3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 AMEND THE ASSIGNMENT AND ASSUMPTON AGREEMENT
5 (ANTENNA LEASES) AND TO ACCEPT TRANSFER OF RESERVOIR
6 PARK PROPERTY FROM CENTRAL ARKANSAS WATER; AND FOR
7 OTHER PURPOSES.
9 WHEREAS, the City of Little Rock, Arkansas (the "City ") and Central Arkansas
10 Water ( "CAW ") and other parties previously entered into an Assignment and
11 Assumption Agreement (Antenna Leases) dated June 30, 2001; and
12 WHEREAS, the City and CAW desire to amend the Antenna Lease Agreement to
13 change the current allocation of revenue; and
14 WHEREAS, the City and CAW believe this new allocation will create a more
15 equitable distribution to managing and maintaining cellular antennas on CAW
16 properties, and
17 WHEREAS, this City has a desire to obtain ownership of park property below
18 Jackson Reservoir in Reservoir Park to expand potential programs and park facilities.
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
20 OF THE CITY OF LITTLE ROCK:
21 Section 1. The City Manager is authorized to amend the Assignment and
22 Assumption Agreement (Antenna Lease).
23 Section 2. Under the new agreement, Central Arkansas Water will continue
24 paying the City of Little Rock eighty -five (85 %) percent of the gross rent on antennas
25 placed on CAW properties under the existing Antenna Lease Agreement and fifty (50 %)
26 percent of the gross rent on antennas placed on CAW properties under the Amended
27 Antenna Lease Agreement.

I Section 3. The City Manager is authorized to accept the land adjacent to Jackson
2 Reservoir in Reservoir Park as an addition to the Reservoir Park Master Plan.
