FISCAL IMPACT None RECOMMENDATION Approval of the right-of-way abandonment subject to the area of abandoned right-of-way being retained as public utility and drainage easement. CITIZEN The Planning Commission reviewed this issue as a part of PARTICIPATION a conditional use permit review on January 6, 2011. There were no objectors present. Notice was sent to the Central High and Downtown Neighborhood Associations and to all owners of properties located within 200 feet. Notice of the abandonment request was sent along with notice of a conditional use permit on the abutting lot. The Planning Commission voted 8 ayes, 0 noes, 1 absent and 2 open positions to recommend approval of the right-of-way abandonment. BACKGROUND Arkansas Baptist College is requesting the abandonment of the remaining one-half block of West 17`h Street right-of- way located immediately west of Dr. Martin Luther King, Jr. Blvd. The Mock and a half of 17`h Street right-of-way extending west to Marshall Street was abandoned by the City on July 20, 2010. At that time, the college did not own the lot at the southwest comer of 17`h and MLK. The college now owns all abutting property. The area of abandoned right-of-way will become a driveway providing access to parking and a service area. The area will be retained as utility and drainage easement. All Utilities and Public Works have approved abandonment of the right-of- way.
