Mr. Carney:
I am writing to express my great concern and objection to the above referenced
rezoning request that is to be considered before the Little Rock Planning
Commission on Thursday, February 21, 2013. 1 am a resident in The Ridge
subdivision adjacent and just west of the subject property being requested for
rezoning from R-2 to C-3. Along with many of my neighbors, I firmly object to this
rezoning from R-2 to C-3 based primarily on the following;
1.) Such C-3 zoning will encroach on the residential zoning buffer surrounding
our neighborhood which we all currently enjoy. When considering and making
this home investment, I along with many of my neighbors relied on this
protective zoning buffer.
2.) Such C-3 zoning will undoubtedly increase the traffic flow on this section of
Cantrell making ingress and egress from the many surrounding residential
properties and neighborhoods even more difficult and dangerous. By
expanding the commercial node in to this residential area along Cantrell, such
would be Creating additional traffic where current voiurnes already exceed the
capacity of the roadway. Please also note the current configuration of Cantrell
Road does not allow for a center left turn lane just west of the Cantrell
Heights Shopping Center, thus making exiting traffic from an expanded
shopping center even more dangerous for neighbors and shoppers to
contend with on a daily basis.
3.) The proposed improvements of these lots being considered for rezoning will
undoubtedly compound drainage and water runoff issues for adjacent
property owners and those properties north of the Cantrell Heights Shopping
Center.
4.) This request for zoning does not appear to match up with the future Land Use
Plan outlined by the City for this area of Little Rock.
It is for these primary reasons listed above that I along with many other residential
owners in the area strongly object to this rezoning request. If this rezoning is allowed
to proceed, it is my great fear that this will be the first domino to fall in allowing
commercial development to span from this point on Cantrell all the way to 1 -430 thus
disrupting and negatively affecting a much larger number of residences along
Cantrell and those neighborhoods accessed directly and solely by Cantrell Road. In
light of such, I respectfully request that you present this letter to the Planning
Commission for its thoughtful consideration. It is my solid hope the Planning
Commission will agree that a "no" vote on this proposal is in the best interest of the
surrounding neighbors and the City of Little Rock as a whole.

The owner of the 3.62 acre property located at 8220-8300
Cantrell Road is requesting that the zoning be reclassified
from R-2 to C-3 and OS (with conditions).

The Planning Commission recommends approval of the
Ordinance. Staff recommends denial of the Ordinance.
The Planning Commission reviewed this issue at its
April 4, 2013 meeting. There were numerous objectors
present.
All owners of property located within 200 feet of the site
and the Robinwood Property Owners Association were
notified of the public hearing. Staff could find no contact
information for the Andover Square Neighborhood
Association.
The Commission voted to recommend approval of the
rezoning. The vote was 6 ayes, 3 noes, 1 abstention
(Fountain) and 1 open position.
BACKGROUND
Heights Real Estate Company and 65`n Street Center, Inc.,
owners of the 3.62 acre property located at 8220 — 8300
Cantrell Road, are requesting to rezone the property from
"R-2" Single Family District to "C-3" General Commercial
District (2.53 acres) and "OS" Open Space District (1.09
acres) (with conditions). The owner originally requested
the entire property be rezoned to C-3, but revised the
request to C-3 and OS (with conditions) prior to the
Planning Commission meeting. The owner is proposing
the following conditions for the proposed rezoning:
On -site:
• Agree to deed -restrict, prohibiting development, all the
land not zoned commercial.
• Double the number of plantings over required in the
west -side landscape buffer.
■ Direct site lighting downward and inward unless
otherwise required by City.
• Paint or use building materials colored to blend with
the foliage and vegetation.
Off -site:
• Extend the bi-directional turn lane of Highway Ten to
serve the site and Reservoir Park.
• Limit western -most entry -drive to right -in and right -out
only.
• Demolish liquor store to accommodate changes to
drives and traffic -signal access.
• Reconfigure the north leg of the intersection of
Highway Ten and Andover Court.

BACKGROUND
CONTINUED
The property is located on the north side of Cantrell Road,
west of Andover Court. The rezoning is proposed in order
to allow expansion of the existing Cantrell Heights
Shopping Center to the east. The overall ownership is
comprised of 5.653 acres, but the applicant is requesting
rezoning of just the south 3.62 acres. The overall property
has approximately 470 feet of frontage along Cantrell
Road.
The property is currently comprised of three (3) single
family residences within the west 360 feet of the property.
The east 100 feet of the property is undeveloped. The
areas to the north and west are zoned R-2 and contain
single family residences. An office development and the
entry to Reservoir Park are located across Cantrell Road to
the south. The reservoir is located to the southwest. A
mixture of residential (multi -family), office and
commercial uses and zoning is located to the east and
southeast.
The City's Future Land Use Plan designates this property
as Residential Low Density. A proposed Land Use Plan
Amendment to Commercial is a separate item on this
agenda.
Staff does not support the requested C-3 and OS rezoning.
Staff feels that commercial zoning is not appropriate for
the subject property. A west boundary line for the
commercial zoning and development was established a
number of years ago. The POD development across
Cantrell Road to the south was an in-fill/transitional
development between the commercial zoning and the
reservoir. The current C-3 and OS proposal would
eliminate three (3) existing single family homes along the
north side of Cantrell Road, extending the current
commercial zoning strip. Staff believes that eliminating
any of the single family homes along the north side of
Cantrell Road, west of the existing commercial zoning line
would be detrimental and have an adverse impact on the
adjacent single family properties and the general area.

Section 3. That the map referred to in Chapter 36 of the Code of Ordinances

Section 4. That the Ordinance shall take effect and be in full force 30 days
after the date of its passage and approval.
Section 5. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be
invalid or unconstitutional, such declaration or adjudication shall not affect the
remaining portions of the ordinance which shall remain in full force and effect as if
the portion so declared or adjudged invalid or unconstitutional was not originally a
part of the ordinance.
Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

Attached is the traffic study report we discussed today. Please note that I got this report Tuesday
and the revised survey on Thursday of last week. Ernie Peters has reviewed this report with Bill
Henry. I'm told Bill Henry had no objections to the study report or Peters & Associates'
recommendations except to note that a 300' spacing between driveways should be maintained.
But I won't speak for Bill. He can give you his comments himself. I've copied him on this
email so that he has a copy for his files and so that you know he got it and he knows you got it.
I will have a summary letter coming to you this week that outlines the proposed revisions to the
applications for Land Use and Zoning changes. As noted, key elements are a reduction of the
proposed area of C-3, a request for zoning of the remaining area to be changed from R-2 to OS,

and the addition of a request for an area along the west boundary to be zoned OS instead of the original
request of C-3
I don't know that Brian Minyard will want a copy of the traffic study report but I have copied him on
this email just in case.
Please note in the Commissioners package that we've made revisions to our proposal. In our opinion, in
the aggregate the revisions are substantial. They meet all or nearly all of the concerns raised by the
neighbors.

Land Adjacent to Cantrell Heights Shopping Center
Dear Mr. Moore:
Cantrell Heights shopping center is a commercial real estate property located at 8122 to
8218 Cantrell Road. This property is on the north side of Cantrell Road, directly across
Cantrell Road from Pavilion in the Park and Pavilion Centre. This letter accompanies
applications from the property owners requesting a change in the Land Use Plan and a
change in the Zoning Plan to allow for the expansion of Cantrell Heights Shopping Center.
The owners of Cantrell Heights own a vacant lot and three houses immediately to the
west. These houses all face Cantrell Road / Highway Ten and are rented to provide
investment income. Expansion of Cantrell Heights to the west would replace these houses
that were built in the 1940s, when this area was still a quiet country road referred to as
Perryville Road, with a use of the property that recognizes the changes that have come
with office buildings and shopping centers being built across the road, and the country
road becoming a five -lane urban highway,
The proposal for rezoning of this property is to allow the center to be expanded to provide
better circulation and access to the existing buildings and parking lot. Such expansion
would include additional restaurant, retail, office and other uses common to
neighborhood shopping centers. Cantrell Heights is zoned C-3 and it is the owners' desire
to continue the C-3 zoning to the west and maintain continuity in the zoning of the
extended center. Cantrell Heights was completed in 1976 and has served the surrounding
community since before growth of the retail, office & commercial uses across the highway.
Cantrell Heights has been, and will continue to be, a good fit in the neighborhood. The
topography of the land provides a natural barrier between the proposed extension of the
center and the residential properties to the north. Surrounding land uses include office
buildings, shopping centers, apartment buildings, condos, the Racquet Club, and Reservoir

Park. All of these uses have co -existed for years. Pavilion Centre office building to the
west of Cantrell Heights and directly across the highway from the proposed rezoning is
the most recent addition. In summary, the proposed rezoning is consistent with the land
use and zoning of the surrounding properties. It increases density rather than promoting
sprawl. It recognizes that the highest and best use of the property has changed as the
highway and surrounding properties have changed. And it may directly impact only one
residence. That residence, at 8308 Cantrell Rd., and two others at 8330 and 8350 Cantrell
sit across from Reservoir Park and just east of the gated entry to Ridgeview Dr. These
homes already endure the traffic on Highway Ten of over 31,000 cars per day. The
orientation of the properties provides that the required landscape buffers & building
setbacks allow for appropriate screening between the rezoned property and those houses.
The requested rezoning is not speculative; it is for the expansion and improved parking &
circulation of Cantrell Heights. Construction of new building(s) however will be demand -
driven and the full completion of this expansion may be years in the making. The owners
desire the expansion to provide access and circulation of traffic within the center. They
anticipate future western driveway(s) of the expansion will match the entrance to
Reservoir Park or the entrance to Pavilion Centre. This will allow better access to the
parking field in the rear of Cantrell Heights & will provide the expansion with access to the
existing traffic signal at the intersection of Andover Court that serves Pavilion in the Park
and other businesses. Existing businesses in Cantrell Heights will benefit from improved
access as will future businesses in new building(s) on the land proposed for rezoning.
A copy of the bill of assurance from 1925 was being located. It does not restrict current or
future uses. All necessary right-of-way dedications and street improvements appear to
have been made at the time this property was developed or during various widenings of
Highway Ten over the years. The property owner has submitted the necessary forms for
the dedication of additional right-of-way in the event that any is necessary.

Dear Monte,
As noted in my message of Thursday February 14, Cantrell Heights requests a deferral to
the next regular zoning agenda of the Planning Commission on April 4, 2013.
1 have met with many neighbors. In response to the concerns raised by neighbors, the
owners of Cantrell Heights have hired Peters and Associates for a traffic study and report.
The owners of Cantrell Heights have also asked West Land Surveying to revise the legal
description of the proposed area of rezoning. The owners are waiting on both of these.
The Peters & Associates report is expected to provide information helpful in
understanding what on -site and off -site improvements might be considered to best
address traffic into and out of the existing center and the proposed expansion.
West Land Surveying and the owners are evaluating the proposed expansion site to
determine the minimum distance necessary from the Highway 10 right-of-way to the
north to allow for expansion and traffic circulation as contemplated by the owners. The
area of the requested rezoning is anticipated to be less than the original area requested.
These things, and others, are in response to meetings and conversations with neighbors.
The owners have asked me to meet again with neighbors after getting the Peters & Assoc.
report and the revised land area. If this request is granted, we will do that as soon as the
report and survey are provided and fully expect to make a full presentation to the
Planning Commission on April 4th.

Dear
Cantrell Heights shopping center opened in 1976. Cantrell Heights is requesting a change in zoning of
adjacent land to allow for the expansion of Cantrell Heights. Only the front portion of the property is
affected by this request. The back portion is not part of this request and would remain zoned R-2. The
total area of the request is approximately the same size as the existing center. Cantrell Heights has been,
and will continue to be, a good fit in the neighborhood.
The owners of Cantrell Heights have long owned the vacant lot and three houses immediately to the west.
These houses all face Cantrell Road / Highway Ten and are rented. Expansion of Cantrell Heights to the
west would replace these houses that were built when Highway Ten was still a quiet country road with a
use of the property that matches the Pavilion Centre & Pavilion in The Park properties across Highway Ten.
The proposal for rezoning of this property is to allow the center to be expanded, and to provide better
traffic circulation and access for the existing buildings. Such expansion would include additional
restaurant, retail, office and other uses serving the neighborhood. The site is not a "big box" site. The area
of the request matches the existing center and is a similar shallow depth. The trees and valley behind the
center area provide a buffer between the center and residential properties to the north. The required
landscape buffers & building setbacks for expansion of Cantrell Heights will allow for appropriate
screening between any extension of Cantrell Heights and the houses to the west. Surrounding Cantrell
Heights to the north, east and south are office buildings, shopping centers, apartments, condos, the
Racquet Club, and Reservoir Park. All of these uses have co -existed for years. All of these uses find a
natural transition point to parks and residences at the entrance to Reservoir Park.
The area around Cantrell Heights is an established commercial area. Small infill redevelopment such as
this and larger infill projects like Midtowne & Park Avenue on University Ave. encourage neighborhood
shopping rather than promoting sprawl. The request recognizes that since Cantrell Heights was built, the

Dear Mr. Moore,
The Ridge Property Owners Association strongly opposes the proposed reclassification of 3.62
acres adjacent to Cantrell Heights Shopping Center from Residential (R-2) to Commercial (C-3). Over 900
homeowners in 4 subdivisions (The Ridge, Robinwood, River Ridge and Foxcroft) can be negatively
affected. Concerns include:
New commercial intrusion into an historically residential section of Cantrell Road
`r Significant increase in already heavy traffic flow
A realistic potential for increased crime
Decreased property values
The Cantrell Road corridor west of Cantrell Heights Shopping Center to 1-430 has remained solidly
residential for decades. Our concern is rezoning the 3.62 acres will begin a precedent of increasing
commercialization on this section of Cantrell Road. In 1976, this same property was submitted for
rezoning. The request was denied.
Traffic flow is currently overburdened on this section of Cantrell, which provides a major east -
west corridor for the city. Motor vehicle accidents are frequent and several are deadly. Speeding is a
constant concern. Heavy traffic loads make The Ridge ingress and egress difficult and hazardous. Traffic
concerns will become dangerous.
Crime occurs daily around our subdivision, especially in commercialized areas from Mississippi
Avenue to Andover Court and along Reservoir Road. C-3 rezoning will predictably increase crime.
The Ridge subdivision consists of 23 homes with high assessment values and high real estate
taxes. This proposal to rezone to commercial will detrimentally change the nature and value of our
properties as well as homes from 8220 Cantrell Road to Pleasant Valley Drive.

Although I am unable to attend the commission's February 21 meeting ,this email identifies my strong disapproval of the
Racquet Court in the Foxcroft neighborhood, which lies adjacent to the proposed rezoning area. proposed rezoning of Cantrell Road (8220, 224, and 8300) from R-2 to C-3 status. My opposition is shared by my neighbors on
Our street is already reached by the sounds of vehicles, their headlights in the evenings, and the lights of the buildings on the
existing commercial area of Cantrell Road. The development of additional commercial activity wili only increase these
unwelcome intrusions into one of Little Rock's finest and most livable streets.
Traffic and commerce on this section of Cantrell Road is already at a high level. The frequent re -leasing of businesses there
indicates that the existing structure offers ample opportunity for new business investment. Allowing additional commercial
development will only accelerate the problems of business turnover and storefront vacancy.
The residential sites and the magnificent trees in many of front yards along this stretch of the road offer a welcome relief from the
concentration of businesses and parking lots to the east. Little Rock needs a balanced usage of residential and commercial sites.
This balance will be negatively impacted by extending the existing strip mail and removing the green space/residential lots.

Mr. Carney:
I am writing to express my great concern and objection to the above referenced
rezoning request that is to be considered before the Little Rock Planning Commission
on Thursday, February 21, 2013. 1 am a resident in The Ridge subdivision adjacent and
just west of the subject property being requested for rezoning from R-2 to C-3. Along
with many of my neighbors, I firmly object to this rezoning from R-2 to C-3 based
primarily on the following;
1.) Such C-3 zoning will encroach on the residential zoning buffer surrounding our
neighborhood which we all currently enjoy. When considering and making this
home investment, I along with many of my neighbors relied on this protective
zoning buffer.
2.) Such C-3 zoning will undoubtedly increase the traffic flow on this section of
Cantrell making ingress and egress from the many surrounding residential
properties and neighborhoods even more difficult and dangerous. By expanding
the commercial node in to this residential area along Cantrell, such would be
creating additional traffic where current volumes already exceed the capacity of
the roadway. Please also note the current configuration of Cantrell Road does
not allow for a center left turn lane just west of the Cantrell Heights Shopping
Center, thus making exiting traffic from an expanded shopping center even more
dangerous for neighbors and shoppers to contend with on a daily basis.
3.) The proposed improvements of these lots being considered for rezoning will
undoubtedly compound drainage and water runoff issues for adjacent property
owners and those properties north of the Cantrell Heights Shopping Center.
4.) This request for zoning does not appear to match up with the future Land Use
Plan outlined by the City for this area of Little Rock.
It is for these primary reasons listed above that I along with many other residential
owners in the area strongly object to this rezoning request. If this rezoning is allowed to
proceed, it is my great fear that this will be the first domino to fall in allowing commercial
development to span from this point on Cantrell all the way to 1 -430 thus disrupting and
negatively affecting a much larger number of residences along Cantrell and those
neighborhoods accessed directly and solely by Cantrell Road. In light of such, I
respectfully request that you present this letter to the Planning Commission for its
thoughtful consideration. It is my solid hope the Planning Commission will agree that a
"no" vote on this proposal is in the best interest of the surrounding neighbors and the
City of Little Rock as a whole.

Dear Commissioner:
I am writing to you to express my extreme concerns about the proposal to rezone
four lots along Cantrell Road from R-2 residential to C-3 commercial and the resultant
impact on the residential areas near this location.
I live in The Ridge Subdivision and this project will essentially be in my back
yard, as well as those of some of my neighbors. The fact that this proposal, if approved,
will impact this neighborhood, the remaining homes along Cantrell and homes in
Foxcroft is unquestionable.
As proposed, there are NO RESTRICTIONS on the use of the property other
than the blanket provisions of C-3, which is very broad. There is no plan to deal with
lighting, shielding of the buildings, use of the development for parking or any restriction
on clubs or restaurants, etc. that could face our subdivision and Foxcroft. No detailed
plans of any nature have been provided by the developer. -A number of area residents
will be forced to look at whatever is placed there if the development is approved.
A map provided by the developer, which is attached as Attachment 1, shows an
aerial view of the immediate area. It is a photograph, and as such, it is accurate as far
as it goes. What it does not show is how close the proposed rezoned area comes to the
developed subdivisions of Foxcroft and The Ridge, as well as the remaining homes
along Cantrell. This is shown by the detail of the proposed rezoned area on Attachment
2. It bounds property along Cantrell, property in The Ridge and in Foxcroft.
Attachment 3 is a topographical map showing the line -of -sight impact on the
surrounding residential areas. By looking at this map, one can readily see that there is
a large valley between Foxcroft, The Ridge and Cantrell where the development is
proposed. The new development will be very visible to these areas and with

approximately 20% of the trees shown on the aerial photograph now on the ground
because of the Christmas storm, the property owners on the streets marked in red will
have a very clear view of the back of the development.
Attachments 4 and 5 are pictures of the back and west end of the current
development. Beauty is somewhat subjective, but I doubt that anyone really wants
these views in their back yard. I can assure you I do not.
I know others will address separate issues regarding this matter, so I will close
with a request that you consider the home owners that have invested hundreds of
thousands of dollars in their homes. All of the homes in The Ridge were built, starting in
the early to mid-1980s, after a prior attempt to rezone part of this area was rejected by
the Planning Commission. I would urge you to follow your past precedent which was to
reject a rezoning to commercial statue long before The Ridge was developed. Thank
you for your consideration in this matter.

Request to Rezone 3.62 acres Adjacent to Cantrell Heights Strip Mall
From Residential (112) to Commercial (0)
I write to encourage you to vote NO on the above mentioned zoning request (Case No. Z8829).
I would attend the meeting on Thursday, April 4 but I must be at the Governor's Mansion at the
same time to receive the Fribourgh Award at the same time as the Little Rock Planning
Commission will meet to consider this important decision.
When Betty and I made plans to retire from the University of Arkansas at Little Rock we had
originally planned to build a retirement home on a lot we owned on a lake in South Carolina.
However, as we thought about how much we enjoyed Little Rock we revisited our decision and
built a home her in The Ridge. We were attracted not only by the significant mixture of cultural
attractions in Little Rock but also by the general ambiance of the city that had been created by
the many attractive neighborhoods that had been carefully protected by judicious and careful
application of well -crafted zoning codes. Most Little Rock neighborhoods have been protected
by not allowing Residential (112) Zoning to be changed easily to Commercial (0) zoning.
We strongly oppose the re -zoning of the property referenced above not simply because it will
decrease property values because of the diminished residential zoning buffer, increase
potential for crime, and the almost certainty of increased vehicular accidents caused by traffic
entering and exiting the strip shopping mall onto an already overburdened traffic artery
(Cantrell). Increasing the size of the strip shopping mail, among the most unattractive of
developments, will lead to increased curb cuts into a road that carries a significant over load of
vehicles since there a few east -west arteries in this region of our city.
We strongly request that you protect the integrity of the neighborhoods in the immediate area
of the proposed re -zoning by voting NO.

On January 13, 2013 at our annual property owners meeting, Robinwood POA voted
unanimously to oppose rezoning the property included in case #Z8829 from its current
residential status to any other status not residential.
Please accept these 157 signed petitions from Robinwood residents opposing this
rezoning application its previous, current or any future form and make them a part of
the Planning Commission's files.
Reasons for our opposition include but are not limited to:
• Heavier traffic congestion
■ Higher traffic volume
■ Increased safety risks
• Destruction of desperately needed green space
• Encroachment into valued residential areas increased
• Surplus of available retail space renders adding more unnecessary
Additionally, we have conducted research on currently vacant and available for lease
retail space. Along Cantrell Road, between Kraftco and Pleasant Ridge Shopping Center,
there is currently nearly 35,000 sq. ft. of retail space available. And without including
Pleasant Ridge there is 19,932 sq. ft. available for lease at this time.
Our position is that rezoning the property in question is not only clearly unwanted, it's
completely unnecessary.

General Commercial District for commercial use of approximately 3.6 acres,
being a part of Tracts "C" and "D" of the 1925 Subdivision of Hyland
Homes Addition to the City of Little Rock, Arkansas. We believe that this
proposed rezoning will adversely affect the adjoining residential area and
seriously alter the character of that area, as well as increase the existing
