Section 6. Severabi1hy. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The applicant is requesting a rezoning of 39.987 acres from
R-2, Single-family to PD-R, Planned Development
Residential to allow the development of the area with
71 residential lots of attached and detached single-family
homes.

Staff recommends approval of the requested PD-R zoning.
The Planning Commission voted to recommend approval of
the PD-R zoning by a vote of 10 ayes, 0 noes and 1 absent.
The applicant is requesting a rezoning of the site from R-2,
Single-family to PD-R, Planned Development Residential.
The site contains 39.987 acres and is proposed for
development with 71 residential lots of attached and
detached single-family homes. The applicant is requesting
15-foot front building setbacks for the homes proposed in
Block 3 and a 20-foot front building setback for the homes

located in Blocks 1, 2 and 4. The lots located in Blocks 1
and 2 are indicated with 50-foot lot widths. The lots located
in Block 3 are indicated with a 32-foot lot width. The lots
located in Blocks 1, 2 and 4 are indicated with 5-foot side
yard setbacks. The lots located in Block 3 are indicated as
attached single-family residences with zero side yard
setbacks.
The Planning Commission reviewed the proposed PD-R
request at its February 2, 2017, meeting and there were no
registered objectors present. All property owners located
within 200-feet of the site were notified of the public
hearing. There is not an active neighborhood association,
registered with the City of Little Rock, located in the
area. Please see the attached Planning Commission
minute record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.

Subject: Parkside Entrance Sign
Dana,
The sign we would like to construct at the entrance to Parkside at Wildwood on Denny Rd would be 7" wide at
the base and approximately I I' tall. The sign itself will be built so it will not sway in the wind. It will be the
only subdivision sign at the entrance and will be maintained by the neighborhood RID. Please let me know if
you have any questions.
Regarding Wildwood Ridge Phase 4, I think we would like to pull that application off the agenda and revisit the
project at a later date.

WHEREAS, the City Clerk has presented the petition to the Mayor; and
WHEREAS, the Mayor has set the regular March 20, 2018, meeting which begins at 6:00 PM as the date
and time for a hearing before the Little Rock Board of Directors for consideration of the petition; and
WHEREAS, the Little Rock Board of Directors has determined from an Abstractor's Certificate of
Property Ownership that those signing the petition constitute all the owners ofthe real property to be located in
said District; and
WHEREAS, the Arkansas Municipal Property Owners' Improvement District Law provides that if the
governing body determines that all the owners of the real property to be located in the District have petitioned
for the improvements, it shall then be its duty by ordinance to establish and lay offthe District as defined in the
20 petition and to appoint the Commissioners named in the petition.
21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
22 LITTLE ROCK, ARKANSAS:
23 Section 1. That the real property described in Exhibit A attached hereto and made a part hereof is hereby
24 established and laid off as City of Little Rock Municipal Property Owners' Multipurpose Improvement District
25 No. 2018-330 (Denny Road Recreation District) for the purpose of providing recreational facilities and
26 maintaining the infrastructure and improvements within the District, together with facilities related to any of
27 the foregoing within said District.
28 Section 2. The following three (3) individuals are hereby appointed as commissioners of said
29 Improvement District: Robert Graham Smith; Scott M. Hurley; and John Zack DeYmaz.
30 Section 3. The name of Improvement District shall be City of Little Rock Municipal Property Owners'
31 Multipurpose Improvement District No. 2018-330 (Denny Road Recreation District).
32 Section 4. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or
33 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance,

Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any
provision of this ordinance are hereby repealed to the extent of such conflict.
Section 6. Emergency. The Board of Directors hereby determines that there is a need for additional
infrastructure within the City and hereby determines that the passage of this ordinance will facilitate
construction of 4i lditional infrastructure within the City, therefore, an emergency is hereby declared to exist,
and this ordinance being necessary for the public health, safety and welfare shall be in full force and effect
from and after its passage and approval.

to be placed on the December 15th, 2016 Planning Commission Meeting Agenda. We are requesting the
following items with this development:
1. Advanced Grading for future development to the west of this phase. This will allow grading for
future development and moving of excess material from that grading to the future development.
Also, by allowing the bulk of the grading to occur in this phase, developed streets from Phase 1
will not be damaged by construction traffic. All material in planned to remain on the property.

3. Zero foot lot lines with attached quadplexes on Block 3.

Ladies and Gentlemen:
On behalf of Deltic Timber Corporation ("Deltic"), we wish to bring to your attention
certain matters which relate directly to the above referenced Application currently
pending before the Little Rock Planning Commission. Although Deltic has no
ultimate objections to the Applicant's development of the subject property as proposed,
there are aspects of the pending Application which may not have been fully considered
by the Staff of the Little Rock Planning Department.
First, the real property which is the subject of this Application was originally acquired
from Deltic in two purchases in 1998 and 2001. The deeds conveying the subject
property from Deltic to the original purchasers contained restrictions limiting the use
of the property to construction of "a privately -operated pre-school, kindergarten,
elementary or secondary school(s) through the twelfth grade" for a period of 20 years
(the "restrictive period"). These restrictions expire as to the first tract on or about
January 15, 2018 and, as to the second tract on or about August 30, 2021.
Notwithstanding the sale of both tracts of property to the current owner, Deltic has
indicated strongly that it will enforce the restrictions on development should any use
of the property for an unpermitted purpose during the restrictive periods, become
apparent. The Applicant through legal counsel has indicated that he acknowledges
the restrictions on development and, assuming he complies with such restrictions as
he proceeds with his development of the proposed Wildwood Trails neighborhood, it
should not be necessary for Deltic to take steps to enforce the restrictive covenants
which were attached to the Applicant's property. Copies of the deeds containing the

restrictive language and a diagram illustrating the two tracts of property are enclosed
for your information.
In addition to the restrictive covenants affixed to the subject real property, approval of
any development of the property by the Chenal Valley Architectural Control
Committee ("ACC") is also a condition found in the enclosed deeds. The period of
review and approval by the ACC is also limited to 20 years, in the case of each tract,
but there has been no submission of the pending Application to the ACC for its
consideration at this time and should the ACC impose development requirements
which are either different from or inconsistent with those approved by the City, it
could become necessary for this Application to come back before Planning Commission
for reconsideration.
Finally, Deltic developed the first three phases of the Wildwood Place neighborhood
which is adjacent to and west of the subject property in 2015 and is presently
completing Phase IV. The Wildwood Place neighborhood is served by a sewer line and
pump station (the "Denny Road Pump Station") designed, developed and constructed
by Deltic in cooperation and conjunction with the Little Rock Wastewater Utility
("LRW"). Deltic and LRW entered into that certain "Sanitary Sewer Pump Station
Operation and Maintenance Agreement" dated December 10, 2014 (the "Contract"), a
copy of which is also enclosed for your information, which states in pertinent part as
follows:
"As evidenced by that certain Dedication Deed executed concurrently
herewith, Deltic Timber Corporation conveyed ownership of a sanitary
sewer pump station. . . . .to [LRWU] for the benefit of Wildwood
Place neighborhood for sewage disposal. As exchanged consideration
for said dedication, and for other valuable consideration herein recited,
[LRWU] will accept said pump station into its system and henceforth
operate and maintain the pump station for the benefit of the
Wildwood Place neighborhood." (Emphasis supplied)
It is Deltic's understanding that the Staff of LRW may recommend that the Little
Rock Sanitary Sewer Committee approve Mr. Smith's request to tie -on to the LRW
system which would permit effluent from the subject development to be handled by
the Denny Road Pump Station. In response to Deltic's request for clarification, LRW
has provided written assurance that there is sufficient capacity in the Denny Road

purposes and in the interest of preventing future confusion concerning developments
in the Denny Road area. Deltic strives to cooperate fully with the City of Little Rock,
the Little Rock Planning Department and the Little Rock Planning Commission to
create and insure harmony between the City's planning process and enforcement of

1. Sanitary Sewer Pump Station. As evidenced by that certain —
Dedication Deed executed concurrently herewith, DTC conveyed ownership of a
sanitary sewer pump station, as described herein at Exhibit A, ("pump station") to
the Utility for the benefit of the Wildwood Place neighborhood for sewage
disposal. As exchanged consideration for said dedication, and for other valuable
consideration herein recited, the Utility will accept said pump station into its
system and henceforth operate and maintain the pump station for the benefit of
the Wildwood Place neighborhood.
2. Service. The Utility agrees to perform in a good and workmanlike
manner the following specific services pertinent to the operation and
maintenance of the pump station located at the Wildwood Place neighborhood,
also known as "Denny Road Pump Station, Little Rock, Arkansas":
A. The Utility personnel will make such visits to the pump station site
for operational observance and routine preventive maintenance as is
deemed necessary and prudent by the Utility; and

B. The Utility personnel will provide such emergency service and
otherwise routine and non -routine maintenance as is required to keep the
pump station functioning properly at all times, including any necessary
parts and labor incident thereto; and
C. The Utility personnel will make timely payment on any and all utility
bills incurred in the operation of said pump station facility.
3. Compensation. In consideration for the above ongoing services,
DTC will pay to the Utility, who will accept in full payment therefore, the following:
A lump sum payment for services to be rendered by the Utility in
the amount of $41,500, which amount is based on the Utility's
experience with operating expenses for similar pump stations
(including a reasonable amount for overhead, taxes and insurance),
such sum to be paid by DTC on or before the date this Agreement
is to become effective. Additionally, along with the lump sum
payment, a deposit of $30,000 shall be made by DTC for the
purpose of covering the costs incurred by the Utility in the
installation of telemetry equipment required for the operation of the
pump station. To the extent the deposit is not sufficient to cover all
such costs, the balance outstanding will be billed to DTC, and, by
the same token, any surplus of deposit money over and above the
costs incurred by the Utility in installing the telemetry equipment
shall be refunded to DTC. DTC shall pay any balance due
hereunder within 30 days after receipt of such statement from the
Utility.
4. Discontinuance. The Utility reserves the right to discontinue its
obligations hereunder at any time, without notice, until payments required
hereunder have been made as agreed.

5. Miscellaneous. Execution of this Agreement by the Utility and
DTC constitutes a stipulation by the parties to the following facts:
A. Unless prohibited by any agreement involved in the financing of the
construction of the pump station facilities, DTC shall transfer title to the
pump station and underlying interest in the real estate to the Utility by
execution of the necessary documents, including full ownership and
control of the pump station, and the services provided, concurrently
herewith.
B. Sewer mains, six inches in diameter or larger, located in streets'
rights -of -way, or legitimate easements within the boundaries of the
Wildwood Place neighborhood, are public sewers operated and
maintained by the Utility and the sewer service is made available only in
accordance with the current ordinances, rules, and regulations of the
Utility.
C. This Agreement shall be binding on the successors and assigns of
both DTC and the Utility.
6. Term. This Agreement shall become effective as of the date stated
above and shall continue in full force and effect for all times thereafter.

I appreciate you and your staff taking the time to meet with me last Thursday. The
meeting clarified some of Pulaski Academy's concerns with regards to the above referenced
application (the "Application"). As we discussed, Pulaski Academy's concern with the
Application pertained to Comment 11 of the Public Works Conditions stating the following:
At this time, boundary street improvements are required to be constructed on
Denny Road for the portion of property still owned by Pulaski Academy and not a
part of the preliminary plat in conformance with previous approvals.
As noted earlier, a plain reading of this comment seems to indicate approval of the
Application would immediately necessitate some requirement on behalf of Pulaski Academy.
However, my understanding after our discussion was the City did not intend any immediate
action by Pulaski Academy respecting the boundary street improvements and recognized the
conditional use permit only requires such boundary street improvements when traffic at the
entrance drive reaches 800 vehicles a day.
While we understand the City's inclusion of the comment in order to inform the Planning
Commission, we feel the need to ensure the Planning Commission understands the clarification
as discussed at our meeting. As such, we request a simple statement be read into the record at
the Planning Commission meeting on February 2, 2017 or the staff comments be revised to
reflect nothing in the Application is intended to activate or accelerate any requirement of Pulaski
Academy regarding the boundary street improvements. Please let me know if you or your staff
would be willing to read such a statement or revise the comments in order to resolve any
confusion.

We respectfully submit this letter in opposition to the above referenced
application (the "Application") to the extent it would necessitate any amendment or
accelerate or activate any condition under the existing conditional use permit of
Pulaski Academy as approved July 26, 2001 (File No. Z-6520-A which is attached
hereto as Exhibit A). Comment 11 of the Public Works Conditions of staffs
comments to the Application (attached hereto as Exhibit B) states:
At this time, boundary street improvements are required to be
constructed on Denny Road for the portion of property still owned by
Pulaski Academy and not a part of the preliminary plat in
conformance with previous approvals.
It is our understanding and contention any requirement to make such
boundary street improvements pursuant to Pulaski Academy's conditional use
permit are not yet required and should not be required by approval of the
Application. Under Pulaski Academy's conditional use permit, turn lanes and tapers
on Denny Road are not required until traffic at either entrance drive reaches 800
vehicles per day at the points indicated on the master plan. To our knowledge, no
study has been completed which indicates such, and our estimate of such traffic
would only reach a high of approximately 200 vehicles per day. Further, any other
street improvements required pursuant to the conditional use permit would only be
required once the master plan has been fully implemented. To date, the master plan
has not been fully implemented and the approval of the Application would not
necessitate full implementation of the Master Plan. Any contention of the City such
boundary street improvements are required at this time contradicts the City's
previous stance as other improvements pursuant to the Master Plan were
completed.

As noted above, we do not oppose the Application in and of itself. Rather, we
oppose the Application only if approval impacts Pulaski Academy's conditional use

amendment to its conditional use permit.

This correspondence will confirm the action taken by the Little Rock Water Reclamation
Commission ("LRWRC") on February 15, 2017 regarding the variance request made by your client,
Graham Smith, for the Wildwood Trails Development. The LRWRC granted the variance request
with the following stipulations:
1. The variance is specific to the 40 acres presented as the Wildwood Trails Development
consisting of 124 residential lots.
2. The developer will pay a zero -capacity fee per lot which must be paid prior to the start of
construction for each phase of development.
3. The developer will pay estimated costs, as prepared by LRW staff, for the required
capacity upgrades to the pump station and gravity sewer system to the start of
construction for the first phase of development.
The Zero Capacity Fee is $117.61 per lot, and must be paid for all lots in each phase at the time that
LRW's standard Approval Letter is returned to LRW, prior to commencing construction of that
phase. Furthermore, the Collection System Upgrade Costs of $85,640 must be paid in full at the time
that LRW's standard Approval Letter is signed and returned to LRW, prior to commencing
construction of Phase 1. If you have any questions concerning this matter, please do not hesitate to

Sewer Connection Fees
Dear Mr. Hotho,
Thomas Engineering has been retained to provide the engineering services for a future
residential subdivision on Denny Road. The owner and developer of the subdivision is Graham
Smith. The location of the proposed subdivision is shown in Figure 1. The preliminary layout for
the subdivision shows approximately 110 lots at full buildout. It is anticipated the proposed
development will be created in phases with Phase 1 providing approximately 72 lots. This letter
is to provide Little Rock Wastewater and understanding of the project, present the proposed
sewer connection to the Little Rock Wastewater's collection system, and to request Little Rock
Wastewater to review the required fees for servicing the proposed subdivision.
Sewer Flow
Using the standards for residential sewer flows the full build -out flow for the proposed
subdivision will be as follows:

Sewer Connection
The proposed subdivision will have sewer service provided by gravity sewer per LRW standard
specifications and details. The final routing of the sewer will be developed with the final
construction plans for the subdivision. At this time it is expected the sewer will be collected at
the front of the property along Denny Road. The gravity sewer will be extended northwest from
the proposed development along the Denny Road Right of Way to an existing LRW 8-inch PVC
gravity line that leads to an existing pump station. The proposed gravity sewer and existing
sewer are shown in Figure 1.

Pump Station
The existing pump station is designed to provide 250 gpm @ 125-ft Total Dynamic Head (TDH).
The pump station pumps through 3943 LF of 6" PVC to its discharge point east of the pump
station. From previous meetings with LRW it was determined this pump station was sized to
provide service for a separate development without additional capacity. Phase 1 of the separate
development has been constructed which consists of approximately 65 lots. The remaining
timing for the full buildout of the separate development is unknown.
An analysis of the existing pump station was performed to determine the required upgrades of
the pump station for both subdivisions at full buildout. The pump station hydraulics were
calculated and an updated system curve was developed for the pump station and the force
main. The new design flow for the pump station will be the existing flow (250 gpm) plus the full
build -out flow for the proposed subdivision (110 gpm), 360 gpm total flow. Based upon the
system curve the new design point for the pump station will be 360 gpm at 193-ft TDH.
A preliminary pump was selected based upon the new design point. The selected pump is a
Fairbanks Morse 4", 60 HP submersible pump. The pump data sheet is attached. Instrument
and Supply (ISI) provided a cost for the pumps, $26,000 each. Also, ISI reviewed the pump
station electrical system and determined the larger pumps would require the existing motor
starters and breakers to be replaced. The estimated cost for the electrical upgrade as provided
by ISI is $7,000. Additionally, the base elbows for the pumps will need to be replaced, estimated
cost $2,500 each. The anticipated the total pump station upgrade cost to provide service for the
proposed subdivision is shown in Table 1.

Sewer Connection Fees
The developer understands it is their responsibility to provide and pay for the gravity sanitary
sewer collection system for the proposed development to the connection point of the existing
LRW collection system. Additionally, the developer is willing to pay for a portion of the pump
station upgrades. In this case, for full buildout the new development will only use a portion of the
total pump station capacity, 110 gpm of a total 360 gpm capacity. The developer is proposing to
split the pump station upgrade cost based upon the usage capacity ratio; 110/360 (gpm).
At this time it is not necessary to upgrade the pump station. As previously mentioned, the pump
station is currently serving 65 lots. Our developer's proposed Phase 1 is approximately 72 lots.
Therefore, the necessary capacity of the existing development and Phase 1 of the new
development is 137 gpm. The current pump station's 250 gpm capacity is more than adequate

to provide service for these developments. Once these developments reach a combined sewer
service need of greater than 250 gpm then the pump station should be upgraded. However, the
timing for the pump station upgrade needs are unknown and could be past the useful life of the
current pumps. For this reason our developer is proposing to split the pump station upgrade
cost based upon the usage capacity ratio, 110/360, for a total pump station sewer connection
fee of $22,488. Our developer is willing to pay this amount for the sewer connection fee during
Phase 1 so no additional pump station upgrade costs will be accessed for future phases of this
development.
We are requesting you review this information and let us know if you concur with the proposed
sewer connection fees for our client's new development. Our client is requesting these fees be
developed during the preliminary analysis so their financing can cover the full development
costs. Once final construction plans have been developed for Phase 1 we will submit to you for
your review along with the agreed upon sewer connection fees.

control device. They prefer the device to be either a speed hump or a pedestrian table and to be located between lots

Sewer Service Plan
Dear Mr. Pownall:
Little Rock Wastewater has reviewed your letter regarding the referenced
development proposal (copy attached), and our comments are as follows:
Sewer Flow: Your volume calculation is adequate.
Sewer Connection: In general your proposed method of providing sewer service to the
proposed development is acceptable. Easements in favor of the City of Little Rock, for
the use and benefit of the Little Rock Water Reclamation Commission will be required
for all sewer mains, both on -site and off -site. Easement acquisition shall be the
developer's responsibility. Right -of -Way permit(s) shall also be the responsibility of
the developer. The composite development should be submitted to LRW for approval
in the normal manner for a Developer -Funded project, with appropriate review fees
and all supporting documents.
Pump Station: The proposed development may be connected via gravity lines to the
existing Denny Road Pump Station, with some conditions. Since the existing pump
station was designed and constructed by others to provide sewer service for the full
buildout of their property, it must be assumed that there is zero available excess
capacity in the pump station. Therefore an upgrade of the pumping capacity of the
station is required for any other property or development to be connected, and the
developer of that property must pay the entire cost of the pump station upgrades. We
have reviewed your proposal for a cost share with LRW for the upgrades, and we find
no public need for LRW to participate in said costs. Instead of the developer
contracting to have the upgrade work done immediately, he should make a non-
refundable payment to LRW in the amount of the full estimated cost of the required
pump station improvements as stated in attached letter, or $73,600.00. LRW will then
use this money when needed in the future to make the required upgrades to the Denny
Road Pump Station.
Zero Capacity Charges: The proposed development would be served by the pump
station which conveys the sewage flow to a different subbasin, and therefore a Zero
Capacity Charge of $117.61 per lot must be paid prior to construction of each phase of

the proposed development. If preferred, this charge can be paid all on the front end
for the entire development, for a total of $117.61 per lot x 110 lots = $12,937.10.
Sewer Connection Fees: A Service Connection Permit will be required for each new
building connection, at the time of connection to the LRW System, which will require
payment of the Connection and Inspection Fees in effect at the time of connection,
which as of this writing are $70.00 and $125.00, respectively.
