
14 Z-9431: Part of the northeast quarter lying north of the State Highway 10, Section
15 20, Township 2, Range 13 West, City of Little Rock, Pulaski County, Arkansas.
16 Section 2. That the preliminary site development plan/plat be approved as recommended by the Little
17 Rock Planning Commission.
18 Section 3. That the change in zoning classification contemplated for the Copper Well Retreat Short-
19 Form POD, located at 12418 Cantrell Road (Z-943 I )is conditioned upon obtaining final plan approval
20 within the time specified by Chapter 36, Article V11, Section 36-454 (e) of the Code of Ordinances.
21 Section 4. That this ordinance shall not take effect and be in full force until the final plan approval.
22 Section 5. That the map referred to in Chapter 36 of the Code of Ord inances of the City of Little Rock,
23 Arkansas, and Designated District Map be and is hereby amended to the extent and in the respects necessary
24 to affect and designate the change provided for in Section i hereof.
25 Section 6. Severabilitp. In the event any title, section, paragraph, item, sentence, clause, phrase, or
26 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
28 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
29 ordinance.
30 Section 7. Repealer. Al I laws, ordinances, resolutions, or parts of the same that are inconsistent with

BACKGROUND
The property at 12,418 Cantrell was rezoned from R-2 to PD-O to allow for conversion of
the existing structure from residential to office use in 1995. Subsequently, the PD-O was
revised to add a health studio or spa to the approved uses for that site in 2016.

The property at 12,420 has remained undeveloped; however, it was added to the PD-O
zoning earlier in 2019 (File Z-5570-D).
A. PROPOSAL/REQUEST/APPLICANT'S STATEMENT:
The owners of the spa/retreat have been successful in their business. They have
found the building housing the spa to become too loud and congested when larger
groups are next to rooms with private services; therefore, they seek to erect a yurt
on the adjacent lot under the same ownership of their current landlord to provide
a separate space for group activities.
The yurt is considered a "semi -permanent" structure and is to be sourced from a
manufacturer of custom yurts with over 40 years of experience. The 30-foot
diameter yurt would be 15 feet in height and have an ADA-compliant ramp to
provide accessibility.
B. EXISTING CONDITIONS:
The property contains a structure initially constructed as a residence, now
converted into office and health studio uses under the current PD-O. Parking is
located both in front of and behind the building. The recently -acquired west parcel
is undeveloped.
Office uses are located to the east and on the south side of Cantrell Road.
A specialty gym and a medical clinic are located across Viewpoint Cove to the
west. The adjacent property to the north is undeveloped.
C. NEIGHBORHOOD COMMENTS:
As of this writing, staff has not received any comments from area property owners
or neighborhood associations. Notice of the public hearing was sent to all owners
of properties located within 200 feet of the site, as well as the Piedmont and Walton
Heights-Candlewood neighborhoods.
D. ENGINEERING COMMENTS:
PUBLIC WORKS CONDITIONS:
1. Cantrell Road is classified on the Master Street Plan as a principal arterial.
Dedication of right-of-way to 55 feet from centerline will be required.

Digital Submittal of Site Plan/Survey: As soon as possible, please email to akoenig@littlerock.gov a digital
file of the site plan and/or survey submitted with your application in either .dwg or .pdf format.
Sign: If a sign is required for the application request —the sign must be posted 30-days prior to the public
hearing. The sign must be posted on or before ]uIy 24,E 2019. The sign is to remain posted for the entire
review and approval process. If the sign is damaged or destroyed the applicant is responsible to replace
the sign with a new sign provided by staff.
Subdivision Committee Meeting: The meeting is at noon, City Hall Board Room, 500 West Markham
Street, on August 7, 2019. You must attend or have a representative present.
Revisions: All responses to staff comments, revisions or additional information requested at the
Subdivision Committee meeting is to be returned to staff on or before August 14 2019.
Notification: Notification of property owners as required by the Planning Commission By-laws are to be
post marked on or before August 14, 2019. Return proof of notice to me on or before August 23, 2019.
The listing of persons/property owners must be obtained from a licensed abstract or title company. You
must use the proper notice form which is included'in the application package. Failure to provide proper
notice will result in the deferral of your item for six (6) weeks.
Public Hearing: The public hearing before the Little Rock Planning Commission is set for August 29, 2019
at 4:00 pm. You or an authorized representative must be present.
Board of Directors Approval: Items requiring approval by the Board of Directors will be forwarded for
final action on October 2, 2019; however, this is not a firm date, the date of the hearing before the Board
of Directors will be determined by the City Manager at his staff meeting on September 16 2019.

The following list is the minimum criteria for submittal of a Site Plan Review issue, whether for

To whom it may concern;
We, the business owners of Copper Well Retreat, Joseph and Dawn Eick, are hoping to rezone
the currently vacant second tract on our leased land. The building on the first tract is where we
conduct our spa business. Much to our happiness, our business is doing far better than we'd
expected. Our private rooms stay busy and our larger meeting rooms also stay busy with small
parties, specialty services, yoga and classes. We have found the building gets too loud and
congested when we have groups next to private services. After researching many options, we
have concluded an external space would provide the separation and traffic control we need but
also keep with the unique experience and beautiful aesthetic look of our business.
Our intention is to erect a semi -permanent yurt on the second track, just adjacent to our
building. The entire yurt specifications, engineering and structural details including decking
have been included in this application. We plan to use the company Pacific Yurts. They have
been successfully manufacturing custom built yurts for 41 years. They have worked with many
state and city governments and are very aware of safety standards. The yurt we have designed
will be 30 feet in diameter with a total height of 15 feet at it's center dome. The structure will
have 2 doors on opposite sides with decking attaching to the ground. A wheelchair ramp, ADA
compliant will attach it to the existing back patio of the property on track 1. This will allow
continued use of our disabled clients and ADA access to the main building restrooms. Due to
the strong winds and weather in Arkansas, we are including the 'enforced weather package' as
well as a triple wall insulation on the sides and roof of our yurt. The yurt will also have 4
windows and electricity will be run to it. There will be a split unit for climate control for heating
and cooling. We believe the exceptional beauty and experience of this building will be a very
exciting addition to the city of Little Rock and are proud to have the opportunity to be the ones
to first offer it.
We intend to use this space to continue conducting our current spa business with private and
group spa services, classes, parties and workshops as well as employee training space.

Thank you for the conversation this morning. The marked up survey is attached.
We put the large Yurt up in 2020 as a necessary reaction to COVID. We found that clients do not prefer a service in
that structure because of its size. We are planning to assemble two smaller (14' Yurts) on the property to satisfy
client preferences and remain in business.
We are not offering any new services and will only offer the services we are approved for in our zoning. There will not
be a marked increase in traffic or utilization since the larger Yurt use is different from original intention. It is primarily
used for staff training and meetings since we have almost complete turnover from COVID.
In summary - this project assembles two small Yurts in an existing clearing where a structure was obviously present
before we occupied the property. There will be no change in services provided and no increase in traffic or
utilization.
Please contact me with questions as I need to get this approved as soon as possible.
