Justification: The applicant's justification is presented in an attached letter. Present Use of Property: Multi -family residential Proposed Use of Property: Multi -family residential STAFF REPORT A. Public Works Issues: No Comments. B. Staff Analysis: The R-2 zoned property at 5813 Baseline Road is occupied by a multi -building multifamily residential development (Colonial Park at Baseline). The main entry drive is from Baseline Road, with a secondary, gated entrance from Dana Lane at the southeast corner of the property. The entire site is fenced with a combination of wood, chain link and wrought iron fencing. There is a fenced, controlled access gate at the main entry drive from Baseline Road. The existing wrought iron fencing near the front (north) property line and along Dana Lane is approximately 6.5 feet in height. The applicant proposes to replace the existing wrought iron fencing along Dana Lane and the Baseline Road frontage with a new eight (8) foot high wrought iron fence. The new taller fence is proposed to address security issues which have recently arisen concerning this multifamily development. A total of approximately 440 linear feet of new wrought iron fencing is proposed, as noted on the attached site plan. A photo example of the new proposed wrought iron fence is provided as an attachment to the applicant's cover letter. The gated controlled entry area will remain along the main entry drive from Baseline Road. SEPTEMBER 30, 2013 M NO.: 2 (CON'T. Section 36-516(e)(1)a. of the City's Zoning Ordinance allows a maximum fence height of six (6) feet for fences in residential zoning, and four (4) feet for fences located between building setback lines and street side property lines. Therefore, the applicant is requesting a variance to allow the sections of new wrought iron fencing along the Baseline Road and Dana Lane frontages with a fence height of eight (8) feet. Staff is supportive of the requested fence height variance. Staff views the request as reasonable. Staff feels that the proposed fence height and placement will aid in the security issues associated with the multifamily development. The proposed fence will be a non -opaque wrought iron fence, similar to the existing fence. There is one (1) single family structure located across Dana Lane from the existing wrought iron fence. The new taller wrought iron fence will have no greater visual impact than does the existing fence. Staff believes the proposed wrought iron fencing with increased height will have no adverse impact on the adjacenl properties or the general area. C. Staff Recommendation: Staff recommends approval of the requested fence height variance, subject to a building permit being obtained for the new fence construction. BOARD OF ADJUSTMENT (September 30, 2013) The applicant was present. There were no objectors present. Staff presented the application with a recommendation of approval. There was no further discussion. Staff added the following condition: ■ The applicant must submit proof of notifications to staff within three (3) days of this hearing date. If the notices are not 100 percent correct, the Board's approval will be automatically nullified and the application automatically deferred to the October 28, 2013 Board of Adjustment agenda. The item was placed on the Consent Agenda for approval as recommended by staff. The vote was 5 ayes, 0 nays and 0 absent. The application was approved
