12 SECTION 1. That the zoning classification of the following described property be changed from C-

16 SECTION 2. That the preliminary site development plan/plat be approved as recommended by the
17 Little Rock Planning Commission.
18 SECTION 3. That the change in zoning classification contemplated for PB General Holdings, Short-
19 Form PD ,C (Z-9039), located at 2504 Ferndale Cut -Off, is conditioned upon obtaining a final plan approval
20 within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances.
21 SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
22 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
23 necessary to affect and designate the change provided for in Section I hereof.
24 SECTION 5. That this ordinance shall not take effect and be in full force until the final approval of
25 the plan.
26 SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
27 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
30 ordinance.
31 SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
32 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is to rezone the site from C-3, General
Commercial District to PCD to allow the construction of
a new retail building containing 9,939 square feet.
None.
Staff recommends approval of the requested PD-C
zoning. The Planning Commission voted to recommend
approval of the PD-C zoning by a vote of 8 ayes, 0 noes
and 3 absent.
The Planning Commission reviewed the proposed PD-C
request at its June 4, 2015, meeting and there were no
registered objectors present. All property owners located
within 200-feet of the site were notified of the Public
Hearing. There is not an active neighborhood association
located in this area.
BACKGROUND
Ordinance No. 18,779 adopted by the Little Rock Board
of Directors on November 19, 2002, zoned the site to
C-3, General Commercial District as a part of the City
expanding their zoning jurisdiction to this area through
Extraterritorial Planning. The ownership of the property
included tracts that were located outside the
extraterritorial planning jurisdictional area, and only
tracts that were within jurisdictional area were zoned.
Uses listed by the applicant included grocery store,
convenience store with gas pumps, video rental, deli
sandwiches, tobacco sales, and a three (3) bay carwash.
All the uses proposed were permitted uses in C-3,
General Commercial Zoning District but the carwash
required a CUP (Conditional Use Permit) in the C-3,
General Commercial Zoning District. A CUP was
approved for the site as well.
The current application is a request to rezone the site to
Planned Commercial Development (PCD) to allow the
redevelopment of the site with a retail use. The site
currently consists of two (2) lots located at 2504 Ferndale
Cut-off Road. Lots 1 and 2 of the Ferndale Grocery
Addition are currently zoned C-3, General Commercial
District with a CUP for a carwash. The buildings have
been removed. The applicant is requesting approval of
the two (2) lots being combined into one (1)
approximately 1.74-acre lot and rezoned to a PCD with a
planned use of a single commercial/retail structure.
The proposed site plan has been designed with one access
drive from Kanis Road and one from Ferndale Cut-off
Road. The building is designed with the HVAC units on
top of the building with screening. The dumpster area will
be screened with wood fencing and is located near the
rear of the property. The dumpster hours of pick-up will
be limited to store hours. The site plan indicates
landscape buffers around the south and southeast property
lines.

Ms. James,
Please accept this letter to serve as our application for the above referenced submittal. We wish for this
application to be reviewed and accepted by the Planning Department and placed on the June 4, 2015 Planning
Commission Meeting Agenda.
The site currently consists of two lots located at 2504 Ferndale Cut Off Road. Lots 1 and 2 are currently zoned
CUP (with an C-3 underlying zoning) and is in the Ferndale Grocery Addition. We have been unable to locate an
existing Bill of Assurance for the property. One lot is currently vacant and one is being used as a car wash. We
are requesting approval of the two lots being combined into one approximately 1.7 acre lot and rezoned to a
PCD with a planned use of a single commercial/retail structure, as well as to allow for a variance of the rear
setback line from 15' to a 10' rear setback as shown on the attached site plan.
The current City of Little Rock "Future Land Use" map shows our property is in an area planned for Commercial
Use. Approval of this application to rezone will allow our client to develop this approximately 1.7 acre lot into a
9,100 sq. ft. general merchandise retail store. The area currently consists of a wide range of zoning, such as
Commercial (PCD), Double Tree Veterinary Clinic (2606 Ferndale Cut Off Road), Residential (R-2), the vacant
tract that is northwest of our site, as well as Park and Open Space zoning. The approval of this development
and rezone application will allow for more economic growth for the city, as well as, serve the community.
Our proposed site plan has been designed with one access drive being on Kanis Road and one on Ferndale Cut
Off Road. The building is designed with the HVAC unit on top of the building with screening. We have screened
in the dumpster area with wood fencing and placed it near the back of the property. The dumpster pickup hours
will be limited to store hours. This site plan shows landscape buffers around the south and southeast property
lines. With the above in mind, in addition to the site being located on Minor and Principal Arterial Streets, it is our
opinion that this area lends itself for this type of development and would be a good addition for the city and the
neighborhood. We have enclosed (18) copies of the proposed development site plan.

I, Ronald J. Wheeler — Fire Chief, have been made aware of the proposal to build a Dollar
General store at the intersection of K.anis and Ferndale Gut -Off Roads,
The West Pulaski Fire Protection District #23 provides fire protection service to the
Ferndale area. There is no water system in the Ferndale area and water will have to be
provided by a well. Because of this no fire hydrant will be available and the fire
department will rely on water shuttle operations in case of a fire to this commercial
structure. When I inquired about a sprinkler system from the developer called and left a
message the property was too small to require a sprinkler system. With that said, I highly
recommend a fire alarm system in order for a fast response to a call.

located on a fire apparatus access road, the minimum road width shall be 26 feet, exclusive of

Gates

roads shall comply with all of the following criteria:
1. Minimum gate width shall be 20 feet.
2. Gates shall be of swinging or sliding type.
3. Construction of gates shall be of material that allow manual operation by one person.
4. Gate components shall be maintained in an operable condition at all times and replaces or
repaired when defective.
5. Electric gates shall be equipped with a means of opening the gate by fire department personnel
for emergency access. Emergency opening devices shall be approved by the fire code official.
6. Manual opening gates shall not be locked with a padlock or chain and padlock unless they are
capable of being opened by means of forcible entry tools or when a key box containing the keys
to the lock is installed at the gate location.
7. Locking device specifications shall be submitted for approval \by the fire code official
8. Electric gate operators, where provided, shall be listed in accordance with UL 325.
9. Gates, intended for automatic operation shall be designed, constructed and installed to comply
with requirements of ASTM F 2200.
One- or Two-Familv Residential Developments.
As per Appendix D, Section D107.1 of the Arkansas Fire Prevention Code Vol. 1, One- or Two -Family
dwelling residential developments. Developments of one- or two-family dwellings where the number of
dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access
roads, and shall meet the requirements of Section D104.3.
Exceptions:
Where there are more than 30 dwelling units on a single public or private fire apparatus
access road and al dwelling units are equipped throughout with an approved automatic
sprinkler system in accordance with Section 903.3.1.1, 903.3.1.2 or 903.3.1.3 of the
Arkansas Fire Code, access from two directions shall not be required.
2. The number of dwelling units on a single fire apparatus access road shall not be increased
unless fire apparatus access roads will connect with future development, as determined by
the fire code official.

of 150 feet shall be provided with width and turnaround provisions in accordance with Table D103.4.

There are going to be over 30 houses and code requires two separate access roads, need to
connect the roads inside the housing development.
