The proposed project has been significantly scaled back although a variance still seems to me to be needed for replacement of the existing 6 foot fence with a new metal six foot fence to the extent that a portion of the rear line "backs" on to public Greenbrier Drive. A variance may also still be need for the front gate even though it is more than 25 feet (or rather right at 25 feet from Edgehill. I am going to be out of town tomorrow but wanted you to get the original and revised letters and confirm that we can still be on the November docket since the request is scaled back . A copy of a survey dated September 27, 2010 by Brooks Surveying, Inc. is attached as Exhibit "A". The property is also indicated as the area shaded on the "Assessor .Drawing" attached as Exhibit `B". The property is zoned R-2 and is currently being used as a single family residence fronting on Edgehill Road. The rear portion of the Lot is platted as Lot 9, Greenbrier Subdivision as can be seen from Exhibit `B". Across approximately 1/3 of the rear property line of the residential backyard the property "backs" onto publicly dedicated Greenbrier Road. The remaining 2/3 of the rear property line is contiguous to a paved private access drive from the end of publicly dedicated Greenbrier Road utilized by Lots 5, 6, 7, 8 and 9 of Greenbrier Subdivision. Currently there is an existing 6-foot wooden fence across the rear of the residential property west of Greenbrier Road and west of the jointly utilized continuation of that pavement as the private drive. Again, this is shown on the survey. The existing 6-foot wooden fence also borders the sides of the property as shown on the survey. The topography of the part of .Lot 9 between the existing wooden fence and the pavement on Greenbrier Road and the existing private access drive falls very steeply to the Northeast towards the pavement. The applicant wishes to construct a rear drive serving the property utilizing the existing private drive just east of where that private drive connects to the publicly dedicated end of Greenbrier Road and wishes to service that rear drive with a new gate and matching fence. The applicant proposes to replace the existing 6-foot wooden fence with a new fence. The fence is proposed to be 8 feet in height, but because it will be located further down, the slope between the existing rear fence (which will be removed) and the existing asphalt, the fence will by and large be only slightly higher from the pavement than the existing fence. The fence will be constructed of 84-inch metal "pickets" with an additional 2-inch bottom clearance. It will be visually permeable, unlike the current wood fence and will have two horizontal decorative supports near the top, and two horizontal decorative supports near the bottom. A markup of the design is attached as Exhibit "C". The fence will continue along the property line on both sides of the residential property. A similarly designed mechanical gate with two foot taller support posts will allow ingress and egress from the new back driveway. A similarly designed front gate would be installed that also requires a variance where the property driveway intersects .Edgehill. Existing low brick serpentine walls will be retained across the remainder of the front. There are several walls and gates in the immediate vicinity of the property on Edgehill for which similar variances seem to have been previously obtained.
