Our office does not grant that type of permission. All residents that own rental property are required to register it with the City. We utilize the business license program to track the registration of these properties. We do not have an application on file. However, owners of 3 or less residential properties (no commercial) fil out a form listing the rental properties address which does not need Zoning's approval. Attached is the only form we have on file for them, which is an assessment form from 2012. They are required to fill out as assessment form every year listing their rental properties as this might change. You asked about parking and transportation. Most of our residents do not have a vehicle, so it is rare to have more than two vehicles parked in the driveway at any one time. Some residents walk to the bus stop or have jobs within a 15 minute walk of the house. Others catch rides from family, friends, or co-workers. One of the Truth & Transitions (T&T) managers, Paul or Elaine Owens, or myself also provide backup transportation to appointments, jobs, runs to the grocery store, etc. Occasionally residents have called a commercial cab as a last resort. You asked about an onsite staff person or manager who would supervise and maintain discipline. First we have a published set of home rules that all residents sign upon in -processing (see attached). The home rules are enforced by the home leader who is one of the residents and lives at the home. If the home leader needs assistance enforcing the rules, he contacts one of the T&T managers, Paul or Elaine Owens, who do not live at the home, but make frequent visits as required. Paul and Elaine have additional third party resources if the individuals have an assigned case manager or parole officer. We also have a pastoral advisor and a nurse on call. These third party resources can assist and intervene in certain situations if the individual needs counseling to either stay in or be removed from our program. If Paul or Elaine cannot resolve the matter, they contact me, Henri Pousardien, as the owner and property manager. We collectively decide on a resolution to get the individual the help they need while maintaining the integrity of our mission. If there is evidence of criminal activity we report it and turn the matter over to the police. Please let me know if I can be of any further assistance. Henri J. No alcohol or controlled substances or any illegal activity on the premises or you have to leave. You will be subject to random drug tests. Background checks will be reviewed. You must provide name and phone number of probation officer, if applicable and a copy of driver's license or government ID card. Background check costs $25 (nonrefundable) plus there is a $75 security deposit and then $ioo rent is due weekly on the weekday that started your residency. Each resident shall pay an additional $20 fee each week for food and other grocery store items. You shall not consume food belonging to others without permission and must be replaced by agreement. There will be a home leader and there will be other residents living in the property. You shall sign out anytime you will be off the premises for any length of time and sign in when you return. Any visitor who comes to the house has to be approved by the home leader or Paul Owens if the home leader is not available. You will not borrow from or loan money to the other residents. You shall immediately open a savings account with a local bank and put 50 percent of all net earnings in your savings account and show proof of such action within two business days of each payday. The funds will remain in your savings account as long as you are a resident of T&T. No persons of the opposite gender are allowed in the bedrooms. You must attend three weekly meetings, as scheduled, including a church meeting at the Church of Burns Park or other alternatives will be considered upon request. He has two rental units according to our records. According to the business license ordinance, an owner can register up to three rental units for an annual fee of $35.00. I am a home owner living on Archwood street. I feel that everyone deserves not to be homeless but the plans are to have 13 people occupying that house that means there could be 90 or 100 different people living there each year. None of us can choose our neighbors but I suspect the majority of homeowners in Broadmoor want neighbors that care about the neighborhood that want it to be safe and thrive. I personally have spent thousands of dollars remodeling my home. I believe in this neighborhood. Many of my neighbors do as well. Broadmoor could easily turn to an unsafe place. What if more houses become shelters. What if there was a 50/50 mix of good guys at the shelter to not so good guys? I'm a single woman living up the street. I'm really confused how so many cities try to turn transitory neighborhoods into better ones this will bring the neighborhood down. Not for it! There has to be another solution for all parties. I was made aware of the conditional use permit (Z-9235) recently from a flyer placed on my door. The home at 7109 Archwood Drive is - 1725 square feet and is proposed to be a homeless shelter for 13 individuals. Further, the application allows for 13 beds to be rented weekly at a cost of $100.00 a week. I am against the Z-9235 application and I will be out of town for work during the planning meeting to discuss on August 3, 2017. You may wish to email me at the email address below if you have any followup questions or concerns. The property at 7109 Archwood doesn't appear to be in the best of shape. The yard seems to be unkempt, windows drawn, and is at the end of a row of houses on Archwood Drive. I bought my home at 7009 Archwood in October 2015 and this is my first home to own. In my time here I haven't had any issues with crime personally but have heard gunshots frequently and have reported several that seemed to be near or in Boyle Park which is located across the street. Being near the park, I observe many people on foot, some of which I believe may be homeless. The area near 7109 Archwood Drive is a busy intersection that cuts through Boyle Park and does not have a mass transit (CAT) stop that would assist homeless individuals to go to work. The area around Archwood Drive is pleasant with homes that are mostly well-kempt. We experience quite a few people driving through our neighborhood that don't live in this neighborhood but rather pass through the neighborhood traveling to or from West 36th St up to University Avenue. Additionally, this location is less than a mile from Colonel Glenn Rd. which you may observe at any time several homeless individuals walking along the perimeter of the road. A homeless shelter in our community would significantly add to cross traffic through this neighborhood and homeless foot traffic. If the City of Little Rock does indeed aim to address crime in the City, around the Colonel Glenn area, and also maintain or do what it can to increase property values, then I would urge you to deny this application because this kind of facility does not align itself with the goals listed above. If the City is indeed working on a master parks plan which may or may not include Boyle Park, I would again urge the City not to approve the conditional use permit (Z-9235) at 7109 Archwood Drive. This area needs encouragement from the City to shine, thrive, and to become a community that people dream of living in. I just don't see a homeless shelter located in a residential community with — 132 square feet per resident a step in the right direction. I would ask that the Planning Commission align themselves with the strategic plan and vision of the City of Little Rock. I have never met the owners of the home or any residents at 7109 Archwood Drive. I am incredibly concerned that the City of Little Rock would consider this property to be used as a homeless shelter with 13 beds. This property at - 1725 square feet is incredibly small to house 13 individuals. I do believe that homelessness is a problem not just in Little Rock, but in the entire Country. However, installing a homeless shelter in a residential neighborhood does very little to address the underlying problems around homelessness. I would encourage the owners at 7109 Archwood Drive to become affiliated with Our House or another homeless program that really works in Little Rock if their desire is to help homeless individuals instead of finding a use for the property at 7109 Archwood Drive or worse to profit off of the homeless community. Pousardien, property owner and manager. • The CUP application states that the property in question will operate as a "homeless shelter", yet also states that "the current cost is $100 per week" for these homeless occupants to have one of 13 beds. However, the Home Rules state that occupants will be expected to pay an initial $220 just to secure a bed, then $120/week thereafter. Where will the homeless procure such funds? o The CUP application states that "T&T is to provide a faith based, safe and secure housing environment", and page two of the letter to the Planning Department states "T&T maintains a controlled and structured environment", yet none of the four documents referenced mentions any safety or security measures in place to control activity at the facility. e The CUP application states that "the home is available, as required, 24 hours a day", yet none of the four documents referenced mentions 24-hour access or supervision, only that there will be a Home Leader who may or may not be available. • Page one of the letter clearly states "The home is available... to those who are homeless or with drug and/or alcohol addictions who desire help and are willing to follow the published home rules until they are able to live on their own." However, on page two of that same letter, a contradiction is clearly stated: "T&T is a homeless shelter, not a rehab facility. If individuals need rehab we do not take them in until after they have completed a rehab program at other facilities. If a current resident is deemed to need rehab we dismiss them..." This is reiterated in the Neighborhood Cookout flier. • Page two of the letter, as well as the Neighborhood Cookout flier, Mr. Pousardien state that applicants for residency will be referred to the facility by the Veterans Administration and Bridgeway. Contact information for individuals at these organizations who will be making these referrals is hereby requested. • Page two of the letter, as well as the Neighborhood Cookout flier, states "T&T assists with immediate job placement and in the interim provides opportunities for residents to work for rent." What is the nature of this work, and who is receiving the benefit of this free labor from the homeless residents in return for a bed? Also, the Home Rules make no mention of requiring residents to have a job. ADDITIONAL CONCERNS UESTIONS ARISING FROM THE FOUR REFERENCED DOCUMENTS: • The property in question is located approximately 100-200 yards from a city park and playground. The sleeping area in the home is approximately 872 square feet. -How will this accommodate 13 people? -Is the 24-hour on -site Home Leader considered one of the 13 people? -If not, does the Home Leader sleep in a separate area from the other residents? -Where? Is this area part of the 872 square feet? • Will residents be allowed to smoke in the facility? How has fire safety been addressed? ■ A man in a wheelchair has been seen numerous times outside the home on this property. Is the facility ADA compliant? (this includes, at the least, entrances/exits and bathrooms) ■ Will the facility have a commercial kitchen equipped and licensed to accommodate 13 residents? • How and to where will the residents of the shelter be encouraged to move after their two -month stay? • Which rehabilitation facilities/programs will be acceptable for meeting the residential requirements? • T&T has stated that food donations are accepted, in addition to the $20/resident that will be collected weekly for food. How will all of this be allocated? • Will security be available on the premises at all times? ■ How will possible gang activity/affiliation be addressed? ■ If tenants have vehicles, what is the parking arrangement? • There are no bus routes in the area. If tenants do not have vehicles, how will tenants be transported to jobs/meetings/banks? • Is T&T licensed to operate a business, and is the residential property in question zoned for business? Since T&T is requiring rent in order for the tenants to remain on the premises, this facility is not a homeless shelter (as specifically stated on the CUP application and all literature), but rather a short-term bed -to -let business, requiring a business license to operate, and to operate only in an area zoned for such a business, which does not include a residential neighborhood. Is an application for a business license for T&T in process? Is the neighborhood being rezoned to accommodate T&T's business? Have the neighborhood residents been notified of any rezoning hearings? All of this must be done before any such business can commence operation. • If T&T is a non-profit organization, then there should be a Board of Directors who can be contacted for information, financial statements, etc.; said list of the Board of Directors is hereby requested. • Information about the Church at Burns Park and its leadership is hereby requested, as well as explanation for why tenants must attend a weekly meeting at the Church at Burns Park. • T&T has stated that a Profit -and -Loss Statement is available upon request, as well as a homeless shelter license; said documents, as well as other financial and tax statements, are hereby requested. The following concerns/questions apply specifically to the Home Rules document, which is what each resident must sign/date when applying for a space at the facility, and these are the rules that the residents will be held accountable to. Therefore, this document is particularly worthy of scrutiny in that the health, safety, and well-being of the homeless resident, as well as of the surrounding community, are at stake. The Home Rules document states "You can be immediately evicted for infraction of any of the home rules." - Who will ensure compliance with the Home Rules and how? - Who will evict non -compliant residents and how? - When residents are evicted: - Where do they go? Are they taken somewhere, or are they turned out onto the street? - What happens to their belongings? - What happens to their mandatory savings account and the accrued funds? - What happens to their prescription medications the nurse has been dispensing? - Do they get their deposit back if there have been no damages incurred? ■ The Home Rules document states "No alcohol or controlled substances or any illegal activity on the premises oryou have to leave." - What enforcement safeguards are in place to ensure this? - What enforcement safeguards are in place to ensure there is "no alcohol or controlled substances or any illegal activity" taking place off the premises, such as in the street, in the wooded area across from the premises, the nearby city park, or in the surrounding residential areas? - Are weapons allowed on the premises? If not, how will this be enforced? The Home Rules document states "You will be subject to random drug tests." - How often is the testing conducted? - How will this be conducted? - Who is conducting the testing? - Where is the testing conducted? - Who is paying for the testing? - Which lab will be analyzing the results? - How are the results verified and recorded? The Home Rules document states "Background checks will be reviewed." - How are background checks for prospective residents conducted? - Who provides them? - What is included in the background check? - Who signs off on whether or not a prospective resident meets the standard? ■ The Home Rules document states "Background check costs $25 (nonrefundable) plus there is a $75 security deposit and then $100 rent is due weekly on the weekday that started your residency. Each resident shall pay an additional $20 fee each week for food and othergrocery store items." The applicant must, therefore, pay $220 cash up fs-ont before even being accepted as a resident. - Is it realistic to expect a homeless person to have $220 to procure a temporary bed in a `shelter'? - Is the security deposit refundable? • The Home Rules document states "You must provide name and phone number of probation officer, if applicable, and a copy of drivers license orgovernment ID card." - Persons on probation cannot legally be housed together. How will this be avoided? - A person on probation has a criminal background. - Is a criminal background acceptable for a resident? - Is this not part of the background check? The Home Rules document states "You shall not consume food belonging to others without permission and must be replaced by agreement." - How will this be enforced? - How will food be obtained and distributed among the residents? - How many meals/day will be provided for each resident? - If food requires preparation, who will prepare? • The Home Rules document states "There will be a Home Leader and there will be other residents living in the property." - What are the qualifications of the Home Leader? - Is the Home Leader residing on the premises and available 24/7? - If not, how is oversight of activities on the premises maintained to ensure compliance with the Home Rules? • The Home Rules document states "You shall sign out anytime you will be off the premises for any length of time and sign in when you return." - How will this be enforced? - Where will a resident be allowed to go when checked out? - How will a resident's whereabouts be monitored when checked out? - To whom and by whom will a resident's unaccounted-for absence be reported? • The Home Rules document states "Any visitor who comes to the house has to be approved by the home leader or Paul Owens if the home leader is not available." - This implies a home leader will not be available 24/7 to monitor the facility and residents. - Will visitors also undergo a background check and be checked for alcohol, illegal substances, and weapons before being allowed to enter the premises? - Will visitors be allowed to stay overnight? If so, where will they sleep? Meals? ■ The Home Rules document states "You will not borrow from or loan money to the other residents." - How will this be monitored/enforced? • The Home Rules document states "You shall immediately open a savings account with a local bank..." - Will transportation be provided to a bank? - How is the bank account set up? Deposit only? - If the tenant is homeless, what address will be on the account? - If a government issued ID or SS# is not available to open the account, under whose name will it be opened? - Who will have access to the account until the tenant is no longer a resident? - How will the former resident retrieve funds from the deposit -only savings account? H ■ The Home Rules document states "..[you shall] put 50 percent of all net earnings in your savings account and show proof of such action within two business days of each payday." - How will this be enforced? - Will transportation be provided within two business days of each payday? - What will be the proof of earnings? - What will be proof of deposit? - What will be proof of payday? - How will cash earnings be accounted for? - Is having a job even required? (no such requirement stated in the Home Rules) ■ The Home Rules document states "No persons of the opposite gender are allowed in the bedrooms." - How will this be enforced? - Are there separate areas for men and women residents? - If this is a co-ed housing facility: - Will you accommodate women with children? - If so, will women have to pay an additional $100/week for each child? - If so, will women have to pay an additional $20/week/child for food? - How will the welfare of the children be ensured? - Where will the children be attending school? - Who will take care of any children while a mother is working? * The Home Rules document states "You must attend three weekly meetings, as scheduled, including a church meeting at the Church of Burns Park or other alternatives will be considered upon request." - Why the Church at Burns Park? - Where are the other two required meetings? - What is the purpose of each of the three required meetings, and who will conduct them? - How will residents be transported to the three meetings? ■ The Home Rules document states "Any complaints go to the Home Leader and if unresolved contact Paul Owens (phone numbers). If still unresolved call Henri Pousardien (phone numbers)". - How are disputes handled/resolved? - Is there a house land -line phone available to residents if calls become necessary? - Will the tenant be evicted if unresolved? If so, to where? ■ The Home Rules document states the days/hours of a curfew and "strict lights out policy." - How will this be enforced? • The Home Rules document states "Ifyou have a job, coordinate your hours with the Home Leader." - How will having a job that requires coordination of hours be verified? (nowhere in the Home Rules document does it mention the necessity for having a job) - How will the Home Leader verify that a resident has gone to a job outside of regular curfew hours?
