BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS.
Section 1. That the zoning classification of the following described property be changed from 0-3,
General Office District, to PD-C, Planned Development - Commercial:
Z-9162: Part of the Northwest Quarter Northwest Quarter of Section 10, Township
1 North, Range 13 West, Little Rock, Pulaski County, Arkansas, more particularly
described as: Commencing at the northwest corner of said Northwest Quarter
Northwest Quarter; thence South 88 degrees 08 minutes 06 seconds East along the
north line of said Northwest Quarter 454.60 feet to a point on the south right-of-way
of Kanis Road and the point of beginning; thence South 83 degrees 13 minutes 59
seconds East along said south right-of-way line, 190.80 feet; thence South 01 degrees
43 minutes 09 seconds West 253.30 feet; thence North 88 degrees
08 minutes 06 seconds West, 193.0 feet; thence North 02 degrees
20 minutes 37 seconds East, 269.61 feet to the point of beginning containing 50,086

time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances,
Section 4. That this ordinance shall not take effect and be in full force until the final plan approval.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary
to affect and designate the change provided for in Section 1 hereof.

Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
the provisions of this ordinance are hereby repeated to the extent of such inconsistency.

The request is a rezoning of the site from 0-3, General
Office District to PD-C, Planned Development
Commercial, to allow the construction of a restaurant on
the site.

Staff recommends approval of the requested PD-C zoning.
The Planning Commission voted to recommend approval
of the PD-C zoning by a vote of 10 ayes, 0 noes, 0 absent
and 1 open position.
The applicant is proposing a rezoning of the site from 0-3,
General Office District to PD-C, Planned Development
Commercial to allow the placement of a Zaxby's
Restaurant, with an order menu board and pick-up window
on the site. The plan indicates a single drive from
Kaufman Road and a right-in/right-out only drive on Kanis
Road.
BACKGROUND
CONTINUED
The site plan indicates the hours of operation are
seven (7) days per week from 10:30 am to 10:00 pm. The
dumpster is located along the southern perimeter of the site
and is proposed to be fully screened per Section 36-523 of
the Little Rock Code of Ordinances. The hours of
dumpster service will be limited to 7 am to 6 pm Monday
through Friday.
The Planning Commission reviewed the proposed PD-C
request at its September 22, 2016, meeting and there were
no registered objectors present. All property owners
located within 200-feet of the site along with the John
Barrow Neighborhood Association were notified of the
Public Hearing. Please see the attached Planning
Commission minute record and site plan for the applicant's
specific development proposal and the staff analysis and
recommendation.

Dear Ms. James,
Please find attached 3 copies of the latest survey and 18 copies of the Site Plan for the
above referenced project along with a review fee check in the amount of $230.00. As you
know, this is a proposed Zaxby's restaurant located at the southwest corner of Kanis and
Kaufman Roads adjacent and east of Panera Bread. This project will include street
improvement to Kaufman Road including a turn lane. Along with these documents we are
requesting a zoning change from the current 0-3 office zoning to PCD allowing restaurant
use.
The current property is not platted and will be proposed at a later date, a bill of assurance
will be included.
We believe this restaurant will be a welcome addition to this area.

Staff has reviewed the latest attached proposed site plan for the Zaxby's. Both site plans w"II require variances for the
driveways. Staff would prefer only 1 driveway on Kaufman Road as far from the Kanis Rd intersection as possible to
comply with City driveway spacing codes. Since you have stated 2 driveways are needed, Public Works can recommend
approval of a variance for a right in/right out driveway on Kanis Road as shown on the previous plan. The configuration
of the driveway can be designed to deter left turn movements. Staff cannot recommend approval of a variance For the 2
driveways on Kaufman Road. The northern driveway is too close to the intersection and would create similar problems
to those that occur at the McDonaIds at Rodney Parham Rd and Breckinridge Drive.

effect at the time of request for water service
must be met.
The Little Rock Fire Department needs to
evaluate this site to determine whether
additional public and/or private fire hydrant(s)
will be required. If additional fire hydrant(s)
are required, they will be installed at the
Developer's expense.
Please submit plans for water facilities
and/or fire protection system to Central
Arkansas Water for review. Plan revisions
may be required after additional review.
Contact Central Arkansas Water regarding
procedures for installation of water facilities
and/or fire service. Approval of plans by the
Arkansas Department of Health Engineering
Division and Little Rock Fire Department is
required.
A Capital Investment Charge based on the
size of meter connection(s) will apply to this
project in addition to normal charges. This
fee will apply to all connections including
metered connections off the private fire

If there are facilities that need to be adjusted
and/or relocated, contact Central Arkansas

A land use buffer six (6) percent of the average width / depth of the lot will be required
when an adjacent property has a dissimilar use of a more restrictive nature. The
properties to south, and east are zoned R-2 the property to the west is zoned OS. As a
component of all land use buffer requirements, opaque screening, whether a fence or
other device, a minimum of six (6) feet in height shall be required upon the property line
side of the buffer. The plantings, existing and purposed, shall be provided within the
landscape ordinance of the city, section 15-81.
A perimeter planting strip is required along any side of a vehicular use area that abuts
adjoining property or the right-of-way of any street. One (1) tree and three (3) shrubs or

Building landscape areas shall be provided at the rate equivalent to planter strip three (3)
feet wide along the vehicular use area. One (1) tree and four (4) shrubs shall be planted in

exceeding ten (10) percent of the existing gross floor area. At such time ten (10) percent
of the existing vehicular use area shall be brought into compliance with this chapter and
shall continue to full compliance on a graduated scale.
If building rehabilitation exceeds fifty percent (50%) of the replacement cost then the

A land use buffer six (6) percent of the average width / depth of the lot will be required
when an adjacent property has a dissimilar use of a more restrictive nature. The property
to the east is zoned R-2. As a component of all land use buffer requirements, opaque
screening, whether a fence or other device, a minimum of six (6) feet in height shall be
required upon the property line side of the buffer. The plantings, existing and purposed,
shall be provided within the landscape ordinance of the city, section 15-81.
Street buffers will be required at six (6) percent of the average depth of the lot. The

a) Location is not currently served by METRO but is on our long range plans. One concern
with the design plan presented is no pedestrian access through the main gate to the
street. Sidewalks should be maintained along the entire street front of the
development. We also feel the dedicated right hand turn lane and merge lane are
unnecessary for this location. The roadway is two wide lanes, traffic low volume.
Excessively wide intersections prohibit pedestrian movement, bicycle infrastructure
and transit operations. Preinstalling curb cuts for speculative development seems an
unnecessary expense and provides more barriers for pedestrian infrastructure. We
suggest these alterations be incorporated into the plans which will provide for future
multi -modal opportunities to residents.
2) Z-6488-A KLR Properties PCD 3.2400 Cantrell Road
a) Location is currently served by METRO on Route 25 Pinnacle Mountain. We have no
objection to planned zoning change. Provide pedestrian access from the transit route in
