BACKGROUND: On June 5, 2001, the Board of Directors passed Ordinance No. 18,495 rezoning the property from C-3 and R-2 to PCD to allow boat sales and display along with C-3 permitted uses on the site. As a part of the process the applicant was informed to remain covered by the City's National Flood Insurance Program the applicant was to flood proof the new building, which was constructed on the eastern portion of the site. There is a second building (east of the existing building), which was recently constructed for boat storage. The commercial building contains a boat sales and display business and a church. The third area, on the west end of the building, is currently vacant. There is a mixture of commercial uses along I-30 to the east and west and across I-30 to the north (the Expo Center). A vacant office building is directly adjacent to this site on the west. There is a creek within the southern portion of the property, with the Optimist Club Park (race track) and a truck service business further south. C. Staff briefly described the revised PCD, noting the revision was to add the motorcycle sales and service to the previously approved PCD. Staff noted there were modifications needed on the site plan for the current development. Staff questioned if there was to be any outside storage. Mr. White stated there was not. Staff also asked if the shipment of motorcycles would be in crates. Mr. White stated they would not be in crates. Each bike was custom built and the merchandise was not crated when shipped stated Mr. White. Staff then asked where delivery of the motorcycles would take place. Mr. White stated the motorcycles were shipped in a box van and delivery in the parking lot or behind the building was not a problem. Tad Borkowski, Public Works Staff, stated this property is located in the floodway and usually the city does not allow development in the floodway. This property was "grand - fathered" when the area was annexed. Mr. Borkowski stated, the applicant was to floodproof the new building and any renovations, which took place on the property, were to be with flood protection in mind. Mr. Green stated all electrical and the heat and air had been raised to the four -foot level during the current renovation. The inventory would also be stored at a level above the four -foot height, which was previously indicated sufficient by FEMA. Mr. Borkowski stated, FEMA had paid some $375,000 in flood damage claims on the building over the previous 11 years. He stated the city could elect to not allow the building flood insurance if Mr. Green did not comply with the flood proofing requirements. January 3, J02 SUBDIVISION ITEM NO.: 5 (Cont.) ANALYSIS: As noted in Public Works Comments (paragraph D) and in the Subdivision Committee Comments (paragraph G), the property at 12825 I-30 is located in the floodway. As a condition of the previously approved PCD the applicant was to floodproof the new building to remain in NFIP. If the applicant did not comply with this condition the city would submit forms to FEMA to remove the structure from the program. The "new building" is a detached building from the main structure and to staff's knowledge this condition has not been met. The applicant is in the process of remodeling a suite in the main structure and as a condition of issuing the renovation building permit the applicant was to raise all electrical to four -feet above the floor level. The applicant has met this condition. To staff's knowledge there are no outstanding issues associated with this proposed rezoning request. The use of the suite for motorcycle sales and service (no outside storage or display) should have no adverse impact on the surrounding properties. I. STAFF RECOMMENDATIONS: Staff recommends approval of the revised PCD subject to the following conditions: 1. Meet the requirements of the previously approved PCD. 2. Compliance with the requirements as noted in paragraphs D and E of this report. 3. There is to be no outside storage or display of merchandise. 4. Deliveries are to be made within the confines of the property. PLANNING COMMISSION ACTION: (JANUARY 3, 2002) Mr. Alvin Green was present representing the application. There were no objectors present.
