3 A RESOLUTION TO EXPRESS THE WILLINGNESS OF THE CITY OF
4 LITTLE ROCK, ARKANSAS, TO UTILIZE FEDERAL-AID
5 TRANSPORTATION ALTERNATIVES PROGRAM (TAP) FUNDS FOR
6 THE WEST MARKHAM STREET SIDE PATH PROJECT; TO
7 AUTHORIZE THE CITY MANAGER TO EXECUTE ANY AND ALL
8 NECESSARY AGREEMENTS AND DOCUMENTS FOR ITS
9 ADMINISTRATION; AND FOR OTHER PURPOSES.

11 WHEREAS, the City of Little Rock, Arkansas (City), understands that Federal-Aid Transportation
12 Alternatives Program (TAP) Funds are available at 80% Federal participation and 20% local match to
13 develop or improve the West Markham Street Side Path Project;and,
14 WHEREAS, the City understands that Federal-Aid Funds are available for this project on a
15 reimbursable basis, requiring work to be accomplished and proof of payment prior to actual monetary
16 reimbursement; and,
17 WHEREAS,the City is submitting a grant application for the TAP Funding for a Side Path Project
18 along West Markham Street, from North Woodrow Street to South Park Street, in front of the Arkansas
19 School for the Deaf and Arkansas for the Blind and Visually-Impaired;and,
20 WHEREAS,this project, utilizing Federal Funding, will be open and available for use by the general
21 public and maintained by the applicant for the life of the project.
22 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. In the event that grant funds are awarded,the City of Little Rock,Arkansas,will participate
25 in accordance with its designated responsibility, including maintenance of this project, and the Board of
26 Directors authorizes and directs the City Manager to execute all appropriate agreements and contracts
27 necessary to expedite the construction of the above stated project.
28 Section 2. The Board of Directors pledges its full support and hereby authorizes the Arkansas
29 Department of Transportation to initiate action to implement this project.
30 Section 3. Funding for the 20% local match is available from the Public Works Department Street
31 Fund.
32 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of this resolution, which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
2 resolution.
3 Section 6. Repealer. All laws, ordinances and resolutions, or parts of the same, that are inconsistent
4 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
