Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 4Ordinance Resolution Approval Information Report Approved By Bruce Moore City Manager The request is a rezoning of the site from R-2, Single- family to PCD to allow a safe and vault company to locate on the site. None. Staff recommends approval of the requested PCD zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 6 ayes, 0 noes, 3 absent, 1 open position and 1 recusal (Commissioner Troy Laha). The Planning Commission reviewed the proposed PCD request at its September 23, 2010, meeting. There were no registered objectors present. The Upper Baseline Neighborhood Association, Wakefield Neighborhood Association and Southwest Little Rock United, all residents who could be identified located within 300 feet of the site and all property owners located within 200-feet of the site were notified of the Public Hearing. The Wakefield Neighborhood Association and Southwest Little Rock United for Progress indicated support of the request. BACKGROUND The site contains an existing one story metal building with paved parking located along the western side of the building. The building contains 8,000 square feet and was constructed as an office/warehouse. There is a loading dock located along Young Road. Access to the loading dock is via a graveled drive extending from the paved parking to the dock area. An existing chain link fence is located around an outdoor storage area located to the east of the site. The applicant is proposing a rezoning of the site to PCD to allow the use of the building as an office/showroom/warehouse for the applicant's safe and vault division of the existing lock and key business. The site will be used for showroom and display of various safe and vault models. The site plan does not propose signage. Staff recommends should signage be desired in the future building signage be allowed as allowed in office zones or a maximum of ten percent of the fagade area abutting a public street. Staff recommends ground signage be limited to a maximum height of six (6) feet and a maximum sign area of sixty-four (64) square feet. The applicant is requesting twelve (12) months to remove the loading dock and install the landscaping along Young Road. According to the applicant there are a number of renovations necessary to bring the building back to an occupancy level including the installation of new heat and air units. The applicant has indicated all efforts will be made to install the new landscaping at the proper planting time. According to the site plan street trees will be installed with a 30-foot spacing along Young Road with a minimum of five new trees added. Shrubs will be installed with a 6-foot spacing with a minimum of 38 shrubs installed. An irrigation system is not proposed but a water source within 75-feet of the landscaped areas will be provided. Please see the attached Planning Commission minute record and site plan for the applicant's specific development proposal and the staff analysis and recommendation. See # 6 for further explanation. 3: 1-2 employees , 4: Not needed- no renovation on inside of building -this site will not produce enough waste that would require a dumpster. (existing site uses only city provided container since operation started in 1987) 5: Currently has Entergy lights on poles with lights directing down into site, also has small lights on side building. 6: C-3 zoning for office/showroom/warehouse. Site will be used for storage of new & used safes and safe moving trailer and equipment will also be stored in building. We understand that AAA Lock & Key, located on Baseline Road wants to use this property as warehouse and storage. We understand this would not be a retail space and would not be open to customers. It will certainly be an asset to the Young Road neighborhood. TITLE INSURANCE: Buyer and Seller understand that Listing Firm and Selling Firm are not licensed title insurance agents as defined by Arkansas law and do not and cannot receive direct or indirect compensation from any Closing Agent regarding the closing process or the possible purchase of title insurance by one or more of Buyer and Seiler. Regardless of the policy chosen, Buyer and Seller shall have the right to choose their Closing Agent(s). Within days of acceptance, Seller shall furnish to Buyer a commitment for an American Land Title Association (ALTA) owner's title insurance policy in the amount of the Purchase Price issued by a company of Seller's choice authorized to insure title to real property in the State of Arkansas and which company is reasonably acceptable to Buyer. Where the title commitment shows special exceptions to title other than those standard exceptions contained in the ALTA commitment form, and where such special exceptions relate to restrictions, conditions, defects or other matters that would interfere with Buyer's use or adversely affect the value of the Property, then within days of delivery of the title commitment, Buyer shall deliver written notice thereof to Seller. Such notice shall state specifically those exceptions to which Buyer objects. All objections not specifically enumerated within such a timely delivered notice shall be deemed to be waived by Buyer. Within �� days of Buyer's delivery of notice of objections to Seller, Seller may cure such objections or have the exceptions waived or removed by the title company issuing the commitment. If, within such lS day period, Seller fails to cure and/or waive such objections and exceptions, or within that period, Seller delivers written notice to Buyer that it will not so cure, then within 4 days from delivery of such notice from Seller or the end of the period within which Seller may cure (whichever is applicable), Buyer shall have the option to: a. Agree to extend the Closing date for days to give Seller additional time to cure such objections. GOVERNING LAW: This Real Estate Contract shall be governed by the laws of the State of Arkansas. 21.
