Planning Staff Comments:
1. The 1905 Bill of Assurance/Plat for Jones and Worthen's Addition does not address use issues.
2. Provide signage plan.
3. Provide details on types, height and location of all fencing.
4. Indicate playground area.
5. Provide parking and drop-off for seven vehicles (one per employee and one for every ten (10) children).
6. What will the detached garage building be used for?
7. Any site lighting is to be low-level and directional, aimed downward and into the site.
8. All vehicular use areas are to be paved and landscaped to comply with code standards.
9. Conversion of this structure into a commercial day care center must comply with all applicable building
codes and fire codes.
10. Pay filing fee of $205.00.

Public Works:
1. Due to the proposed use of the property, the Master Street Plan specifies that Brown Street for the frontage
of this property must meet commercial street standards. Dedicate right-of-way to thirty (30) feet from
centerline.
2. The existing driveway is gravel. The driveway apron should be constructed of concrete from the back of
curb to the new property line.
3. From the existing site conditions, children are proposed to be dropped off in the street which will increase
the traffic volumes, cause vehicles to stop in the street, and create possible unsafe conditions.
Utilities and Fire Department/County Planning_
Wastewater: Sewer available to this project.
Entergy: Approved as submitted. Entergy has no issue with the use of this house for a day care. Service wires
appear to be in the back of the house. Care should be used when installing the fence.
Centerpoint Energy: No comment received.
AT&T (SBC): No comment received.
Water: All Central Arkansas Water requirements in effect at the time of request for water service must be met.
If there are facilities that need to be adjusted and/or relocated, contact Central Arkansas Water. That work would
be done at the expense of the developer.
Contact Central Arkansas Water if additional fire protection or metered water service is required.
Contact Central Arkansas Water regarding the size and location of the water meter.
Due to the nature of this facility, installation of an approved reduced pressure zone backflow preventer assembly
(RPZ) is required on the domestic water service. This assembly must be installed prior to the first point of use.

Central Arkansas Water (CAW) requires that upon installation of the RPZA, successful tests of the assembly must
be completed by a Certified Assembly Tester licensed by the State of Arkansas and approved by CAW. The test
results must be sent to CAW's Cross Connection Section within ten days of installation and annually thereafter.
Contact the Cross Connection Section at 377-1226 if you would like to discuss backflow prevention requirements
for this project.
Fire Department: Approved as submitted. Place Fire hydrants per Code and maintain access. Install, as required,
sprinkler system and Fire alarm.
Building Codes Comment: Project is a change in occupancy and is therefore subject to current building code
requirements. Review and approval is required by Building Codes Division before occupancy takes place.

CATA: The nearest CATA bus route is located along 121h Street, two blocks to the South.
Planning Division: No Comments.
Landscape: Site plan must comply with the City's minimal landscape and buffer ordinance requirements.
A land use buffer will be required when an adjacent property has a dissimilar use of a more restrictive nature. As a
component of all land use buffer requirements, opaque screening, whether a fence or other device, a minimum of
six (6) feet in height shall be required upon the property line side of the buffer. A minimum of seventy (70) percent
of the land use buffer shall be undisturbed. Easements cannot count toward fulfilling this requirement. The
plantings, existing and purposed, shall be provided within the Landscape Ordinance of the City, Section 15-81.
The property to the north, south, and east are zoned R-3, therefore, a minimum nine (9) foot wide buffer is required
along these property lines.
The property is located in the City's designated mature area. A twenty-five (25) percent reduction of the buffer
requirements is acceptable.
Required off street parking for nursery and day care center will require, 1.0 space per administrator, teacher and
employee on the largest shift plus 1.0 space per facility vehicle plus 1.0 space per 10.0 persons of licensed capacity.
The City Beautiful Commission recommends preserving as many existing trees as feasible on this site. Credit
toward fulfilling Landscape Ordinance requirements can be given when preserving trees of six (6) inch caliper or
larger.
Other: Submit responses to staff issues and four (4) copies of a revised site plan (if required) no later than
Wednesday April 16, 2014. Required notices are to be sent via certified mail to all owners of properties located
within two hundred (200) feet of the site no later than Wednesday April 16, 2014. The City -provided notice form
must be used. Proof of notice is to be provided to staff no later than April 25, 2014.

STAFF UPDATE AND RECOMMENDATION:
On April 8, 2014, the applicant requested withdrawal of this application. Staff
recommends approval of the withdrawal request.
PLANNING COMMISSION ACTION:
(MAY 1, 2014)
The applicant was not present. Staff informed the commission of the applicant's
withdrawal request. There was no further discussion. The item was placed on
the consent agenda and approved for withdrawal by a vote of 10 ayes, 0 noes
and 1 absent.
