3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH TOTER, LLC, IN AN AMOUNT NOT TO
5 EXCEED TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00),
6 PLUS APPLICABLE TAXES AND FEES, FOR THE PURCHASE OF
7 APPROXIMATELY 4,000, NINETY-SIX (96)-GALLON GARBAGE CART
8 CONTAINERS FOR SOLID WASTE CUSTOMERS, LOCATED WITHIN
9 THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
10 PURPOSES.

12 WHEREAS, the Public Works Department Solid Waste Division utilizes Ninety-Six (96)-Gallon
13 Garbage Carts for garbage collection for Solid Waste Customers, located within the City of Little Rock,
14 Arkansas;and,
15 WHEREAS, vender selection, meeting the specifications needed, was made utilizing the Sourcewell
16 Government Purchasing Cooperative Agreement, Contract No. 041521-TOT;and,
17 WHEREAS,the total purchase price for approximately 4,000, Ninety-Six(96)-Gallon Garbage Carts
18 shall not exceed Two Hundred Fifty Thousand Dollars($250,000.00), plus applicable taxes and fees.
19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. The Board of Directors hereby authorizes the City Manager to enter into an agreement with
22 Toter, LLC, in an amount not to exceed Two Hundred Fifty Thousand Dollars ($250,000.00), plus
23 applicable taxes and fees, for the purchase of approximately 4,000,Ninety-Six(96)-Gallon Garbage Carts
24 for the Public Works Department Solid Waste Division.
25 Section 2. Funds for this purchase are allocated in the Solid Waste Enterprise Fund, Account No.
26 603110-60170.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or shall
29 not affect the remaining portions of the resolution, which shall remain in full force and effect as if the
30 portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution.
31 Section 4. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
32 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
