A conditional use permit is requested to allow for use of the existing residence on this R-2 zoned property as a homeless shelter. STAFF REPORT: On August 23, 2017, the applicant requested withdrawal of this item. STAFF RECOMMENDATION: Staff recommends approval of the withdrawal request. PLANNING COMMISSION ACTION: (SEPTEMBER 14, 2017) The applicant was not present. There were no objectors present. Staff informed the commission that the applicant had requested withdrawal of the item on August 23, 2017. Staff recommended approval of the withdrawal request. There was no further discussion. The item was placed on the consent agenda and approved for withdrawal by a vote of 9 ayes, 0 noes and 2 absent. SUBDIVISION COMMITTEE COMMENTS AUGUST 23, 2017 ITEM NO.: 5. LUCIE'S PLACE HOMELESS SHELTER CONDITIONAL USE PERMIT 7916 HARMON DRIVE Q-92541 Planning Staff Comments: 1. Provide a copy of the bill of assurance for Killarney Addition. Plat references Deed Record Book 653 page 458. 2. Will any of the residents drive? If so, where will parking occur? If not, what transportation is available? 3. The cover letter indicates a "live-in resident advisor." Is that person counted toward the occupancy of 7 persons? 4. Section 8-406(a) of the City's Buildings and Building Regulations Ordinance (minimum area per dwellings unit) requires 150 square feet for the first occupant and 100 square feet for each additional occupant. Therefore, the minimum area for a residence occupied by 7 persons is 750 square feet. The residential structure contains 2,528 square feet. Section 8-406(b) (minimum area per bedroom) requires 70 square feet for the first occupant and 50 square feet for each additional occupant. According to Section 8-406 of City Code, following is the minimum required area for each bedroom with the occupancy as proposed: Square Feet Beds Bdrm 1 155 2 Bdrm 2 137 2 Bdrm 3 90 1 Bdrm 4 130 2 7 Separation, spacing and procedural requirements for homeless shelters will be determined by the planning commission so as not to adversely impact the surrounding properties and neighborhood. Unless the commission determines that a different area is more appropriate, a neighborhood shall be defined as an area incorporating all properties lying within one thousand five hundred (1,500) feet of the site for which the permit is requested. In addition to the development standards and review guidelines established in section 36-107 of this chapter, issues that the planning commission will consider during its review of such facilities include, but are not limited to: a. Spacing of existing similar facilities. b. Existing zoning and land use pattern. c. The maximum number of individuals proposed to the served, the number of employees proposed and type of services being proposed d. Provisions for readily accessible public or quasi -public transportation. e. Access to support services such as social services agencies, employment agencies and medical service providers. Capacity Fee Analysis Required Entergy: Entergy does not object to this proposal. Service is already being provided in the rear of this property with no apparent conflicts with existing facilities. Contact Entergy in advance to discuss any changes to electrical service requirements, or adjustments to existing facilities (if any) as this proposal proceeds. Centerpoint Energy: No comments received AT&T: No comments received Central Arkansas Water: CAW has no objection to the Conditional Use Permits for the subject meeting. Building Codes: Project is a change in occupancy and is therefore subject to current building code requirements. County Planning: No comments ITEM NO.: 5. CON'T Z-9234 Rock Region METRO: a) Location is nearby served by METRO on route 1 Pulaski Heights and route 8 Rodney Parham. METRO has no objections to providing transitional housing in this area which is served by transit. However, we feel the choice of location could be closer in order to provide access to transportation for jobs and services. The closest bus stop is .58 miles from this location which could present a barrier for those with disabilities. Plaiming Division: No comments. LandscUe: No comments. Other: Submit responses to staff issues and four (4) copies of a revised site plan (if required) no later than Wednesday, August 30, 2017. Required notices are to be sent via certified mail to all owners of properties located within two hundred (200) feet of the site no later than Wednesday August 30, 2017. The City provided notice form must be used. Proof of notices is to be provided to staff no later than September 8, 2017.
