3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE
4 PERMANENT AND TEMPORARY EASEMENTS FOR THE
5 ACQUISTION AND LEASE OF LAND FOR THE TRI-CREEK
6 GREENWAY TRAIL PROJECT; AND FOR OTHER PURPOSES.

8 WHEREAS,the City of Little Rock, Arkansas, was awarded Three Million Dollars ($3,000,000.00)
9 in CARTS 2021 Surface Transportation Program Block Grant Funds by the Metroplan Board for the Tri-
10 Creek Greenway Trail Project; and,
11 WHEREAS,the Tri-Creek Greenway Trail Project is a twelve(12)-foot trail corridor in the center of
12 the City of Little Rock following Rock Creek, Fourche Creek and Brodie Creek,from War Memorial Park
13 to Hindman Park;and,
14 WHEREAS, it has been determined that it is necessary to authorize the City Manager to execute
15 Permanent and Temporary Easements for the acquisition and lease of land for the Tri-Creek Greenway
16 Trail Project.
17NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. The Board of Directors authorizes the City Manager to execute any necessary documents,
20 in a form acceptable to the City Attorney,to acquire and lease property for the acquisition and lease of land,
21 including Permanent and Temporary Easements for the Tri-Creek Greenway Project.
22 Section 2. Funding for these acquisitions will come from the Tri Creek Greenway Account No.
23 326459-TS45C18.
24 Section 3. Severabi/ilt. In the event any title, section, paragraph, item, sentence, clause, phrase, or
25 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
26 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and
27 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
28 resolution.
29 Section 4. Repealer.All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
30 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
