In the revised plan we are proposing an extension of the lower level parking (under the proposed building) by creating a parking deck with two levels. The lower level of the parking deck will have entrances from the alley and the upper level parking from the Filmore Street. Total green space in the revised plan is slightly larger than the approved plan, however, we had to rearrange the green spaces and the dumpster location. This change will not make any change in the elevation view from Markham or Filmore streets. We hope that a staff level review and approval will be granted, which will expedite the design and construction process of the project. It must remain the individual property owner's responsibility to maintain and operate any and all onsite systems. (The Property Owner's Association could benefit by using a single provider of this service.) 2. Lots in the subdivision have been preliminarily approved for three bedroom homes as required by the Arkansas Department of Health Rules and Regulations Pertaining to Onsite Wastewater. Any homes larger than three bedrooms may require drip dispersal systems as outlined in the Drip Dispersal Rules and Regulations. Potential property owners should be completely aware of the expense of drip dispersal systems or any type of onsite system proposed. 3. Treatment units capable of producing Class 1 quality effluent must be used with any drip dispersal system. It is recommended by the Department that Drip Dispersal Systems when utilized on any lots shall have both primary and secondary areas installed, due to the specialized equipment and relatively inexpensive tubing. 4. All individual lots will have a suitable primary system location and secondary system location marked by orange colored metal posts that must be maintained until the system is installed. 5. Wells drilled for irrigation or geothermal heating and air conditioning may interfere with the proposed primary and secondary areas and they should be limited or properly sited. 6. Driveways and culverts must be located to minimize any damage to primary or secondary areas. Culvert and driveway location should be addressed by the developer on each lot. 7. Excavation and or clearing of these lots have the potential of severely damaging these soils and rendering them useless for onsite systems. Preservation of these sites by geo-location and marked posts must be maintained until installation. 8. The subdivision, due to the preliminary submittal prior to December 1 St has been reviewed under the 2012 Onsite Wastewater Regulation. 9. All lots will require an individual permit and will stand on its own merits for final permit approval. 10. The final approval of this subdivision does not constitute approval for any other aspect of this subdivision except the overall suitability of onsite systems. The Department has determined onsite systems to be the best available option for treatment and renovation of wastewater in this subdivision. Submitted by: Department of Planning and Development Bruce Moore SYNOPSIS The applicant is proposing a revision to the previously approved PD-O to allow the development of a two (2) phase project with the first phase containing a surface parking lot and the second phase containing a three (2) story office building with parking on the lower level. FISCAL IMPACT None. RECOMMENDATION Staff recommends approval of the requested PD-O zoning. The Planning Commission voted to recommend approval of the PD-O zoning by a vote of 10 ayes, 0 noes and 1 absent. CITIZEN The Planning Commission reviewed the proposed PD-O PARTICIPATION request at its December 18, 2014, meeting and there were no registered objectors present. All property owners located within 200-feet of the site along with the Hillcrest Residents Neighborhood Association were notified of the Public Hearing. BACKGROUND Ordinance No. 20,725 adopted by the Little Rock Board of Directors on May 21, 2013, rezoned the property from 0-3, General Office District to Planned Office Development, (POD), to allow the development of the site with a two- story building containing 15,000 square feet of office and retail space. The approval allowed 3,000 square feet of the lower level to be marketed to retail space utilizing the C-1, Neighborhood Commercial Zoning District uses as allowable uses. The approval allowed a maximum of 1,500 square feet of the 3,000 square feet to be used as restaurant space. The remaining area was to be marketed to office users utilizing the 0-3, General Office District uses as allowable uses. The approved site plan included the placement of 29 parking spaces. With the construction of the office building located on the northwest corner of West Markham and Fillmore Streets this site was graveled and used as a "laydown area" for the materials and construction machinery. In addition to storage of materials and equipment the office personnel of the office building used this area for parking during construction of the office building. The office personnel continue to use this site for parking and the property owner has been issued a notice to appear in City Environmental Court to answer as to why the area has not been secured to eliminate the use of the site as a parking lot and to also answer as to why all the construction equipment and materials have not been removed for the site. The applicant is now proposing to revise the previously approved POD to allow the placement of a 12,000 square foot building on the site along with a ground level parking area and a surface parking lot. According to the applicant the topography condition of the site allows the plan to include a ground level parking area under the two (2) story building. Landscaping and/or architectural screening is proposed to visually mask the parking along West Markham Street. The site is located within the Mid -town Design Overlay District, which requires new development to be reviewed through the planned zoning development process. Staff was not original supportive of the applicant's request. The applicant was requesting to continue to use the unpaved parking lot for a period of time. Staff feels if the site is to be used for parking then the applicant should 2 BACKGROUND CONTINUED construct a proper parking lot with paved surfaces and landscaping. The applicant has agreed to construct the parking lot as requested by staff. The paving will begin no later than March 2015. The building construction will be phase 2 of the development and will begin within 18 to 24 months of approval of this PD-O revision. The property is located in the UU urban use district. Street trees a minimum of three-inch caliper will be required. The trees shall be located a minimum of two (2) feet off the back of a curb and shall be thirty (30) feet on center and no closer than thirty (30) feet to a street intersection with a water source provided. The tree canopy shall be maintained at least eight (8) feet above the sidewalk. ■ Street trees are to be provided on South Cross St and 7th Street. Arkansas Spine and Pain Clinic located at 5700 West Markham, Little Rock has been under construction with the addition of the new building for the last eighteen months. The land adjacent to the Clinic (north west corner of Markham and Filmore Streets) has been used for parking the heavy construction equipment and storage trailers used in the construction. We are at the last stage of completion with our construction at this location. I think staff is agreeable to the schedule but we have not had good luck administratively approving modifications to the POD and or dates that items were to be completed at staff level. The owners attorney was told at the last hearing date to have the owner block the parking lot and not allow cars to park on the lot and then there would not be a violation. The owner has not secured the area -and continues to allow cars to park on the site. We do not feel we can approve this schedule at an administrative level.
