HomeMy WebLinkAbout22430 1 ORDINANCE NO. 22,430 2 3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE 4 TO BID; TO AUTHORIZE THE CITY MANAGER TO EXTEND THE 5 EXISTING CONTRACT WITH WASTE MANAGEMENT OF ARKANSAS, 6 TO PROVIDE RESIDENTIAL CURBSIDE RECYCLING SERVICES 7 WITHIN THE CORPORATE LIMITS OF THE CITY OF LITTLE ROCK, 8 ARKANSAS, FOR AN ADDITIONAL THREE (3) YEARS ON THE 9 CONTRACT UNTIL MARCH 31,2027; TO DECLARE AN EMERGENCY; 10 AND FOR OTHER PURPOSES. 11 12 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 8,666 (March 3, 1992),the City of 13 Little Rock, Arkansas ("the City"), stated its intent to become a part of the Pulaski County Regional 14 Solid Waste Management District("PCRSWMD");and, 15 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 9,341 (March 7, 1995), the City 16 and PCRSWMD entered into a Curbside Recycling Agreement with Waste Management of Arkansas 17 ("Waste Management"); and, 18 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 11,497 (April 15, 2003), the City 19 agreed with PCRSWMD to extend the Recycling Agreement with Waste Management to provide 20 Residential Curbside Recycling Services;and, 21 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 13,124 (May 4,2010), this Recycling 22 Agreement with Waste Management was extended; and, 23 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 13,512 (June 5, 2012), this 24 Recycling Agreement was extended again for a period of seven (7)years until April 1,2019; and, 25 WHEREAS, pursuant to Little Rock Ark., Ordinance No. 21,635 (October 1, 2018), this 26 Recycling Agreement with Waste Management was extended,and, 27 WHEREAS, pursuant to Little Rock Ark.,Ordinance No.21,891 (July 21,2020), this Recycling 28 Agreement with Waste Management was extended,and, 29 WHEREAS,after careful consideration and negotiation between PCRSWMD and Waste Management, 30 it has been determined that with modifications to the existing contract between now and April 1, 31 2024,and an extension of this contract is necessary for curbside recycling to continue;and, 32 WHEREAS, the parties mutually desire to extend contract and maintain service throughgh March 33 31, 2027;and, 34 (Page 1 of 31 1 WHEREAS, the parties mutually desire to include glass and additional plastic materials as identified 2 in contract: and, 3 WHEREAS, under these unforeseen emergency circumstances it is impractical and unfeasible 4 to submit this agreement to formal competitive bids. 5 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 6 OF LITTLE ROCK,ARKANSAS: 7 Section 1. It is impractical and unfeasible to submit a contract for Curbside Recycling Services 8 to a formal competitive selection process in conjunction with the Pulaski County Regional Solid Waste 9 Management District. 10 Section 2. The Board of Directors authorizes the City Manager to enter into an extension of 11 the existing Curbside Recycling Contract with Waste Management through March 31, 2027, to 12 provide Curbside Recycling for approximately 61,000 solid waste customers, at a cost of: 13 (a) Five and 99/100 Dollars ($5.99) per month per residential customer for April 1, 2024, 14 through March 31, 2025; and, 15 (b) Six and 31/100 ($6.31) per month per residential customer for April 1,2025,through March 16 31,2026; and, 17 (c) Six and 64/100 ($6.64) per month per residential customer for April I, 2026, through March 18 31,2027. 19 Section 3. Funding for the project is allocated in the Solid Waste Collections Contracts Account 20 No.603110-63390. 21 Section 4. Severability. In the event any title,section, paragraph, item, sentence, clause, phrase, 22 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration 23 or adjudication shall not affect the remaining portions of the ordinance, which shall remain in full 24 force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally 25 a part of the resolution. 26 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are 27 inconsistent with the provisions of this ordinance, are hereby repealed to the extent of such 28 inconsistency including, but not limited to, Little Rock, Ark., Resolution No. 8,666 (March 3, 1992), 29 Little Rock, Ark., Resolution No. 9,341 (March 7, 1 995), Little Rock, Ark., Resolution No. 11,497 30 (April 15, 2003), Little Rock, Ark., Resolution No. 13,124 (May 4, 2010), Little Rock, Ark., 31 Resolution No. 13,512(June 5,2012), Little Rock Ark., Ordinance No. 21,635 (October 1,2018),and 32 Little Rock Ark., Ordinance No. 21,891 (July 21, 2020), 33 Section 6. Emergency Clause.
