RIGGS, IN AN AMOUNT NOT TO EXCEED AN 7 ANNUAL BUDGET OF TWO HUNDRED FIFTY THOUSAND DOLLARS 8 ($250,000.00), FOR AN ANNUAL CONTRACT FOR CATERPILLAR 9 PARTS AND SERVICE FOR THE FLEET SERVICES DEPARTMENT; 10 AND FOR OTHER PURPOSES. 11 12 WHEREAS, it is critical that the Fleet Services Department ("Fleet") be equipped with reliable 13 Caterpillar Parts and Service Tools for minor repairs and maintenance on Caterpillar Equipment currently 14 in the City's fleet;and, 15 WHEREAS,J.A. Riggs is the only authorized Caterpillar dealer in Central Arkansas;and, 16 WHEREAS, Little Rock, Ark., Ordinance No. 22,158 (August 2, 2022), authorized a contract with 17 J.A. Riggs for one(1)-year,with the option of two(1)additional one(1)-year terms;and, 18 WHEREAS, the Annual Budget for each one (1)-year term is not to exceed Two Hundred Fifty 19 Thousand Dollars($250,000.00);and, 20 WHEREAS,this extension represents the third and final year of the contract. 21 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. The Board of Directors hereby authorize the City Manager to enter into a final one(1)-year 24 contract extension with J.A.Riggs,in an annual amount not to exceed Two Hundred Fifty Thousand Dollars 25 ($250,000.00),for the purchase of Caterpillar Parts and Service for the Fleet Services Department. 26 Section 2. Funding for the annual amount is allocated in various Fleet Maintenance and Parts 27 Accounts. 28 Section 3. Because J.A. Riggs is the only distributor for the Caterpillar Parts and Service meeting the 29 Departments specifications, the Board of Directors declares it is impractical and unfeasible to submit this 30 purchase to competitive bids. 31 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 32 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 33 adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and Page I of2l I effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 2 ordinance. 3 Section 5. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with 4 the provisions of Little Rock, Ark., Ordinance No. 22,158 (August 2, 2022), are hereby repealed to the 5 extent of such inconsistency. 6 PASSED: April 16, 2024 7r�''V.
